1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PX-1 ORDINANCE NO. 1155 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTIONS 16.15 AND 16.16 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, TO CHANGE SPEED LIMITS ON CERTAIN STREETS AND TO REPEAL ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH WHEREAS, the City of Vernon (the "City") is a municipal corporation and a chartered city of the State of California organized and existing under its Charter and the Constitution of the.State of (California; and WHEREAS, on March 3, 2004., the City Council of the City of Vernon adopted Ordinance No. 1099 to establish speed limits on certain streets in accordance with a Speed Zone Survey dated January.2004; and WHEREAS, Hartzog & Crabill, Inc. prepared an Engineering and Traffic Survey on Speed Limits dated March 2009 ("Engineering and Traffic Study") on behalf of the Community Services Department for the purpose of evaluating existing speed limits on various streets within the City of Vernon; and WHEREAS, the Community Services Department has recommended that the City Council accept and approve the recommendations contained in the Engineering and Traffic Study and that the Vernon City Code be amended by retaining existing speed limits on some streets and changing speed limits on other streets based on the Engineering and Traffic Study; and WHEREAS, Vehicle Code Section 22357 authorizes cities to determine and declare prima facie speed limits greater than 25 miles per hour on the basis of an engineering and traffic survey; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, according to the Engineering and Traffic Study, the recommendations for prima facie speed limits of 30, 35, 40 and 45 miles per hour on certain streets will facilitate the orderly movement of vehicular traffic and will be reasonable and safe on those streets; and WHEREAS, said Engineering and Traffic Study supports the enforcement of the prima facie speed limit of 30, 35, 40 and 45 miles, per hour on certain streets; and WHEREAS, the California legislature has established various criteria for preparing an engineering and traffic survey and determining speed limits therein in order to promote uniformity throughout the State; and WHEREAS, Vehicle Code Section 40802 provides that .radar may not be used as an enforcement tool if the posted limits are set without being justified in fact by an engineering and traffic survey; and WHEREAS, certain sections of the Vernon Code need to be amended to.establish the speed limits recommended in the Engineering and Traffic Study; and WHEREAS, Chapter 4.1(f) and (h) of the Charter of the City of Vernon provides that an ordinance shall amend a code or repeal any ordinance or code previously adopted. THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. Speed limits on certain streets --Forty miles per hour. Pursuant to Vehicle Code Section 22357, the city council hereby determines and declares that the prima facie speed limit on the following streets shall be forty (40) miles per hour: ALAMEDA STREET -WEST The northbound lanes from the northern city boundary to the southern city boundary DISTRICT BOULEVARD From Downey Road to Atlantic Boulevard 37TH STREET VERNON AVENUE LEONIS BOULEVARD LEONIS BOULEVARD PACIFIC BOULEVARD 381h STREET From Santa Fe Avenue to Soto Street From Alameda Street to Santa Fe Avenue From Pacific Boulevard to Boyle Avenue From Boyle Avenue to Downey Road From Santa Fe Avenue to the southern city boundary From Santa Fe Avenue to the BNSF Railroad tracks east of Santa Fe Avenue Every violation of this section by propelling a vehicle in excess of the speed limit provided for herein is hereby declared to be a public nuisance. SECTION 3: Section 16.16 of the Vernon City Code, is hereby amended to read as follows: Sec. 16.16. SECTION 4: Any ordinance, part of an ordinance, or code section in conflict with this Ordinance is hereby repealed. SECTION 5: If any section, subsection, sentence, clause, phrase or word of this Ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance; it being the intention of the City Council of the City of Vernon to pass and adopt this Ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that one or more of the sections, subsections, clauses, sentences or phrases thereof may be declared to be invalid or unconstitutional. SECTION 6: In accordance with Government Code §36933, the City Clerk is hereby (a) directed to cause a summary of this Ordinance to be published at least once in the Vernon Sun and to cause a certified copy of the full text of this Ordinance to be posted in the Office of the City Clerk at least five (5) days prior to the adoption of this Ordinance; and (b) directed to certify to the passage of this Ordinance and to publish at least once in the Vernon Sun the summary of this Ordinance with the names of those City Council Members voting for and against