AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON, CALIFORNIA, AMENDING SECTION 2.69-1 OF
ARTICLE X OF CHAPTER 2 OF THE VERNON MUNICIPAL
CODE, AND REPEALING OR AMENDING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the City of Vernon (the `City") is a municipal
corporation and a chartered city of the State of California organized
and existing under its Charter and the Constitution of the State of
California; and
WHEREAS, on March 5, 2013, the City Council of the City of
Vernon adopted Ordinance No. 1202, amending Section 2.4 and Section
2.6-6(c) of Chapter 2 of the Vernon Municipal Code, to establish a
personnel merit system and to centralize hiring authority and personnel
matters within the office of the City Administrator; and
WHEREAS, on March 18, 2014, the City Council of the City of
Vernon adopted Resolution No. 2014-07, amending Schedule No. II through
Schedule No. XVIII of Resolution No. 2013-57 (the "Citywide Personnel
and Salary Resolution"), to revise Citywide personnel classifications,
approve newly created classifications, and classify eighteen (18)
incumbent employees into the City's current associated salary ranges
and classifications; and
WHEREAS, the City Council desires to reorganize the City's
administrative structure and departmental organization, in order to
bring the City's structure and organization into conformance with the
revised and newly adopted personnel classifications, and to reflect the
personnel authority within the office of the City Administrator.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that all of the foregoing recitals are true and
correct.
SECTION 2: The City Council of the City of Vernon finds that
this action is exempt under the California Environmental Quality Act
(CEQA), in accordance with Section 15061(b)(3), the general rule that
CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: Section 2.69-1 of Article X of Chapter 2, of the
Vernon Municipal Code is hereby amended in its entirety, to read as
follows:
"2.69-1. Departments.
The City shall have the following departments and the City
Council of the City of Vernon shall appoint the department
head by resolution, after receiving the recommendation of the
City Administrator:
(a) City Administration. There is hereby created and
ratified in the service of the City the City Administration
Department. The City Administrator shall administer the City
Administration Department and shall be responsible to the
City Council for the proper and efficient management of all
the affairs of the City, acting as the agent of the City
Council in the discharge of his/her administrative duties,
subject to the provisions of the City Charter and Chapter 2
of the Code of the City of Vernon and report directly to the
City Council. As fully set forth in Section 2.6-6(c) of
Chapter 2 of the Code of the City of Vernon, the City
Administrator shall administer and implement the personnel
merit system and hiring system. Except as otherwise

provided, the City Administrator shall perform such other
duties as set forth in the Charter of the City of Vernon or
the Code or as prescribed by the City Council.
(b) City Clerk Department. There is hereby created and
ratified in.the service of the City the City Clerk
Department. The City Clerk shall administer the City Clerk
Department of the City, subject to provisions set forth in
the Code of the City of Vernon and report to the City
Administrator. Except as otherwise provided, the City Clerk
shall perform such other duties as set forth in Charter of
the City of Vernon or the Code, or as prescribed by the City
Council.
(c) City Council Department. There is hereby created and
ratified in the service of the City the City Council
Department.
(d) Public Works, Water and Development Services Department.
There is hereby created and ratified in the service of the
City the Public Works, Water and Development Services
Department. The Director of Public Works, Water and
Development Services shall administer the Public Works, Water
and Development Services Department and report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council. The
Director of Public Works, Water and Development Services also
serves as the City Engineer, Building Official, Director of
Community Services, Traffic Engineer and Superintendent of
Streets, and in these capacities shall also report to the
City Administrator.

(e) Finance Department. There is hereby created and
ratified in the service of the City the Finance Department.
The Finance Director/City Treasurer shall administer the
Finance Department and, as to issues concerning the
Department, he/she shall report to the City Administrator,
subject to the provisions of the Code of the City ofVernon'
or as prescribed by the City Council.
(f) Fire Department. There is hereby created and ratified
in the service of the City the Fire Department. The Fire
Chief shall administer the Fire Department and as to issues
concerning the department, he/she shall report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon, of the Code of the City of Vernon, or as
prescribed by the City Council.
(g) Health and Environmental Control Department. There is
hereby created and ratified in the service of the City the
Health and Environmental Control Department, which may also
be cited as the Health Department or the Environmental Health
Department. The Director of Health and Environmental
Control, which may also be cited as the Director of
Environmental Health, shall administer the Health and
Environmental Control Department and as to issues concerning
the Department, he/she shall report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council. The
Director of Health and Environmental Control also serves as
the City Health Officer.

