AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA, 1959, BY ADDING A NEW ARTICLE XII TO
CHAPTER 24 RELATING TO PLACARDS USED TO DENOTE
CONDITIONS RELATING TO CONTINUED OCCUPANCY OF
BUILDINGS AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the City of Vernon (the "City") is a municipal
corporation and a chartered city of the State of California organized
and existing under its Charter and the Constitution of the State of
lCalifornia; and
WHEREAS, on May 18, 1999, the City Council of the City of
Vernon adopted Ordinance No. 1073 adopting by reference, except as
modified or changed, the 1997 Uniform Code for the Abatement of
Dangerous Buildings published by the International Conference of
Building Officials; and
WHEREAS, on August 6, 2007, the City Council of the City of
Vernon adopted Ordinance No. 1133 adding Article XI to Chapter 24,
Repair and Reconstruction of Damaged Structures, of the Vernon City
Code and adopting by reference the 2006 Edition of the International
Existing Building Code except as modified or changed; and
WHEREAS, the Office of Emergency Services is encouraging all
jurisdictions to adopt revised ATC-20 placards included in the Post -
Disaster Safety Assessment Program in order to have a uniform placard
system in place throughout the state; and
WHEREAS, the Director of Community Services & Water has
recommended the adoption of placards in conformance with the Safety
28 IlAssessment Program; and
I WHEREAS, Chapter 24of the Vernon —City --Code pertains—to--
2building and construction; and
3 WHEREAS, Chapter 4.1(f) and (h) of the Charter of the City of
4 Vernon provides that an ordinance shall amend a code or repeal any
5 ordinance or code previously adopted.
6 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
7 SECTION 1: The City Council of the City of Vernon hereby
8 finds and determines that the recitals contained hereinabove are true
9 and correct.
10 SECTION 2: The City Council of the City of Vernon hereby
11 amends Chapter 24, Building and Construction, of the Vernon City Code,
12 by adding a new Article XII to Chapter 24, Safety Assessment Placards,
13 as set forth in Exhibit A which is attached hereto and incorporated by
14 reference.
15 SECTION 3: Any ordinance, part of an ordinance, or code
16 section in conflict with this Ordinance is hereby repealed.
17 SECTION 4: If any section, subsection, sentence, clause,
18 phrase or word of this Ordinance is for any reason held to be void or
19 unconstitutional, such decision shall not affect the validity of the
20 remaining portions of this Ordinance; it being the intention of the
21 City Council of the City of Vernon to pass and adopt this Ordinance and
22 each section, subsection, sentence, clause or phrase thereof
23 irrespective of the fact that one or more of the sections, subsections,
24 clauses, sentences or phrases thereof may be declared to be invalid or
25 unconstitutional.
26 SECTION 5: There being no newspaper printed, published or
27 circulated in the City of Vernon, the City Clerk is hereby directed to
28 certify to the passage of this Ordinance and shall post the same, or

1 cause the same to be posted, within fifteen (15) days after its passage
2 in accordance with Section 36933 of the Government Code, in three (3)
3 of the most public places in the City of Vernon, to wit: the northwest
4 corner of 38th Street and Santa Fe Avenue, the northeast corner of
5 Leonis Boulevard and Pacific Boulevard, and on the bulletin board
6 located outside on the wall near the second floor entrance to the City
7 Hall of said City, located at 4305 Santa Fe Avenue, all in the City of
8 Vernon, County of Los Angeles, State of California.
9 SECTION 6: This Ordinance shall be in full force and effect
10 thirty (30) days from and after its passage of the same.

2 CHAPTER 24. BUILDING AND CONSTRUCTION.

4 ARTICLE XII. Safety Assessment Placards.
5 Sec. 24.100. Intent.
6 This article establishes standard placards to be used to indicate
7 the condition of a structure for continued occupancy. This article
8 further authorizes the Building Official and his or her authorized
9 representatives to post the appropriate placard at each entry point to
10 a building or structure upon completion of a safety assessment.
11 Sec. 24.101. Application of Provisions.
12 The provisions of this article are applicable to all buildings and
13 structures of all occupancies regulated by the City of Vernon. The
14 Council may extend the provisions as necessary.
15 Sec. 24.102. Definitions.
16 (a) Green placard identifies the building or structure as being
17 safe to occupy.
18 (b) Red placard identifies the building or structure as being
19 unsafe to occupy.
20 (c) Safety assessment is a visual, non-destructive examination of
21 a building or structure for the purpose of determining the condition
22 for continued occupancy.
23 Ad) Yellow placard places restrictions on the occupancy.
24 Sec. 24.103. Placards.
25 (a) The following are verbal descriptions of the official
26 jurisdiction placards to be used to designate the condition for
27 continued occupancy of buildings or structures. Copies of actual
28 placards are attached.

2 any building or structure wherein no apparent structural hazard has
3 been found. This placard is not intended to mean that there is no
4 damage to the building or structure. This placard is green.
5 (2) RESTRICTED USE is to be posted on each building or
6 structure that has been damaged wherein the damage has resulted in some
7 form of restriction to the continued occupancy. The individual who
8 posts this placard will note in general terms the type of damage
9 encountered and will clearly and concisely note the restrictions on
10 continued occupancy. This placard is yellow.
11 (3) UNSAFE - Do Not Enter or Occupy is to be posted on each
12 building or structure that has been damaged such that continued
13 occupancy poses a threat to life safety. Buildings or structures
14 posted with this placard shall not be entered under any circumstance
15 except as authorized in writing by the Building Official,,or his or her
16 authorized representative. Safety assessment teams shall be authorized
17 to enter these buildings at any time. This placard is not to be used or
18 considered as a demolition order. The individual who posts this
19 placard will note in general terms the type of damage encountered.
20 This placard is red.
21 (b) The name of the jurisdiction, its address, and phone number
22 shall be permanently affixed to each placard.
23 (c) Once it has been attached to a building or structure, a
24 placard is not to be removed, altered or covered until done so by an
25 authorized representative of the Building Official. It shall be
26 unlawful for any person, firm or corporation to alter, remove, cover or
27 deface a placard unless authorized pursuant to this article.