this Ordinance and to post in the Office of the City Clerk a certified copy of the full text of this adopted Ordinance along with the names of those City Council members voting for and against this Ordinance within fifteen (15) days after passage of this Ordinance. - 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 7: This Ordinance shall be in full force and effect thirty (30) days from and after its passage of the same. Services and Water Speed Limits in the City of Vernon - 2009 Ordinance The City of Vernon has the authority to establish, by ordinance, speed limits that "would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street." California Vehicle Code Section (CVC) 22357 specifies that the City may establish the speed limits upon the basis of an engineering and traffic survey. The survey is defined in CVC Section 627 and must incorporate prevailing speeds, collision records, highway, traffic, and roadside conditions not readily apparent to the driver and residential density except in a business district. However, CVC Section 40802 does not allow the creation of a "speed trap" which is a particular section of highway that has a prima facie speed limit that is not justified by an engineering and traffic survey within five years prior to the date of the alleged violation. The City of Vernon established speed limits in 2004 and has secured an engineering and traffic survey by a consultant to establish the new speed limits in the City. The consultant, Hartzog and Crabill has surveyed the City and measured the speeds of the vehicles throughout the City on representative sections of each street and has reported the recommendations in the attached report. The consultant collected the speed data from 40 different roadway segments on 19 different collectors and arterials in the City. The data is collected at free flowing points in the roadway segments on week days and off peak hours with fair weather conditions. An unmarked car with an inconspicuous speed meter is used with the speed meter validated for accuracy before each use. The sampling normally consists of a minimum of 100 vehicles. The 10 mph pace range, the average speed and the 85t' percentile speed are determined from the speed data. The 85t' percentile speed is the speed that 85% o of the vehicles are traveling at or below this speed and is known as the critical speed. From experience, traffic engineers have determined that this critical speed is the most reliable speed to set an appropriate speed limit to allow orderly movement of traffic with the highest safety level. Moreover, the Vehicle Code specifies that the speed limits must be set within 5 mph of the 85' percentile speed of free -flowing traffic unless unusual conditions not readily apparent to drivers are present. The consultant has considered any unusual traffic, roadway, and roadside conditions that could affect the motorist in each segment and has recommended any alterations in the recommended speed limits. The collision history of the roadway is also incorporated in the setting of the speed limit for a roadway segment. The consultant has considered all the above elements and has recommended the speed limits for the segments of roadway in the City: The recommendations and the justifications for the speed limits are provided in the attached report. The consultant has recommended that the ordinance for the new speed limits will be the same as the one enacted in 2004 with the exception of the speed limits for the following street segments which are recommended to be increased: Leonis Blvd. - Pacific Blvd. to Boyle Avenue Leonis Blvd. — Boyle Avenue to Downey Road Previous Speed Recommended 35 mph 40 mph 35mph 40 mph In addition, a new street was constructed and named Pennington Way. Since this segment of street is an extension of 26�1 Street and the speed limit on this street as well as the 26t' Street Bridge over Atlantic Blvd. that transitions into Pennington Way has been determined to be 35 mph, it is recommended that the speed limit be set at 35 mph. Pennington Way — 26t' Street to Bandini Blvd. Recommended speed limit 35 mph The setting of the speed limits by the engineering and traffic survey will permit the Police Department to enforce the speed limits in the City. The speed limits will be posted by Community Services on clearly visible signage throughout the City. With the enactment of the ordinance the speed limits are established with the Courts and any citations are enforceable along with the fines imposed for any violations. ENGINEERING AND TRAFFIC SURVEY FOR SPEED LIMITS Introduction I In accordance with procedures established by the State of California, this Engineering and Traffic Survey has been developed for the City of Vernon as the basis for the establishment and enforcement of speed limits for selected' streets within the, City. The work herein was authorized by the City and was performed