RESOLUTION No. 888.
A RESOLUTION OF THE CITI COUNCIL OF THE CITY OF VERNON APPROVING
THE REQUEST OF SAU1fDERS BROTHERS FOR THE RECISION OF THEIR CONTRACT.
Trill CITY COUNCIL OF THE CI1~ OF VERNON DOES RESOLVE AS FOLLOWS:
TI~T WHEREAS the City did, on the 31st day of March,
1937, enter into a gontract with Saunders Brothers to drill a
water well in accordance with City Specificgtion No. 100, and
WHEREAS the Contractoredid, on the 30th day of August,
1937, inform the City Council that it would be impossible for
them to complete the Contract in accordance with said Specifica-
tion No. 100, and requested the City Council to rescind its
previous Contract, and
WHEREAS the City Council finds that it would be for the
best interest of the City to enter into an Agreement with the
Contractors for the recision of said Contract,
NOW, THEREFORE, BE IT RESOLVED A S FOLLOWS:
Section 1: That the Mayor and City Clerk of the City
of Vernon be, and they are hereby authorized, instructed and
empowered, in the name of the City, to enter into an Agreement
with Saunders Brothers for the cancellation and recision of the
Contract between the City and the said Saunders Brothers, entered
into the 31st day of March, 1937, for the drilling of a water well
under the City's Specification, No. 100.
Section 2: The Contractors, shall, upon the execution
of the Agreement, pay to the City Clerk the sum of One Hundred
Dollars (~I;lOO.OO), money expended by the City for Attorney's fees
in connection with the entering into the Contract with the Con-
tractor, and all work in connection with the mutual cancellation
thereof.
Section 3: The Contractor shall not be relieved from

any costs incurred by him in any manner whatsoever in reference

1 to this Contract, and shall pay for all labor, material and
2 equipment used in any wise pursuant to said Contract.
3 Section 4: The City Clerk shall certify to the passage of
4 this resolution, and thereupon and thereafter the same shall be
5 in full force and effect.
