Ordinance No. 11371 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 1137 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING ARTICLE II OF CHAPTER 7 OF THE CODE OF THE CITY OF VERNON; ADOPTING BY REFERENCE THE 2007 CALIFORNIA FIRE CODE, INCLUDING APPENDICES; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH WHEREAS, the City of Vernon by Ordinance No. 1090 adopted the California Fire Code, 2001 Edition, including specified Appendices, and the Uniform Fire Code Standards with certain modifications and changes; and WHEREAS, Health and Safety Code Section 18938 (b) provides that the most recent editions of the Uniform Building Code, the National Electrical Code, the Uniform Plumbing Code, the Uniform Mechanical Code, and the California Existing Building Code (hereinafter the "codes"), as referenced in the California Building Standards Code, shall apply to all occupancies in the state and shall become effective 180 days after publication in the California Building Standards Code by the California Building Standards Commission (hereinafter referred to as the "Commission") or at a later date after publication established by said Commission; and WHEREAS, the 2007 California Fire Code, has been copyrighted and published by the International Code Council and the California Building Standards Commission, as the California Building Standards Code; and WHEREAS, the Commission has determined that the 2007 California Fire Code, as published in the California Building Standards Code, shall become effective January 1, 2008; and; WHEREAS, California Health and Safety Code Sections 13143.2(b), and 18941.5 allow certain amendments to the California Building Standards Code to be made by a local government, provided findings of necessity can be made; and WHEREAS, the amendments, deletions, and additions to the 2007 California Fire Code set forth in this ordinance are intended as amendments, deletions, and additions to the 1 2 3 4 5 6 7 8 corresponding requirements of the California Building Standards Code, based upon the findings hereinafter set forth, contained in the Staff Report, Fire Code Adoption dated October 23, 2007 or as otherwise authorized; and WHEREAS, it is in the interest of the public health, safety, and welfare to enact certain amendments to the California Fire Code as set forth herein because of climatic, geological, and topographical conditions, based upon the following findings: 1. Adverse climatic conditions and strong winds such as those in existence in the City of Vernon increase the likelihood of fire spreading (conflagration) from one building to 9 another; 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. Geological conditions in the City of Vernon are affected by the nearby location of earthquake faults that can create tremendous loss of life and structures in the City; 3.. Topographical conditions of the City of Vernon coupled with the density of buildings, limited setbacks, narrow access to buildings and narrow streets potentially create a problem for governmental agencies to respond to emergency conditions; and WHEREAS, most of the proposed amendments to the California Fire Code are presently in the Vernon City Code; and WHEREAS, the City Council of the City of Vernon is authorized, pursuant to Section 50022.2, et sec . of the California Government Code of the California Health and Safety Code, to adopt the California Fire Code as a primary building code, by reference in whole or in part and that the primary code may adopt by reference a secondary code in whole or in part; and WHEREAS, pursuant to Government Code Section 50022.3, the City Council on November 5, 2007, as continued on November 6, 2007, gave a first reading to this Ordinance and the title of said code to be adopted and standards, said standards are listed in Article 90, Article 91 and Appendix V-A of said code and a duly noticed public hearing will be held on December 3, 2007, for the purpose of considering the adoption; and THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein above are true and correct. - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 2: Fire Codes The City of Vernon hereby adopts by reference the 2007 California Fire Code, and all Appendices, copyrighted by the International Code Council and the Commission. SECTION 3: Article II of Chapter 7, Vernon City Code is hereby amended as follows: A. Section 7.10 is hereby amended to read as follows: Sec. 7.10. 2007 California Fire Code, adopted. The 2007 California Fire Code including all Appendices and standards contained l therein, copyrighted by the International Code Council and the Commission, subject however, to the amendments, additions, and deletions set forth in this article are adopted as the Fire Code of the City of Vernon. B. Section 7.12 is hereby amended to read as follows: Sec. 7.12. Amendments, Additions, and Deletions. The 2007 California Fire Code, is hereby amended as follows: (a) 2007 California Fire Code Sections 111.2.5, and Appendix Chapter 1 Section 108 are hereby deleted. (b) 2007 California Fire Code Section 503.2.1 is hereby amended to read as follows: Sec.503.2.1. Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 27 feet and an unobstructed vertical clearance of not less than 15 feet. (c) 2007 California Fire Code Section 508.5.5 is hereby amended to read as follows: Sec. 508.5.5. Clear Space around Hydrants Clear space of 31 feet in front of, 4 feet in rear of and 10 feet on both sides shall be maintained around each onsite hydrant. (d) 2007 California Fire Code Section 1504.2 is hereby amended to read as follows: - 3 - 1 2 3 4 5 6 7' 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Sec. 1504.2 Location of Spray -Finishing Operations. All inside or outside spray -finishing operations shall be conducted in an approved spray booth constructed in accordance with Section 1504. (e) 2007 California Fire Code Section 3301.1 is hereby amended to read as follows: Sec. 3301.1. Prohibited and Limited Acts. Explosive materials shall not be manufactured, tested or stored within the limits of the City of Vernon. (f) 2007 California Fire Code Section 3404.2.9.5.1 is hereby amended to read as follows: Sec. 3404.2.9.5.1. Storage of Class I and Class II Liquids. Storage of Class I and Class II liquids in above ground tanks outside of buildings within the City of Vernon and in areas 1,000 feet or more from the outside boundary of a kindergarten through 121h grade public school shall be in approved containers not exceeding 10,000 gallons in size. In areas of a lot or parcel within 1,000 feet of the outside boundary of said school, the only Class I or Class 11 liquids approved for storage in above ground tanks is diesel fuel which shall be in approved containers and shall be limited to either two (2) 1,000 gallon tanks or one (1) 2,000 gallon tank. (g) 2007 California Fire Code Section 3804.1 is hereby amended to read as follows: Sec. 3804.1 Storage of Liquefied Petroleum Gases. Storage and transportation of LP -gas and the installation and maintenance of pertinent equipment shall be in accordance with U.F.C. Standard No. 82-1. Storage is permitted within the limits of the City of Vernon except within 1,000 feet of a kindergarten through 12th grade public school. EXCEPTION: Storage of LP -gas not exceeding 2,000 gallons per parcel in approved containers is permitted in all areas within the limits of the City of - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Vernon. (h) 2007 California Fire Code Appendices A, C, VI-E, and VI-H are hereby deleted. (i) 2007 California Fire Code Appendix D Section D103.1 is hereby amended to read as follows: Sec. D103.1. Access Road. The dimension of the fire access road turnarounds shall be in accordance with City standards. (j) 2007 California Fire Code Appendix Chapter 1, Section 105.1.1 is hereby amended to read as follows: Appendix Chapter 1, Sec. 105.1.1. Permits Required. Permits required by this code shall be obtained from the fire code official. Issued permits shall be kept on the premises designated therein at all times and shall be readily available for inspection by the fire code official. Permit fees shall be as set forth in a fee schedule adopted by resolution by the City Council. (k) 2007 California Fire Code Section 508.5 is hereby amended to read as follows: ' Sec. 508.5. Fire Hydrant System. When any portion of the facility or building protected is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the facility or building, on -site fire hydrants and mains capable of supplying the required fire flow shall be provided when required by the chief. SECTION 4: Enactment of Penalty Sections. Pursuant to Government Code Section 50022.4 the following penalty sections are specifically enacted and published as set forth in Exhibit A attached hereto, and made a part hereof by reference, except as otherwise amended or deleted in this ordinance: 2007 California Fire Code, Sections 103.1, 103.3, 104.1, 104.3, 104.3.1, 104.5, 106.1, 109.1, 109.2, 109.2.1, - 5 1 2 3 4 5 61 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 109.2.2, 109.2.3, 109.2.4, 109.3, 109.3.1, 110.1, 110.1.1, 110.1.2, 110.2, 110.3, 110.4, 111. 