by the engineering consulting firm of Hartzog & Crabill, Inc. The goal of the review was two -fold. The first was to review new roadway segments to determine if speed limit postings should be recommended. The second involved a determination as to whether changes in pre- existing conditions have occurred where existing speed limits should be modified. The requirement to perform Engineering and Traffic surveys for speed limits is based on the California Vehicle Code. It indicates that once every five (5) years (may be extended to 7 years under certain conditions), to conform to Section 408028 of the California Vehicle Code (CVC), speed surveys must be performed with the use of radar or other approved electronic devices if the use of radar is to be employed to enforce speed limits. If such a .survey is not performed, then the new data and its use will constitute a "speed trap".. Per the Vehicle Code, a "speed trap" is either of the following: j (a) A particular section of a highway measured as to distance and with boundaries l marked, designated, or otherwise determined in order that the speed of a vehicle may be calculated by securing the time it takes the vehicle to travel the known distance. b A articular section of a highway with a prima facie speed limit provided b this code t O p 9 y P Pe P y or by local ordinance pursuant to paragraph (1) of subdivision (b) of Section 22352, or established pursuant to Section 22354, 22357, 22358, or 22358.3.which speed limit is not justified by an engineering and traffic survey conducted within a specked date of the alleged violation, and where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects. The definition of a Traffic and Engineering Survey is contained in Section 627 of the 1 Vehicle Code and is as follows: ..l Engineering and Traffic survey, as used in this code, means a survey of highway and traffic conditions in accordance with methods contained within the California Manual on Uniform Traffic Control Devices (CA. MUTCD) for use by State and local authorities. An engineering and traffic survey shall include, among other requirements deemed necessary by the Department, consideration of the following: (a) Prevailing speeds as determined by traffic engineering measurements. (b) Accident records. (c) Highway, traffic and roadside- conditions not readily apparent to the driver. The California Vehicle Code: (CVC) and the CA. MUIrCD, have set certain regulations regarding the: posting and enforcement of speed zones.These regulations ` generally reflect that speed zoninglestablishment should be based on traffic conditions and natural driver behavior and not because of an arbitrary response. to a traffic event or occurrence. Therefore, it is important to have a general a understanding of the ""Basic Speed Law", "Prima Facie Speed Limits" and _ "Intermediate Speed Zones". NOW a" Ift All fifty states base their speed regulations on the Basic Speed Law. In California, CVC 22350 defines the basic speed law as: "No Person shall drive a vehicle upon a highway at a speed .greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property." This law recognizes that driving conditions vary widely from time -to -time and place -to - place and; therefore, no set of fixed driving rules will adequately serve all conditions. The motorist will constantly adjust his driving behavior to fit the conditions he I encounters. He must learn to do this with a minimum of assistance from the police; l The Basic Speed law is founded on the belief that a majority of motorists are able to modify their driving behavior properly, as long as they are aware of the conditions = 7 around them, in a reasonable manner. Prima F_ggie §R22d Umits (CVC 2,2351) All other speed limits are prima facie limits which, "on the face of it", are reasonable and prudent under normal conditions. A driver may exceed any prima facie limit if it is safe to do so under prevailing conditions. However, when a police officer cites a driver for exceeding a prima facie speed limit, it is up to the driver to prove, if he can, that he was driving in a reasonable and prudent manner under the existing conditions. The opportunity given to the driver to exceed a prima facie speed limit when it is safe to do _ so recognizes the fact that any posted speed limit cannot adequately reflect the many different conditions of traffic; weather, visibility, etc., that may be found on the same highway at different times. Certain prima facie limits are established by law (CVC 22362). These include a 15 mph limit in alleys, Mind intersections, blind railroad crossing, and the 25 mph limit in business and residence districts. There is also a part time 25 mph limit in school zones when children are present enroute to or from school. Business and residence districts are defined in the Vehicle Code as specific areas meeting a specified minimum density of roadside