ORDINANCE NO. 1157
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON ESTABLISHING A DATE FOR CERTIFICATION OF THE
RESULTS OF THE CANVASS OF THE JUNE 2, 2009 SPECIAL
MUNICIPAL ELECTION; AND DECLARING THAT SAID
ORDINANCE SHALL TAKE EFFECT IMMEDIATELY
WHEREAS, a Special Municipal Election will be held in the
City of Vernon on June 2, 2009; and
WHEREAS, Section 5.3 of the Charter of the City of Vernon
provides (1) that the City Council is authorized to adopt by ordinance
procedures governing municipal elections, (2) that until the City
Council adopts by ordinance provisions governing municipal elections,
all elections shall be held in accordance with the general laws of the
State of California, and (3) that if an ordinance respecting municipal
elections is adopted by the City Council thereby superseding certain
provisions of the general laws governing municipal elections, the
general laws not so superseded as they may exist from time to time
shall be applicable unless and until the City Council shall take action
otherwise; and
WHEREAS, Section 3.4 of the Charter of the City of Vernon
provides that the City Council shall canvass the returns of an election
on the first Tuesday following a City Council election or such other
date within fifteen days of an election as may be provided by
lordinance; and
WHEREAS, Elections Code § 10263 provides that the governing
body of a city conducting an election shall meet at its usual place of
meeting no later than the fourth Friday after the election to declare
the results; and
WHEREAS, it is the desire and intent of the City Council that

it meet on the first Monday following the June 2, 2009 Special
Municipal Election for the purpose of canvassing returns and performing
the other functions and duties specified in Elections Code§§ 10262,
10263 and 10264; and
WHEREAS, Section 4.3 of the Charter of the City of Vernon
provides that an ordinance calling or otherwise relating to any,
elections (1) shall take effect upon adoption, (2) may be introduced
and adopted at one and the same regular or special meeting, and (3) may
specify a date on which all or a portion of its provisions shall be
operative.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained hereinabove
are true and correct.
SECTION 2: With respect to the Special Municipal Election
to be held on June 2, 2009, the City Council of the City of Vernon
shall meet at their usual place of meeting on the first Monday after
the election for,the purpose of canvassing returns and performing the
other functions and duties specified in §§ 10262 and 10263 of the
California Elections Code.
SECTION 3: Any ordinance or parts of ordinances in conflict
with this Ordinance are hereby repealed.
SECTION 4: If any section, subsection, sentence, clause,
phrase or word of this Ordinance is for any reason held to be void or
unconstitutional, such.decision shall not affect the validity of the
remaining portions of this Ordinance; it being the intention of the
City Council of the City of Vernon to pass acid adopt this Ordinance
and.each section, subsection, sentence, clause or phrase thereof

irrespective of the fact that one or more of the sections,
subsections, clauses, sentences or phrases thereof may be declared to
be invalid or unconstitutional.
SECTION 5: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed to
certify to the passage of this Ordinance and shall post the same, or
cause the same to be posted, within fifteen (15) days after its
passage in accordance -with Section 36933 of the Government Code, as
well as Vernon Code Sections 1.9 and 1.10, in three (3) of the most
public places in the City of Vernon, to wit: the northwest corner of
38th Street and Santa Fe Avenue, the northeast corner of Leonis
Boulevard and Pacific Boulevard, and on the bulletin board located
outside on thewallnear the second floor entrance to the City Hall of
said City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
County of Los Angeles, State of California.
SECTION 6: This Ordinance shall take effect immediately
upon adoption.
