WORK TO BE DONE The proposed work will cons.ist of furnishing allsuper.vision, labor, tools, equipment and materials necessary for completing in a. satisfa.ctory manner the various items shown in "Detailed. Specifir.,ations", included herewith. 3. COMMENCEMENT AND COMPLETION OF WORK The Contractor sha.ll commence actual work at the site within ten (10) days after signing of the contract, if so directed by the Engineer, he shall state in his proposal the nunmer of days after award of contract in which he will guarantee completion of work. The work shall not be started, however, until after netice will have been roceived by the Contractor from the Engineer that the City is ready for same, and the work shall be completed with~ in the number of days so specified, beginning with the date of said notice.. 4. INTERPRETATION OF. SPECIFICATIONS Whenever a. question as to the meaning of any portion of the specifications is in dispute, or where there may be more than one interpretation given to any portion thereof, the same shall be referred to the Engineer, whose decision in the matter shall be final. 5. CONTRACTOR'S RESPONSIBILITY 1 j It is understood and agreed that the Contractor assumes full responsibility fo!' the safety of his employees, plant, and materials, and for any damage or inju!'y done by or to them from any.seurce or cause. EXAMINATIoN OF WORK Bidders must examine the site of, and judge :for themselves the conditions surrounding. the proposed work, the nature of the excavation to be made. the work to be done, and the sufficiency of the plans. The plans for the work show conditions as they are believed by the Engineer to exist, but it is not intended or to be inferred that the conditions as shown'thereon constitute a representation by the City, or its Officers, that such conditions are actually existent, nor shall the Contractor be relieved of any liability u~der his contract, or the City, or any of its Officers be liable for any loss sustained by the Contractor, as a result of any variance betweon any conditions, as shown on the plans and the actual conditions revealed during the progress of the work or otherwise. 8. CONTRACTOR TO BE PRESENT OR REPRESENTED . ..." 'I . -.;..& The Contractor shall at all times be either personally present upon the work or be represented thereon by a responsible agent, to be designated in writing by the Contractor, who Shall be clothed with full authority to act for him in all cases and to carry out any instructions relative to the work which may be given by the Engineer, either personally or through an authorized representative. 9. MATERIALS AND WORKMANSHIP - All articles and materials, unless otherwise specified, shall be new, of standard make, specified quality, and fully equal to approved samples when samples arc requ.ired. All work must be done and completed in a workmanlike and thorough manner by mechanics skilled in their various trades. All materials furnished and all work done must be satisfactory to tho Engineer, and will be sub~ ject to rigid inspection, and if not in accordance with specifi- cations, in the opinion of the Engineer, shall be made to conform thereto. Unsatisfactory material will be rejected, and, if so ordered by the Engineer, shall be immediately removed from the premises at the expenso of the Contractor. 10. SAMPLES OR SPECIMENS The Contractor shall submit samples" specimens, or test data, of any or all materials to be furnished by him in the work, if required to do so by the Engineer. 11. PROTECTION OF WORK The Contractor shall be responsible for the protection of all work until final completion and acceptance and will be required to make good at his expense and in a manner satisfactory to the Engineer, any and all damage the work may sustain from any cause. l],'he Contractor agrees to accept all risks from fire, earthquake and unforseen obstructions and casualties of every description and make no charge for delay from such causes. He may, howev-er. be allowed a reasonable extension of time on account of such delay as provided herein. - 2 - ~ , - # 12. METHODS..iWD APP1lANCES ..--~ " ... The methods, appliances, equipment and 'workin' force, employed by the Contractor must be such as will secure a first class quality o~ work and. enable him to complete the work in the time agreed upon. If at ::m.y time such methods, equipment, appli~ ances or force appoar to the Engineer to be inadequate, he maF order the Contractor to improve, change or increase the same, and the Contractor must promptly conform to such order; but the failure of the Engineer to order any such improvement, change or increase will not rolieve the Contractor from his obligation to perform the work in accordance with the specifications, and to finish it in the time agroed upon. 13. INSPECTION AND SUPERVISION The Contractor shall prosecute work only in the pre.sence of the Engineer, and any work done in tho absence of said Engineer shall be subject to rejection for that rO'!\.$"Gn. The Contractor shall notify the Engineer at least forty-eight (48) hours before beginning any work and shall furnish said Engineer all reasonable facilities for obtaining full information respecting the progress and manner of work~ Tho work will be done under the general direction of the Engineer and will be inspected by inspectors appointed by him, who will enforce a strict compliance with the terms of the contract. The inspectors will keep a record of the work done, but the presence of the inspector shall not relieve the Contractor or his respon- sible agent of any responsibility for the proper execution ot - the work. All material needed for tho proper execution and in- spection of the work shall be furnished and maintained in good order by the Contractor. 