development. CVC Sections 235 and r� r 240 define these regulations. A count of houses or active businesses facing on a highway must be made to determine whether or not a valid business or residence' district exists. The law does not require posting these prima facie limits, which are readily apparent. e Establishment of Speed Zones Previously speed limits were established at or below the closest 5-mile increment to the 85th percentile speed. Recent changes to be brought before the California Traffic Control Devices Committee (CTCDC) when a speed limit is to be posted, it shall be within 10 km/h or 5 mph of the 85th percentile speed of free -flowing traffic, except as shown below in option. Option: The posted speed limit may be reduced by 10 km/h or 5 mph from the 10 km/h or 5 mph increment of the 850 percentile speed, if unusual conditions not readily apparent to drivers, such as significantly higher collision rates or other factors exist, as long as those conditions are in compliance with all the appropriate sections of the CVC, especially CVC Sections 627 and 22358.5. Standard: If used, a one-time 10 km/h or 5 mph reduction, according to CC Sections 627 and 22358.5, shall be documented in writing. The final, posted speed limit shall not be less than the 50th percentile speed, Data Collection Procedures Speed evaluation data was collected at 40 different roadway segments on 19 different roadways in the City of Vernon. These areas and the number of segments on each are described as follows: 1. 25th Street (1) 11.Downey Road (2) 2. 26th Street (4) 12. District Boulevard (3) As described in various traffic engineering documents - including information provided by the State of California, the individual locations on which radar data collection procedures were used involved considerations for the following: a. Stop sign or traffic signal locations; b. Visibility problems; 3 7 c. Traffic flow opportunities at or near intersections, major driveways, crosswalks, railroad crossings and unusual turning movements;< ` d. The influence of other traffic factors on the speed of cars such as from parking, r roadway features, and lighting. _. j Sneed Toning Lffiodolouv The CA. MUTCD specifies a , 'short method" of determining speed limits on City and County roadways. and local Streets, excerpted as follows; 1 City and County Through Highways, Arterial and Collector Loads Procedures. ` The short method of speed zoning is based on the premise that the reasonable speed limit is one that conforms to the actual behavior of the majority of motorists, and that by measuring motorists' speeds, one will be able to select a speed limit that is both reasonable and effective. If there are other factors, such as high pedestrian volumes coupled with lack of sidewalks, etc. that might require further down zoning of speeds, then it is recommended that the procedure for speed zoning on State Highways be followed. However, experience has proven that the short method will handle most situations adequately. Steed done Survey Only one person is required for the fieldwork. Speeds can be read directly from a ` radar speed meter. The radar speed meter accuracy is validated prior to each use. A section of road should be selected with representative operating speeds. If speeds vary on a given road, additional surveys should be conducted. In this case, it may be necessary to establish additional speed zones with different speed limits. The section selected should be straight and should have no traffic signal, stop sign or intersection with a major cross street. i Speed measurements should be taken during off-peak hours on weekdays. The i weather should be fair with no unusual conditions prevailing. It is important that the surveyor and his equipment be so inconspicuous so as to not affect traffic speeds, For this reason, an unmarked car is used, with the radar speed meter located as inconspicuously as possible. It should be placed so as to be able to survey traffic in both directions, where feasible and shouldnot make an angle greater than 15 degrees with the roadway centerline. It is desirable to have a minimum sample of 100 automobiles in each survey. This may, result in excessive survey periods for low -volume roads. Under these conditions, the survey should be conducted for a minimum of two hours, but in no case should the sample for any survey contain less than 50 automobiles. 