1, 111.2, 111.3 and 111.4. SECTION 5: Ordinances Repealed. Any ordinance, part of an ordinance, or code section in conflict with this Ordinance is hereby repealed. A violation of this ordinance or any part hereof is punishable by a fine of not more than Five Thousand Dollars ($5,000.00) or by imprisonment in the County Jail for a period of not more than six (6) months, or by both such fine and imprisonment. Each day or any portion thereof during which any violation of any provision of this ordinance is committed, continued or permitted, constitutes a separate and individual offense. SECTION 7: Severability. If any section, subsection, sentence, clause, or phrase or word of this ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance; it being the intention of the City Council of the City of Vernon to adopt and pass this ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that one or more of the sections, subsections, clauses, sentences or phrases thereof may be declared void or unconstitutional. SECTION 8: Copies on File with City Clerk. Pursuant to Government Code Section 50022.6, one certified copy the 2007 California Fire Code shall be made available for public inspection in the office of the City Clerk. SECTION 9: Posting. There being no newspaper printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance and shall post the same, or cause the same to be posted, within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board located outside on the wall - 6 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 near the second floor entrance to the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California. The department of fire prevention is established within the jurisdiction under the direction of the fire code official. The function of the department shall be the implementation, administration and enforcement of the provisions of this code. 103.3 Deputies. In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the fire code official shall have the authority to appoint a deputy fire code official, other related technical officers, inspectors, and other employees. SECTION 104 — GENERAL AUTHORITY AND RESPONSIBILITIES 104.1 General. The fire code official is hereby authorized to enforce the provisions of this code and shall have the authority to render interpretations of this code, and to adopt policies, procedures, rules and regulations in order to clarify the application of its provisions. Such interpretations, policies, procedures, rules and regulations shall be in compliance with the intent and purpose of this code and shall not have the effect of waiving requirements specifically provided for in this code. 104.3 Right of entry. Where it is necessary to make an inspection to enforce the provisions of this code, or whenever the fire code official has reasonable cause to believe that there exists in a building or upon any premises any conditions or violations of this code which make the building or premises unsafe, dangerous or hazardous, the fire code official shall have the authority to enter the building or premises at all reasonable times to inspect or to perform the duties imposed upon the fire code official by this code. If such building or premises is occupied, the fire code official shall present credentials to the occupant and request entry. If such building or premises is unoccupied, the fire code official shall first make a reasonable effort to locate the owner or other person having charge or control of the building or premises and request entry. If entry is refused, the fire code official has recourse to every remedy provided by law to secure entry. 104.3.1 Warrant. When the fire code official has first obtained a proper inspection warrant or other remedy provided by law to secure entry, an owner or occupant or person having charge, care or control of the building or premises shall not fail or neglect, after proper request is made as herein provided, to permit entry therein by the fire code official for the purpose of inspection and examination pursuant to this code. 104.5 Notices and orders. The fire code official is authorized to issue such notices or orders as are required to affect compliance with this code in accordance with Appendix Chapter 1, Sections 109.1 and 109.2. SECTION 106 - INSPECTIONS 106.1 Inspection authority. The fire code official is authorized to enter and examine any building, structure, marine vessel, vehicle or premises in accordance with Appendix Chapter 1, Section 104.3 for the purpose of enforcing this code. SECTION 109 — VIOLATIONS 109.1 Unlawful acts. It shall be unlawful for any person, firm or corporation to erect, construct, alter, repair, remove, demolish or utilize a building, occupancy, premises or system regulated by this code, or cause same to be done, in conflict with or in violation of any of the provisions of this code. 109.2 Notice of violation. When the fire code official finds a building, premises, vehicle, storage facility or outdoor area that is in violation of this code, the fire code official is authorized to prepare a written notice of violation describing the conditions deemed unsafe and, when compliance is not immediate, specifying a time for reinspection. 