(I , ... - . e (I Q,., this~~ ::day of June, THIS AG~mNT, made and entered into 1925, by and between the City of Vernon and the City of Los Angeles, both being municipal corporations in the State of California: W I 'f N E SSE T H: WHEREAS, the public interest, health and welfare of the City of Vernon requires that the market refuss and COir.oustable rubbish, originating in the City of Vernon, be disposed of by the incineration m..thod; and WHE~S, the City of Los Angeles is desirous of establishing and maintaining an incinerator in the City of Vernon, said incinerator to be located on that certain piece of property known as the "De Turk Estate", as shown on a certain map entitled "Survey of estate of Joshua A. De Turk", November 15th, 1915, filed in book 8, page 1, License Sur- veys of Los Angeles CountYi said property being that portion of the said estate lying south of 26th Street, formerly George Street; and WHEREAS, the City of Vernon is desirous of entering into an agreement wi tll the City 0 f Los Angeles for the disposal 0 r combust able materials in return for the granting by it to the City of LosAngeles, of the privilege of establishing and maintaining said incinerator in the City of Vernon; and the further consideration that the City of Vernon will agree to establish said incinerator as the official place for the incineration of combust able rubbish originating in the City of Vernon, which, because of the nature and number of industries located in 'lemon, is desirable to be used in maintaining sud1 an incinerator; and WHEREAS, this agreement, and the performance thereof, will be to the mutual benefit and advantage 0 f both Cities, am the trustees of the City of Vernon, after careful study, investigation and consideration, have determined that the construction and. operation of such incinerator, including hauling of materials thereto, will not be detrimental to the public health or safety, but will tend to protect the same. (1) i~ ' . e NOW THEREFORE, in consideration of the mutual agreements to be kept and performed by the parties hereto, the parties hereto have mutually covenanted and agreed, a nd by these presents do covenant and agree with each other, as follows: The City of Vernon hereby grante!. to the City of Los Angeles, the right, privilege and pennissicn to construct, operate and maintain f::.t all times, an incinera.tor or:. the premises I"'ilreinabove descr~.bed for the pllrpose of disposing of and incinerating any waste or other material which the afo!'tisaid incinerating plant is capable of reducing or des- ~ troying by incinenltion, E.nd further grants to the City of Los Angele s, the right and priVilege to do all thin[s n",;:":c,,a::-;y fer the f:laintenance and operation of said plant. The City of Vernon further agrees to estahlish such incintora- tor as the official place for the consump-;;ion of combustable n...bbish and market refuse originating within the City of Vernon and the place where its citizens will be required to del'vc}' same in case the puhli c neces6ity and convenience require the adoption of an ordinance requir- ing such consumption in some one place. IT IS UNDERSTOOD AND AGREED, -that, in consids1'E.tiol for the rigtts and privilee;es granted to the City of Los Angeles by the City of Vernon, hereinbefore enumerated, the City of Los .~)1geles will accept from a~y citizen of Vernon, or from the City of Vernon, for the purpose of incineration, such combustable material orieinating in the said City of Vernon as the City of Los Angeles accepts from its own citizens for incineration, and under such rules rmd regulations as the City of Los Angeles snall prescribe for the acceptance of comoustable mated.9,1 from citizens of the City of Los Angeles for incineration; ar.d that the charge for receiving and incinerating said material delivered by citizens of Vernon, or by the City of VernonJ shall be at the same rate as that exacted for like service from citizens of the City of L06 Angeles. (2) IT IS UNDERSTOOD AND AGREED, that the City of Los Angeles will accept from the City of Vernon, or any contractor acting for the City of Vernon, any material of the character then being incinerated or consumed by the City of Los Angeles under such rules and regulations as may be prescri.'oed by the City of Los Angeles, and will i.ncinerate or destroy the same, and that the charge for such service shall be that fixed by the City of Los Angeles. IT IS FURTHER UNDERSTOOD AND AGREED, that the privileges extend- ed by this contract to the citizens of Vernon are ths same, and no more than those extended to the citizens of Los Angeles, and if the City of los .Angeles finds it necessary to make rules or regulations limiting the kind of materials allowed to be so delivered by its citizens for r.educt:.on i.n such incinerator, or making; any other regulations concerning the same, 8\.ch reguluiioJ:'s stall be equally bi.nding upon the cHizens of Vernon. The Uity of Vernon, as a municipal corporation, shall have the same rights, and no more, under this contract, as a citizen of Vernon. IT IS FlJRTH:li:R m~DERSTOOD AND AGREED, t hat. the City of Los Angeles i tsal f, or aXlY contractor acting for it, shall have the right to reduce domestic garbage or any other material capable of I'eduction in said in- cinerator, if it desires, but neither the citizens of Vernon, nor of Los Angeles, as individuals, shall have any right by reason of this con.~ract, to have domestic garbage reduced in such incinerator.