4 As previously discussed, speed limits are established within 5 mph of the 85th t percentile speed, which is defined as that speed at or below which 85 percent of the traffic is moving. This speed can be selected directly from the data sheet. However, roadway conditions not readily apparent to the motorist may result in a further reduction of 5 mph in the recommended seed limit. Under no circumstance may the speed limit be established lower than the 50 percentile speed. As a check on the validity of the proposed speed limit, an analysis should be made of ` the three-year accident record for the section of roadway under consideration. If this record shows an abnormally high percentage of accidents associated with excessive speeds, the proposed speed limit should be further reduced. This is a judgment ] situation, and will not usually be a factor. Short speed zones of less than half a mile should be avoided, except in transition _. areas. j Speed zone changes should be coordinated with changes in roadway conditions or J roadway development. Speed zoning in 5 mile per hour increments should be avoided if possible. A 10-mile per hour increment is preferable. ` - Speed zoning should be coordinated between adjacent jurisdictions. Local Street Exemations (CVC 40802) Many streets are designated as "Local" streets per CVC 40802. These streets are exempt from the .radar study. Therefore, the speed limit for these streets does not require an Engineering and Traffic Survey. The code is as follows: "For the purpose of this section, local streets and roads shall be defined by the latest functional usage and federal aid system maps as submitted to the Federal Highway Administration. When these maps have not been submitted, the following definition shall be used: A local street or road primarily provides access to abutting residential j property and shall meet the following three conditions: 1. Roadway width of not more than 40 feet. 2. Not more than one half mile of uninterrupted length. 3. Not more than one traffic lane in each direction. Other Considerattons Every street should be inspected for unusual traffic, roadway and roadside conditions not readily, apparent to a motorist. A check should be made of the adequacy of traffic control devices, roadway alignment, width surface conditions, accident history and any . C 5 unique traffic hazards that may exist. Any of these conditions may warrant the selection of a speed lower than the 85th percentile speed for speed zoning,_ ftdar Collection Time Frames The hours of radar operation were restricted to off-peak periods for heavily traveled streets and to uncongested peak periods on lightly traveled streets. All surveys were conducted in fair weather. The radar unit was mounted at the top of the front dash_ of an unmarked vehicle with the meter reading unit sustained inside the vehicle. The radar units calibration was checked periodically using a tuning fork. ` 1 The radar operator recorded the speed meter readings for each location on • Radar Speed Survey Field Sheets included in the appendix of this report. A representative sampling of at least 100 vehicles were surveyed in each direction or a cumulative sample of 200 vehicles for both directions, where possible. On low volume roads, where a total sample of 200 vehicles would result in an excessive time period, sampling was continued until a representative bell -shaped frequency distribution was attained. Andmis: Factors Several factors were used as input to our recommendations for speed limits. These include the 85th Percentile, the 10 MPH Pace and others. These are described in detail below. 1. The CRMCAL SPEED, or the 85th percentile is defined as that speed at or below i which 85 percent of the traffic is moving. From experience, traffic engineers have found that this is one of the most reliable factors in determining appropriate speed limits. Hence, the accepted practice, and one that has been used in this cas e is to set the speed limit at or near the critical speed. This recognizes that other factors could be present where the above may not be appropriate. When this procedure is used; it not only conforms to that required by the State but it also provides a strong base for law enforcement personnel to properly enforce speed limits. 2. The 10 MPH PACE is that continuous 10 mph incremental range of speeds in which the largest number of recorded vehicles is contained-. It is a measure of the dispersion of s . Pe peels .within the sample surveyed. For this element, the accepted practice to the greatest extent possible is to try and keep the recommended speed limit within the 10 mph pace after considering the critical speed and any factors requiring a speed lower than the critical speed. 3. The MEDIAN (MIDDLE) SPEED, or 50th percentile speed, represents the midpoint value within the range of 'recorded speeds for a particular roadway location. in other words, 59% of the vehicles travel faster and 50% travel slower than the 6 median speeds. This value is another measure of the central tendency of the vehicle speed distribution. 