14. ERRORS AND OMISSIONS The Contractor will not be allowed to take advantage~of any error or omission in 'these specifications or in the Oontractor's Specifications, it being fully underatood that either, or both, areintended to provide~ completely for the necessary materials) together with labor, tools and equipment for their application. Full instructions will always be given by the Engineer when such error or omission is discovered. 15. PATENT RIGHTS The Contractor agrees to save, keep, bear harmless and fully indemnify the City and any of its Officers or agents from all damages, costs or expense il1ll law or equity that may at any time arise or be set up for any infringemont of any letters patent; or patent rights, of any person or persons in consequence of the installation or use of any patented article, material, · oquipmont or m,othod of porformirig ":ork undor .this contract. 16. GUARANTEES Where guarantees are required by those specifications, the Contractor shall furnish such in the form proscribed by the City. 17. WATER AND PO~ER The Contractor shall furnish at his own expense, all water, light and power required for the proper execution of the contract. 18. SANITARY CONDITIONS 'l'he Contractor shall erect and maintain such latrines as may be nocessary for the men employed on the work and he shall ent'orc( the use thereof by his men. - 3 .;. , 19. ONE CONTRACT ONLY ., - The City will enter into contract only with the general Con.. .. tractor, and his contrt'.ct shall be for the entire completio~ of tho work describod by those specificationse 20. SUBCONTRACTORS Should any bidder contemplate sub-letting any part of his work covered by these specifications, all conditions und requirements of same shall apply to work a.nd ma.teria1s furnished by the sub- cont.rac<tor with the same force as work donG or to be done, and material furnished by the Contractor. Transfer of contract, or of interest in contract is prohibited, unless formally approved by City Council. 21. SUNDAYS, HOLIDAYS AND NIGHTS No work shull be done on Sundays, legal holidays, or at night, except. as authorized by the Engineer. 22. I{UANT1TIES The qua.ntiti~s of work noted in the contract.. oX' in any instru- ment or drawings forming a. part thereof, are merely approximationfl; and the City Councilor the Enginoer does not expressly or by , implication agree that tho actual amount of work will correspond therewith. 23. CLEANING UP I On or ' before the completion of the work, the Contractor shall remove from the vicinity of the work all rubbi-s:1 of evory des- cription and unused materials belonging to him. 24. PRESERVATION OF .lVLONUMENTS ~, -,- -0. '~l'r The Contractor shall not willfully disturb monuments or stakes found on the lino of improvements without permission from tho Enginoer and shall boar the expense of resotting rmy monuments or stakes which may be disturbed without such permission. The Contractor shall :reset all streot name signs disturbed by him during the progress of the work. 25. OBSERVING CITY ORDINANCES The Cont:ractor shall observe tho laws of the state of California in regard to public imp~ovements and contracts and all theord- inances of'the City of Vernon, in rel3.tion to tho obstruction of streets, keeping open pa.ssagevmys and protecting the same where they are exposed or da.ngerous to travel. Not morc than one successive cross street shall be closed a.t anyone time. 26. A.!{NULlvIENT. OF CONTRACT If at any time the Engineer should be Of the opinion tl:'llat the work is being unnecessarily or unresonably dela~red; he will report same to the City Council, and if directed by them, the Engineer shall make a demand on the Contractor for such addition... al specific force or material as in his judgement may be necess... ary for the faithful fulfillment of the contract; and if' at any time. the Contractor .should fail to comply with such demand with- in two (2) days, or if at any time the Contractor is violating any of the terms of the contract, or if the work under the contract be abandoned, it shall be lawful for the City Council to suspend the operations of the contract after a hearing upon two ( 2) days notice to the Contractor. Upon receiving suc,h notice of suspension of contraQt, the Contractor shall discon- tinue the work or such parts of the work as the City Council _y designate in said notice. Upon such suspension, the City Council may employ other parties to carry the contract to completion in the m.anner and form required by law. Any excoss of cost,aristng - 4 ... , 11 .... therefrom, over and above the contract prioe, .will be charge"8. against the Contractor and his sureties, who will be liable therefor. In the event of such suspension, all moneys due the Contractor or retained under the terms of the contract shall be forfeited to the City, but such forfeiture will not release the Contractor or his sureties from liability for failure to fulfill the contract. If, in its discretion, the said City Council finds that said work has been comp1oted according to the contract it shall thereupon, by resolution, so find and declare the work to be o.ccoptod.~ 28. PAYlIAENTS Payments or acceptance by the City shall not releive tho Con- tractor of any of his guarantees or responsibilities under his contract or in }:lis comnliance with those or the Contractors specifications.' ~ Payments shall bomade out of funds provided for such purpose and shall be made upon demands ordered and paid in such manne~ as other payments made by tho City out of said funds.
