Ordinance No. 1179ORDINANCE NO. 1179 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ELIMINATING THE EXISTING TIME LIMITS ON INCURRING DEBT FOR THE FIRST AMENDED INDUSTRIAL REDEVELOPMENT PROJECT WHEREAS, the City Council of the City of Vernon (the "City Council"), adopted Ordinance No. 992 on November 27, 1990, approving and adopting the Redevelopment Plan (the "Original Redevelopment Plan") for the Industrial Redevelopment Project (the "Original Project Area"); and WHEREAS, on December 6, 1994, the City Council adopted Ordinance No. 1026, which established certain debt incurrence, activity and plan duration limits with respect to the Original Redevelopment Plan and the Original Project Area; and WHEREAS, on July 14, 1998, the City Council adopted Ordinance No. 1063, approving and adopting a Redevelopment Plan entitled "City of Vernon Amended Redevelopment Plan for the First Amendment to the Industrial Redevelopment Project" (the "Redevelopment Plan") adding an additional area to the Original Project Area (the "Amended Area" and, together with the Original Project Area, the "Project Area"); and WHEREAS, on May 18, 1999, the City Council adopted Ordinance No. 1072, which established certain debt incurrence, activity and plan duration limits with respect to the Redevelopment Plan and the Project Area; and WHEREAS, the Redevelopment Agency of the City of Vernon (the "Agency"), has been designated as the official redevelopment agency in the City of Vernon to carry out the functions and requirements of the Community Redevelopment Law of the State of California (Health and Safety Code Section 33000 et seq.) and to implement the Redevelopment Plan; and WHEREAS, Section 33333.6 of the Health and Safety Code was amended by SB 211 which took effect on January 1, 2002, which authorizes redevelopment agencies, including the Agency, to eliminate the.time limit on the establishment of loans, advances, and indebtedness contained in redevelopment plans; and WHEREAS, the City has noticed 9:00 a.m. on Monday, December 20, 2010, at the regular meeting place of the City Council at the Council Chamber at 4305 Santa Fe Avenue, Vernon, California, as the time and place for a public hearing in connection with the approval and adoption of ordinances which would amend the Redevelopment Plan; and WHEREAS, the City provided for the giving of notice of said public hearing in connection with the approval and adoption of ordinances which would amend the Redevelopment Plan in accordance with Health and Safety Code Section 33333.6(e)(3); and WHEREAS, the City Clerk has filed with the City Council a certificate setting forth the time and manner of the compliance with the requirements of law for mailing notices of the hearing to the governing body of each affected taxing entity and of publication of notice of the hearing in connection with the approval and adoption of this Ordinance and of the time and place for said public hearing hereon; and the City Council hereby finds that notice of the time and place for said public hearing thereon has been mailed and published in the time, form and manner required by law; and WHEREAS, said public hearing was duly convened by the City Council at said time and place set for said public hearing on December 20, 2010, and the City Council proceeded with said public 2 hearing, and duly heard, and considered the written submissions of, all interested parties desiring to be heard at said public hearing. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Redevelopment Plan is hereby amended to eliminate the time limit on the establishment of loans, advances, and indebtedness with respect to the Original Redevelopment Plan and the Original Project Area contained in the Redevelopment Plan. SECTION 2: Ordinance Nos. 992, 1026, 1063 and 1072 for the Redevelopment Plan are continued in full force and effect as amended by this Ordinance. SECTION 3: The City Clerk is hereby directed to send a certified copy of this Ordinance to the Agency. SECTION 4: If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and this City Council hereby declares that it would have passed the remainder of this Ordinance if such invalid portion thereof had been deleted. SECTION 5: Book of Ordinances. The City Clerk shall attest and certify to the adoption of this Ordinance and shall cause this Ordinance and the City Clerk's certification to be entered in the Book of Ordinances of the Council of this City. The City Clerk shall cause this ordinance to be published or posted as required by law. 3 SECTION 6: Effective Date. The outside time limit for incurring debt under AB 1290 for plans adopted prior to 1994 was the later of 20 years after the plan adoption or January 1, 2004. The debt incurrence time limit for the Industrial Redevelopment Project is November 26, 2010 (per Ordinance No. 1072), and the debt incurrence time limit for the Amendment Area is July 14, 2018. Under the time limit restrictions imposed by AB 1290, such time limits on debt incurrence could only be extended by 10 years and then only if the redevelopment agency could demonstrate significant remaining blight. The State Legislature passed Senate Bill 211 in October 2001, to be effective January 1, 2002. SB 211 modified the uniform statewide time limits for certain redevelopment agencies in order to provide them with additional time and money to meet their development objectives and financial obligations. Essentially, after January 1, 2002, SB 211 allows a community to amend a pre-1994 plan to delete the debt incurrence deadline altogether, with the result that an agency can incur debt under such a plan up to the deadline for the effectiveness of the plan. Such an amendment simply requires the adoption of an ordinance by the legislative body (city council) without any noticing, hearing, or documentation requirements normally applicable to a redevelopment plan amendment, although standard ordinance adoption procedures must be followed. On the facts, such an amendment is permitted for the Industrial Redevelopment Project but not for the Amendment Area. Most plan amendments trigger statutory pass -through payments to all taxing entities with whom the agency does not already have a pass -through agreement. This same principle is carried through in SB 211. If a community adopts an ordinance under SB 211 eliminating the debt incurrence time limit; its redevelopment agency will be required to pay the statutory pass- through payments required by Health & Safety Code Section 33607.7. The Industrial Redevelopment Project already passes through annual tax increment payments to all taxing agencies, so SB 211 does not affect this Plan.