4. The 15th PERCENTILE SPEED is o that speed at or below which 15 /o of the vehicles are traveling. This value is important in determining the minimum .1 allowable speed limit, given that the vehicles traveling_ below this speed tend to obstruct the flow of traffic, thereby increasing the accident potential. I, 5. MODAL SPEED: The modal speed is the speed, which occurs most frequently in the distribution (the most). It serves as another useful measure in verifying the correct recommendation for speed limits: G. STANDARD ND RD DEVIATION: This is a mathematical calculation, . which relates to measures of dispersion of data. It is used to assist in describing the center of speed distribution information around the arithmetic mean or the time mean speed. It also is used in the overall review of recommended speed limits and serves to verify the J level of confidence of data used in making recommendations. 7. The MEAN (AVERAGE) is the sum of the speeds of the samples divided by the ` number of samples. The numerical values of the above factors are derived from the speed distribution ` curves calculated for each survey location. These distribution curves represent a method of a graphical analysis, which compares the cumulative percentage of vehicles to the speed at which the vehicles are traveling. i Field Review In addition to the availability of the above statistical data, a significant aspect of speed limit recommendations is based on the field review. Its importance is that existing conditions may warrant a lower speed than is actually indicated by the application of survey data. Examples of the field data collected for the purposes of analyzing related roadway characteristics as they pertain to the determination of appropriate speed limits are listed below: j 1 Segment, length, width and alignment 2. Level of pedestrian activity and pedestrian activity. 3. Traffic flow characteristics 4. Vertical and/or horizontal curves: 5. Driver sight distance constraints. 6. Adjacent residential/commercial/industrial etc.' zoning. 7. Number of lanes and other channelization/striping factors 8. Frequency of intersections, driveways and on street parking; 9. Location of stop signs, traffic signals, and other regulatory traffic control devices; 10. Roadway conditions, bumps and dips; 11. Obstructions to pedestrian visibility; 12. Land use and proximity of schools; r 13. Uniformity with existing speed zones totwith adjacent jurisdictions; 14. Any other unusual conditions not readily apparent to the driver. The results of the field review of related roadttraffc variables are summarized on the -j Engineering and Traffic Survey sheets found in the Appendix of this report. &ge(derltHls The Engineering, and Traffic Survey forms summarize the available latest three e f g g y _ years o accident information for the subject streets segments. The accident information includes the total number of accidents within each street segment and of those accidents, the number which are speed: -related. This information was obtained from the California Statewide Integrated Traffic Records System (SWITRS) for the City of Vernon: The annual accident rate figures represent the number of speed -related accidents divided by years, of accident records. The evaluation of accidents is useful as a check on ,the accuracy of recommended or existing speed limits and is an indicator of roadway ` conditions not readily apparent to the reasonable driver. Should this review show a high percentage of accidents associated with excessive speeds, and then consideration basedon professional traffic engineering judgment should be directed toward reducing the posted or recommended speed limit. ROMlts and Recommend_ atians The following Summary of Recommendations presents the results of the radar survey for the selected 40 locations. As shown, the chart presents the necessary analysis elements that in addition to the field review of a registered traffic engineer, led to the recommendations indicated. Adjacent land use is mainly industrial with heavy truck traffic. Currently, it has a 40 mph speed sign posted westbound only. With the 85th percentile speed of 43.1 mph and a 10 mph pace range 34 to 43 mph, it is recommended that the existing 40 mph speed limit be maintained. For enforcement, a 40 mph speed sign should be installed eastbound. QQw9ft Road Vernon Avenue to Fruitland Avenue This section of Downey Road has two lanes of travel in each north -south direction. Field observations include heavy truck traffic in area, no shoulders and no stopping anytime along roadway, and bus stops on both sides of street. With an 85th percentile speed of 37.2 mph, it is recommended that the existing 35 mph speed limit remain. For enforcement, a similar speed sign should be posted northbound. 10 Locations of Now Speed Limit Postings ` One location is currently unposted with no visible speed limits signs at either end of the segment. It is noted that for each case, the recommendation to post is necessary to enhance the enforcement of the recommended safe speed limit. Field observations include a 35 mph speed limit, adjacent land uses of industrial and business, heavy truck traffic and no U-tums at signalized intersections.