(h) Human Resources Department. There is hereby created and
ratified in the service of the City the Human Resources
Department, which may also be cited as the Department of
Human Resources. The Director of Human Resources, which may
also be cited as the Human Resources Director, shall
administer the Human Resources Department and, as to issues
concerning the Department, he/she shall report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon or the Code of the City of Vernon or as
prescribed by the City Council.
(i) Industrial Development Division. There is hereby
created and ratified in the service of the City the
Industrial Development Division. The Director of Industrial
Development shall administer the Industrial Development
Division and report to the City Administrator, subject to the
provisions of the Charter of the City of Vernon or the Code
of the City of Vernon or as prescribed by the City Council.
(j) Gas and Electric Department. There is hereby created and
ratified in the service of the City, the Gas and Electric
Department-. The Director of Gas and Electric shall
administer the Gas and Electric Department and report to the
City Administrator, subject to the provisions of the Code of
the City of Vernon or as prescribed by the City Council.
(k) Office of the City Attorney/Public Prosecutor. There is
hereby created and ratified in the service of the City, the
Office of the City Attorney/Public Prosecutor, which may also
be cited as the City Attorney's Office. The City Attorney
shall administer the Office of the City Attorney/Public

Prosecutor and, as to issues concerning the department,
he/she shall report directly to the City Council, subject to
the provisions of the Charter of the City of Vernon or the
Code of the City of Vernon or as prescribed by the City
Council.
(1) Office of the Treasurer. There is hereby created and
ratified in the service of the City, the Office of the
Treasurer, which may also be cited as the Treasury
Department. The Finance Director/City Treasurer shall
administer the Office of the Treasurer and report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon or the Code of the City of Vernon or as
prescribed by the City Council.
(m) Police Department. There is hereby created and ratified
in the service of the City, the Police Department.. The Chief
of Police, which may also be cited as the Police Chief, shall
administer the Police Department and report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council."
SECTION 4: Any ordinances or parts of ordinances in conflict
with this Ordinance are hereby repealed or amended.
SECTION 5: In accordance with the changes reflected in
Section 3, staff is directed to make the following related revisions
and/or deletions throughout all applicable provisions of the Code of
the City of Vernon:
1. Department title changes shall be reflected and updated
in accordance with the aforementioned changes.

2. References to department or division titles that were
deleted or consolidated shall be deleted or amended to
reflect departmental consolidation, in accordance with
the aforementioned changes.
3. Department head title changes shall be reflected and
updated in accordance with the aforementioned changes.
4. References to department or division head titles that
were deleted or consolidated shall be deleted or amended
to reflect departmental consolidation, in accordance
with the aforementioned changes.
SECTION 6: Severability. If any chapter, article, section,
subsection, subdivision, paragraph, sentence, clause, phrase, or word
in this Ordinance or any part thereof is for any reason held to be
unconstitutional or invalid or ineffective by any court of competent
jurisdiction, such decision shall not affect the validity or
effectiveness of the remaining portions of this Ordinance or any part
thereof. The City Council hereby declares that it would have adopted
this Ordinance and each chapter, article, section, subsection,
subdivision, paragraph, sentence, clause or phrase thereof,
irrespective of the fact that any one or more chapters, articles,
sections, subsections, subdivisions, paragraphs, sentences, clauses,
phrases or words be declared unconstitutional, or invalid, or
ineffective.
SECTION 7: Book of Ordinances. The City Clerk, or Deputy
City Clerk, shall attest and certify to the adoption of this Ordinance
and shall cause this Ordinance and the City Clerk's, or Deputy City
Clerk's, certification to be entered in the Book of Ordinances of the
Council of this City. The City Clerk, or Deputy City Clerk, shall

cause this ordinance to be published or posted as required by law.
SECTION 8: Effective Date. This Ordinance shall go into
effect and be in full force and effect at 12:01 a.m. on the thirty-
first (31st) day after its passage.