109.2.1 Service. A notice of violation issued pursuant to this code shall be served upon the owner, operator, occupant, or other person responsible for the condition or violation, either by personal service, mail, or by delivering the same to, and leaving it with, some person of responsibility upon the premises. For unattended or abandoned locations, a copy of such notice of violation shall be posted on the premises in a conspicuous place at or near the entrance to such premises and the notice of violation shall be mailed by certified mail with return receipt requested or a certificate of mailing, to the last known address of the owner, occupant or both. 109.2.2 Compliance with orders and notices. A notice of violation issued or served as provided by this code shall be complied with by the owner, operator, occupant or other person responsible for the condition or violation to which the notice of violation pertains. 109.2.3 Prosecution of violations. If the notice of violation is not complied with promptly, the fire code official is authorized to request the legal counsel of the jurisdiction to institute the appropriate legal proceedings at law or in equity to restrain, corrector abate such violation or to require removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the order or direction made pursuant hereto. 109.2.4 Unauthorized tampering. Signs, tags or seals posted or affixed by the fire code official shall not be mutilated, destroyed or tampered with or removed without authorization from the fire code official. 109.3 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate sued under provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than $5,000.00 or by imprisonment not exceeding 6 months, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense. 109.3.1 Abatement of violation. In addition to the imposition of the penalties herein described, the fire code official is authorized to institute appropriate action to prevent unlawful construction or to restrain, correct or abate a violation; or to prevent illegal occupancy of a structure or premises; or to stop an illegal act, conduct of business or occupancy of a structure on or about any premises. SECTION 110 — UNSAFE BUILDINGS 110.1 General. If during the inspection of a premises, a building or structure or any building system, in whole or in part, constitutes a clear and inimical threat to human life, safety or health, the fire code official shall issue such notice or orders to remove or remedy the conditions as shall be deemed necessary in accordance with this section and shall refer the building to the building department for any repairs, alterations, remodeling, removing or demolition required. 110.1.1 Unsafe conditions. Structures or existing equipment that are or hereafter become unsafe or deficient because of inadequate means of egress or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or which involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition. A vacant structure which is not secured against unauthorized entry as required by Section 311 shall be deemed unsafe. 110.1.2 Structural hazards. When an apparent structural hazard is caused by the faulty installation, operation or malfunction of any of the items or devices governed by this code, the fire code official shall immediately notify the building code official in accordance with Appendix Chapter 1, Section 110.1. 110.2 Evacuation. The fire code official or the fire department official in charge of an incident shall be authorized to order the immediate evacuation of any occupied building deemed unsafe when such building has hazardous conditions that present imminent danger to building occupants. Persons so notified shall immediately leave the structure or premises and shall not enter or re-enter until authorized to do so by the fire code official or the fire department official in charge of the incident. 110.3 Summary abatement. Where conditions exist that are deemed hazardous to life and property, the fire code official or fire department official in charge of the incident is authorized to abate summarily such hazardous conditions that are in violation of this code. 110.4 Abatement. The owner, operator, or occupant of a building or premises deemed unsafe by the fire code official shall abate or cause to be abated or corrected such unsafe conditions either by repair, rehabilitation, demolition or other approved corrective action. SECTION I I I — STOP WORK ORDER 111.1 Order. Whenever the fire code official finds any work regulated by this code being performed in a manner contrary to the provisions of this code or in a dangerous or unsafe manner, the fire code official is authorized to issue a stop work order. 111.2 Issuance. A stop work order shall be in writing and shall be given to the owner of the property, or to the owner's agent, or to the person doing the work. Upon issuance of a stop work order, the cited work shall immediately cease. The stop work order shall state the reason for the order, and the conditions under which the cited work is authorized to resume. 111.3 Emergencies. Where an emergency exists, the fire code official shall not be required to give a written notice prior to stopping the work. 111.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $100 or more than $5,000.
