Pursuant to an order of the City Council of the City of Vernon, California, given on the lat day of May, 1933, directing this notice, notice is hereby given that sealed proposals or bids will be received by the City of Vernon,. California, a.t the office of the City Clerk of said City, at the City Hall, 4305 Santa Fe Avenue, Vernon, Cali- fornia, until the hour of eight o'clock P.M., .on the 15th day of May, 1933, for the furnishing f.o.b. DEFINITION OF TERMS: ~ity: Whenever the word JlCity" is used in these specifica . ons it shall. mean the City of Vernon, in the State of C a1 if or nia. Cit~ Council: Whenever the word "Council" or the words "City ouncilll are used in these specifications they shall be understood to mean the City Council of the aforesaid C,i ty of Vernon. En~ineer: Whenever the word "Engineerll is used in thesespeci ications it shall be understood to mean the City Engineer of the aforesaid City of Vernon. Contractor: Whenever the word "Contractor" is used in these specifications it shall be understood to mean the person, firm, or corporation to whom the City of Ver:qon has awarded the contract for furnishing and delivering Diesel fuel oil and lubricating oil as herein specified. 2. CONTRACTOR'S SPECIFICATIONS: The bidder shall furnish complete data indicated in the proposal schedule and questionnaire of these specifications, in the spaces provided therein, and such additional data necessary to properly and fully describe his product, which data shall be the basis of guarantees for the Diesel .fuel oil and lubtdcating oil which he proposes to furnish. In case the Contractor's Specifications conflict in any particular with the detail specifications of the City of Vernon, the latter shall govern in determining the point at issue. 3. ERRORS AND OMISSIONS: The Contractor shall not be allowed to take advantage of any error or omission in these specifications or in the Contractor's Specifications (as it is understood that these specifications and the specifications of the Contractor shall cover completely the furnishing and delivering of Diesel fuel oil and lubricating oil :to the City of Vernon, California), and full instructions will always be given when such errors or omissions are discovered. 4. INTERPRETATION OF SPECIFICATIONS: ~-4.T Whenever a question as to the meaning of any portion of the specific ations is in dispute, or where. there may be more than one interpretation given to any portion of these specifications, the same shall be referred to the City Engineer, whose int.erpretation of these specifications shall be final. 5. GENERAL REQUIREMENTS: It is the intent to obtain under these specifi,cations, the City. of Vernon Light andl'ower Department's requirements covering Diesel Fuel Oil and!;ubricating Oil for Diesel Engines and auxiliary equipment consisting of electric generatprs, electric motors, pumps and blowers, for a period of one (I) .....1- f<. . , \ ,} year beginning with the date of award of contract. 6. REQUIREMENTS: There shall be furnished and delivered to the City of Vernon Light and Power Department, in such quantities as said Department may order during the contractual period, Diesel Fuel Oil and Lubricating Oil, f.o.b. the power Plant. The Department's total annual re~irements a~e estimated as follows: Item I - Diesel Fuel Oil, f.o.b. City Power House................. 150,000 bbls. Item 11- Diesel Engine Bearing Oil, f.o.b. City Power House..... 8,000 gals. Item 11:1- Dynamo and Motor Oil, f.o.b. City Power House......... 600' gals. Item IV- Diesel Engine Cylinder Oil, f.o.b. City Power House.......... 20,000 gals. The above requirements being estimated only, the Department reserves the right to purchase ei ther more or less than the quantities above' shown. 7. PRICES: All prices quoted by bidder shall be f.o.b. the power plant and shall be the maximum prices not to be exceeded during the life of the contract. Such prices shall be subject to change below such maximum in accordance with market fluctuations occu:rring during life of contract in the prices of products quoted. 8. DEL IVERY AND DELAYS: Delivery at the Power House, at the northeast corner of Seville Avenue and East 50th street, of the Diesel Fuel Oil to be furnished hereunder shall be f .0, b. the unloading rack if delivered by tank car, and f.o.b. the fuel oil storage tanks if delivered by pipe line. Lubricating oil shall be delivered in barrels, f.o.b. Power House. . Deliveries shall be made only in response to sub-purchase orders issued by properly authorized representatives of the Department. The Contractor shall state in his proposal the time required to deliver oil after receipt of order and deliveries on all sub-purchase orders shall be made within the time so specified. Failure to make deliveries or failure to deliver oil that meets these specifications shall give the City the right to purchase its immediate requirements in the open market and charge the Contractor's account with same and the oil so purchased shall be a.s though furnished by the Contractor who will absorb any increase above the contract price caused thereby. 