Recommendation
It is recommended that the City Council:

V An earlier version of the attached Ordinance was presented to City Council for a first reading on
March 18, 2014. As fully set forth in the attached Staff Report dated March 18, 2014, this
Ordinance would amend Section 2.69-1 of Article X of Chapter 2 ("Section 2.69-1 ") of the
Vernon Municipal Code based on City Council's adoption of the City-wide classification plan, as
well as the City's current organizational structure.
Although this Ordinance relates specifically to Section 2.69-1, the proposed revisions to
department and department head titles must also be updated throughout the Vernon Municipal
Code. It was City staff s intent to effectuate these "clean-up" deletions and updates through the
initial Ordinance, but specific language to that effect was not included. As such, staff has
revised the attached Ordinance to include one additional section (Section 5) identifying and
authorizing these related "clean-up" changes. In light of this clarifying revision, staff
recommends that City Council hold anotTier first reading of the Ordinance.
Analysis
In order to update and ensure consistency of the revised department and department head titles
within the Vernon Municipal Code, staff recommends that the following related revisions and/or
deletions be made throughout the Code:
1. Department title changes shall be reflected and updated in accordance with the
Section 2.69-1 revisions.
2. References to department or division titles that were deleted or consolidated shall
be deleted or amended to reflect departmental consolidation, in accordance with
the Section 2.69-1 revisions.
3. Department head title changes shall be reflected and updated in accordance with
the Section 2.69-1 revisions.
4. References to department or division head titles that were deleted or consolidated
shall be deleted or amended to reflect departmental consolidation, in accordance
with the Section 2.69-1 revisions.
Fiscal Impact
Administrative costs for implementing the proposed Code revisions can be absorbed within the
City Clerk Department's and City Attorney Office's current budgets.

Recommendation
It is recommended that the City Council:
1) Find that approval of the proposed Amendment No. 3 to the Citywide Personnel and
Salary Resolution No. 2013-57, and the Ordinance to amend the City Municipal Code
reflecting such revisions in this staff report are exempt under the California
Environmental Quality Act (CEQA) in accordance with Section 15061(b)(3), the general

2) Approve and adopt the attached resolution amending Schedule No. II through Schedule
No. XVIII of the Citywide Personnel and Salary Resolution to revise the citywide
personnel classifications pursuant to the recommendations of the Citywide classification
study conducted by Public Sector Personnel Consultants.
3) Approve the immediate reclassification of eighteen (18) incumbents into the City's
current associated salary ranges for the respective classifications, effective pay period
beginning April 20, 2014. The proposed resolution shall not affect or alter the existing
compensation of any employee not specifically set forth herein,
4) Hold first reading of, and subsequently adopt, the attached Ordinance amending Section
2.69-1 of Chapter 2 of the Vernon Municipal Code reflecting the revisions to the City of
Vernon classification plan and current City organizational structure.
Background
In line with the City's good governance reforms, on January 22, 2013, City Council approved
staff s recommendation to issue a Request for Proposals for a Citywide Classification and
Compensation Study. On June 11, 2013, Public Sector Personnel Consultants (PSPC) initiated
the classification study. After PSPC conducted a thorough review and analysis of the proposed
classifications, with input from employees, bargaining unit representatives, and Department
Heads, PSPC's recommendations on the classification portion of the study were completed on
November 20, 2013.
On January 21, 2014, the preliminary results of the Citywide classification study conducted by
PSPC were presented to City Council to receive and file pending final review of impact -related
matters with affected bargaining units.
City staff then conducted an internal review and analysis of the classifications as recommended
by PSPC, and received further input from individual Department Heads, employees, and
bargaining unit representatives. The City has concluded the required meet and consult with all
recognized bargaining units regarding the proposed classifications. In light of labor negotiations
currently in progress with the City of Vernon Firemen's Association, classifications represented
by this unit have been excluded from the current classification plan amendments, pending any
proposed changes in terms and conditions of employment.
Analysis:
As a result of the study, 118 job classifications were updated and all employees included within
the scope of the study were allocated to an appropriate job title, job class, and exempt or non-
exempt designation under the Fair Labor Standards Act (FLSA). The following classifications
are newly designated as FLSA exempt. City staff recommends the newly designated exempt
classifications remain status quo and continue to be eligible for overtime until such time that
proposed salary changes arc implemented and would likely incorporate comparable labor market
salaries for these classifications:

The new classification specifications reflect current duties and minimum requirements of the

It is critical that the study's results be implemented in order to modernize and maintain the City's
Personnel Classification Plan. Attachment B provides all updated job classifications in each of
the city departments. The job classifications reflect the essential functions of each classification
as they currently exist. City staff reviewed and recommends the approval of the classification
plan with eighteen (18) immediate adjustments. City staff, also recommends that the date for
implementing the study's results regarding the classification plan become effective April 20,
2014, the beginning of a pay period. This would allow ample time for testing and
implementation of the classification changes into the Eden Human Resources and Payroll
software system.
Pursuant to the Meyers-Milias-Brown Act, the City is required to negotiate over salaries with all
bargaining units as a mandatory subject of bargaining, the City cannot recommend
implementation of any salary adjustments at this time. The City is either currently engaged or
will soon be engaged in negotiations with all affected bargaining units.

Rather than adopt a new resolution each fiscal year, it is recommended that the resolution
proposed in this staff report take effect April 20, 2014, and remain in effect unless or until a new
resolution is deemed necessary and subsequently adopted. Amendments to the resolution can be
made as needed. The proposed Amendment No. 3 to the Citywide Personnel and Salary
Resolution shall not affect or alter the existing compensation of any other officer or employee
not specifically set forth herein.
Proposed Revisions to the Municinal Code
Based on City Council's public policy position in adopting the citywide classification plan, staff
proposes to amend Section 2.69-1 of Article X of Chapter 2 of the Vernon Municipal Code as
follows, and as specifically set forth in the Ordinance attached hereto:
1) Delete subsection (a) Business Services & Purchasing Department.. Purchasing is now a
division within the Finance Department under the direction of the Finance Director/City
Treasurer,
2) Amend subsection (b) City Administration to include the following language: "As fully
set forth in Section 2.6-6(c) of Chapter 2 of the Code of the City of Vernon, the City
Administrator shall administer and implement the personnel merit system and hiring
system." This corresponds to the new Personnel Merit System that was adopted in 2013,
through Ordinance No. 1202, as part of the City's good governance reform efforts.
3) Amend subsection (c) City Clerk Department to revise the reporting relationship of the
City Clerk from City Attorney to City Administrator in accordance with Ordinance No.
1202, adopted by City Council on March 5, 2013. The ordinance implemented the

