Ordinance No. 1192ORDINANCE NO. 1192 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON REPEALING SECTION 2.90 OF THE VERNON CITY CODE RELATING TO CITY COUNCIL ELECTIONS AND THE APPOINTMENT OF COUNCIL MEMBERS IN UNCONTESTED ELECTIONS WHEREAS, Section 2.90 of Article XII of Chapter 2 the Vernon City Code provides for the appointment of council members in uncontested elections; and WHEREAS, on November 22, 2011, the City Council of the City of Vernon held a Special Mailed Ballot Election (the "Election"); and WHEREAS, Measure G of the Election was passed by the voters which amended the Vernon City Charter to require a special election to fill vacancies on the City Council and prohibit the appointment of council members by the City Council,; and WHEREAS, the City Council of the City of Vernon desires to repeal Section 2.90 of the Vernon City Code. THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby repeals Section 2.90 of the Vernon City Code. SECTION 3: Renumbering. Article XVI. Sustainable Development and Energy Efficiency Commission of the Vernon City Code is hereby renumbered as Article XIX. SECTION 4: Severability. The City Council declares that, should r any portion of this ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining portions of this ordinance shall remain in full force and effect. SECTION 5: Book of Ordinances. The City Clerk shall attest and certify to the adoption of this Ordinance and shall cause this Ordinance and the City Clerk's certification to be entered in the Book of Ordinances of the Council of this City. The City Clerk shall cause this ordinance to be published or posted as required by law. SECTION 6: Effective Date. This Ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty- first (31st) day after its passage. APPROVED AND ADOPTED this 21st day of February, 2012. At the November 22, 2011 election, the voters passed a charter amendment (Measure G) prohibiting council appointments and requiring all vacancies to be filled through elections. VCC Section 2.90 is in conflict with the new charter provision and should be repealed to prevent confusion.