9. MATERIALS .AND WORKMANSHIP: All operations involved in the manufacturing process must be done and completed in a thorough, workmanlike manner by workmen skilled in their various trades, notwithstanding any omission from the Specifications . All oils fUrnished must. be satisfactory to the City's representative, and if not in -2- .." ... accordance with the Specifications, in the opinion of the City's representative, shall be made to conform thereto. 10. INSPECTION OF WORK: - The City's representative shall at all times hl'lve the right to inspect the products in course of manufacture and make such tests from. time to time as he may deem advisable. The Contractor sh~ll furnish the City's representative reasonable facilities for so doing.o.nd for obtaining such information as he desires respect- ing the progress and the mannerbf the manufacture of the products to be furnished. The fact that said products shall have been successfully tested and passed by the Qity's representative shall not relieve the Contractor of responsibility in case of later development of defects. . 11. TESTS: All tests provided for here in or deemed nec.essary by the City's represento.tive to determine compliance with these Speci- fications, shall be made at the Contractor's expense, excepting as to the compensation and expense of any representative of the Department. . Such tests shall be supervised and approved by the City's representative or at his option certified tests made by the Contractor may be accepted in lieu thereof, at which the City's representative shall have the right to be present and check and record data obtained so long as no delay or extra expense is caused the Contractor. All tests shall be made in accordance with the Standard named herein. 12. SHIPMENT: All shipments shall be consigned arid properly directed to the City of Vernon, Department of Light and Power, at the location named or designated on sub-purchase orders. The Contrac.,:, tor shall be held responsible for all delays or switching or demurrage charges due to lack of the proper or complete address. Shipping manifests in triplicate, accompanied by Bill of Lading for each and every tank car shipment or pipe line run of Diesel fuel oil, or delivery of lubricating oil, shall be sent to 4305 Santa Fe Avenue, Vernon, California. 13. OPTION: The City of Vernon, desires to reserve the right and option to renew contract for an additional period of one (1) year from date of expiration, under the same terms, condi tions, etc., contained herein. Bidders shall state in their proposal whether or not such option will be allowed. The City of Vernon reserves the right to make one or more awards hereunder. 14. GUARANTEE: Bidders will be required to state the guaranteed per- centage's of carbon, sulphur, ash, gravity in degrees A..P. I., minimum flash points of water free samples of oils they propose to furnish and also the guaranteed characteristics as determined by the Standard Fractional Distillation Method. In each liner there is a continuous crenulated oil groove that is fed at the top points by six timed feeds in the upper cylinder liner and four timed feeds in the lower cylinder liner with two feeds.to the piston rod packing box, from Manzell mechanical lubricators. Oil must be highly refined, free from any compounds or elements that will cause gumming of rings, ports or liners and must have good spreading and lubricating qualities. The Contractor on lubric~ting oil shall assume.responsi- bility of t he type of oils bid in his proposal and if it is found necessary to increase the quality of the products to give satisfactory lubricating service to the equipment of the Power Plant, in the judgment of the Engineer" he shall do so without additional cost. The Contractor shall co-operate with the Engineer to this end. Bidders shall submit with their bids" 'one (1) quart samples of the different grades of oils they propose to furnish. 19. MEASUREMENT OF OIL: A barrel of 011 shall be considered as being forty-two (42) U.S.gallons at sixty (60) degrees Fahrenheit, and all I deliveries are to be corrected for temperature variation from the standard according to the volume correction table for petroleum oils of the Ameri~an Society for Testing Materials. -6-