the Human Resources Department and under the direction of the Director of Human
Resources.
13) Delete subsection (r) Risk Management Department. Risk Management is now a division
within the Finance Department and Human Resources Department, under the direction of
the Finance Director and Director of Human Resources, respectively.
14) Delete subsection (s) Water Department. In accordance with the findings of the
classification study, the Water Department is part of the newly titled Public Works,
Water and.Development Services Department.
15) Re -letter all remaining subsections in sequential order and make other minor, technical
corrections.
Classification Plan Maintenance
In accordance with Personnel Policy and Procedures, Classification Plan Administration II-1,
revisions recommended by the Human Resources Director (including reclassification actions and
the creation of new or abolition of existing classes) which affect individual positions, classes,
class series, or all classes in the Classification Plan require approval of the City Administrator
and City Council and become effective upon the effective date approved by City Council. The
proposed Amendment No. 3 to the Citywide Personnel and Classification Resolution provides
the Human Resources Director the express authority to make minor revisions to the classification
plan where there are no significant impacts to the essential functions of the job classification,
classes, class series or the classification plan.
Fiscal Impact
The approximatecost for the remainder of this fiscal year to implement immediate classification
changes for the Finance Department is approximately $407.00.
The approximate cost for the remainder of this fiscal year to implement immediate classification
changes for the Fire Department is approximately $2,224.00.
The approximate cost for the remainder of this fiscal year to implement immediate classification
changes for the Human Resources Department is approximately $1,409.00,
The approximate cost for the remainder of this fiscal year to implement immediate classification
changes for the Community Services Department is approximately $9,784,00.
The approximate total cost for fiscal year 2013-2014 to implement all changes proposed in this
staff report is $13,824 and can be absorbed within each department's current budget.
All costs will be included in the respective departmental budgets for the proposed fiscal year
2014-2015 citywide budget.
ORDINANCE NO. 1219
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON, CALIFORNIA, AMENDING SECTION 2.69-1 OF
ARTICLE X OF CHAPTER 2 OF THE VERNON MUNICIPAL
CODE, AND REPEALING OR AMENDING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the City of Vernon (the "City") is a municipal
corporation and a chartered city of the State of California organized
and existing under its Charter and the Constitution of the State of
California; and
WHEREAS, on March 5, 2013, the City Council of the City of
Vernon adopted Ordinance No. 1202, amending Section 2.4 and Section
2.6-6(c) of Chapter 2 of the Vernon Municipal Code, to establish a
personnel merit system and to centralize hiring authority and personnel
matters within the office of the City Administrator; and
WHEREAS, on March 18, 2014, the City Council of the City of
Vernon adopted Resolution No. 2014-07, amending Schedule No. II through
Schedule No. XVIII of Resolution No. 2013-57 (the "Citywide Personnel
and Salary Resolution"), to revise Citywide personnel classifications,
approve newly created classifications, and classify eighteen (18)
incumbent employees into the City's current associated salary ranges
and classifications; and
WHEREAS, the City Council desires to reorganize the City's
administrative structure and departmental organization, in order to
bring the City's structure and organization into conformance with the
revised and newly adopted personnel classifications, and to reflect the
personnel authority within the office of the City Administrator.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that all of the foregoing recitals are true and
correct.
SECTION 2: The City Council of the City of Vernon finds that
this action is exempt under the California Environmental Quality Act
(CEQA), in accordance with Section 15061(b)(3) the general rule that
CEQA only applies to projects that may have an effect on the
environment.
SECTION 3: Section 2.69-1 of Article X of Chapter 2, of the
Vernon Municipal Code is hereby amended in its entirety, to read as
follows:
"2.69-1. Departments.
The City shall have the following departments and the City
Council of the City of Vernon shall appoint the department
head by resolution, after receiving the recommendation of the
City Administrator:
(a) City Administration. There is hereby created and
ratified in the service of the City the City Administration
Department. The City Administrator shall administer the City
Administration Department and shall be responsible to the
City Council for the proper and efficient management of all
the affairs of the City, acting as the agent of the City
Council in the discharge of his/her administrative duties,
subject to the provisions of the City Charter and Chapter 2
of the Code of the City of Vernon and report directly to the
City Council. As fully set forth in Section 2.6-6(c) of
Chapter 2 of the Code of the City of Vernon, the City
Administrator shall administer and implement the personnel
merit system and hiring system. Except as otherwise

provided, the City Administrator shall perform such other
duties as set forth in the Charter of the City of Vernon or
the Code or as prescribed by the City Council.
(b) City Clerk Department. There is hereby created and
ratified in the service of the City the City Clerk
Department. The City Clerk shall administer the City Clerk
Department of the City, subject to provisions set forth in
the Code of the City of Vernon and report to the City
Administrator. Except as otherwise provided, the City Clerk
shall perform such other duties as set forth in Charter of
the City of Vernon or the Code, or as prescribed by the City
Council.
(c) City Council Department. There is hereby created and
ratified in the service of the City the City Council
Department.
(d) Public Works, Water and Development Services Department.
There is hereby created and ratified in the service of the
City the Public Works, Water and Development Services
Department. The Director of Public Works, Water and
Development Services shall administer the Public Works, Water
and Development Services Department and report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council. The
Director of Public Works, Water and Development Services also
serves as the City Engineer, Building Official, Director of
Community Services, Traffic Engineer and Superintendent of
Streets, and in these capacities shall also report to the
City Administrator.

(e) Finance Department. There is hereby created and
ratified in the service of the City the Finance Department.
The Finance Director/City Treasurer shall administer the
Finance Department and, as to issues concerning the
Department, he/she shall report to the City Administrator,
subject to the provisions of the Code of the City of Vernon
or as prescribed by the City Council.
(f) Fire Department. There is hereby created and ratified
in the service of the City the Fire Department. The Fire
Chief shall administer the Fire Department and as to issues
concerning the department, he/she shall report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon, of the Code of the City of Vernon, or as
prescribed by the City Council.
(g) Health and Environmental Control Department. There is
hereby created and ratified in the service of the City the
Health and Environmental Control Department, which may also
be cited as the Health Department or the Environmental Health
Department. The Director of Health and Environmental
Control, which may also be cited as the Director of
Environmental Health, shall administer the Health and
Environmental Control Department and as to issues concerning
the Department, he/she shall report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council. The
Director of Health and Environmental Control also serves as
the City Health Officer.

(h) Human Resources Department. There is hereby created and
ratified in the service of the City the Human Resources
Department, which may also be cited as the Department of
Human Resources. The Director of Human Resources, which may
also be cited as the Human Resources Director, shall
administer the Human Resources Department and, as to issues
concerning the Department, he/she shall report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon or the Code of the City of Vernon or as
prescribed by the City Council.
(i) Industrial Development Division. There is hereby
created and ratified in the service of the City the
Industrial Development Division. The Director of Industrial
Development shall administer the Industrial Development
Division and report to the City Administrator, subject to the
provisions of the Charter of the City of Vernon or the Code
of the City of Vernon or as prescribed by the City Council.
(j) Gas and Electric Department. There is hereby created and
ratified in the service of the City, the Gas and Electric
Department. The Director of Gas and Electric shall
administer the Gas and Electric Department and report to the
City Administrator, subject to the provisions of the Code of
the City of Vernon or as prescribed by the City Council.
(k) Office of the City Attorney/Public Prosecutor. There is
hereby created and ratified in the service of the City, the
Office of the City Attorney/Public Prosecutor, which may also
be cited as the City Attorney's Office. The City Attorney
shall administer the Office of the City Attorney/Public

Prosecutor and, as to issues concerning the department,
he/she shall report directly to the City Council, subject to
the provisions of the Charter of the City of Vernon or the
Code of the City of Vernon or as prescribed by the City
Council.
(1) Office of the Treasurer. There is hereby created and
ratified in the service of the City, the Office of the
Treasurer, which may also be cited as the Treasury
Department. The Finance Director/City Treasurer shall
administer the Office of the Treasurer and report to the City
Administrator, subject to the provisions of the Charter of
the City of Vernon or the Code of the City of Vernon or as
prescribed by the City Council.
(m) Police Department. There is hereby created and ratified
in the service of the City, the Police Department. The Chief
of Police, which may also be cited as the Police Chief, shall
administer the Police Department and report to the City
Administrator, subject to the provisions of the Code of the
City of Vernon or as prescribed by the City Council."
SECTION 4: Any ordinances or parts of ordinances in conflict
with this Ordinance are hereby repealed or amended.
SECTION 5: In accordance with the changes reflected in
Section 3, staff is directed to make the following related revisions
and/or deletions throughout all applicable provisions of the Code of
the City of Vernon:
1. Department title changes shall be reflected and updated
in accordance with the aforementioned changes.

2. References to department or division titles that were
deleted or consolidated shall be deleted or amended to
reflect departmental consolidation, in accordance with
the aforementioned changes.
3. Department head title changes shall be reflected and
updated in accordance with the aforementioned changes.
4. References to department or division head titles that
were deleted or consolidated shall be deleted or amended
to reflect departmental consolidation, in accordance
with the aforementioned changes.
SECTION 6: Severability. If any chapter, article, section,
subsection, subdivision, paragraph, sentence, clause, phrase, or word
in this Ordinance or any part thereof is for any reason held to be
unconstitutional or invalid or ineffective by any court of competent
jurisdiction, such decision shall not affect the validity or
effectiveness of the remaining portions of this Ordinance or any part
thereof. The City Council hereby declares that it would have adopted
this Ordinance and each chapter, article, section, subsection,
subdivision, paragraph, sentence, clause or phrase thereof,
irrespective of the fact that any one or more chapters, articles,
sections, subsections, subdivisions, paragraphs, sentences, clauses,
phrases or words be declared unconstitutional, or invalid, or
ineffective.
SECTION 7: Book of Ordinances. The City Clerk, or Deputy
City Clerk, shall attest and certify to the adoption of this Ordinance
and shall cause this Ordinance and the City Clerk's, or Deputy City
Clerk's, certification to be entered in the Book of Ordinances of the
Council of this City. The City Clerk, or Deputy City Clerk, shall

cause this ordinance to be published or posted as required by law.
SECTION 8: Effective Date. This Ordinance shall go into
effect and be in full force and effect at 12:01 a.m. on the thirty-
first (31st) day after its passage.
