Ordinance of Intention No. 524, entitled "An 6 - Ordinance of Intention of the City of Vernon Relating to Sewers, and to a Con.tract Relating Thereto Between the Cities of Vernon and Los Angeles, Providing for the Acquisition and Construction of Sewers and the Acquisition of Rights in the Outfall Sewers and Disposal Works of the City of Los Angeles, for the Creation of a District to be Taxed and Assessed to Pay tne Cost Thereof, and to be Taxed and Assessed to Pay the Annual Cost of the Main- 7 8 9 10 11 12 13 tenanceand Operation Thereof, Determining the Estimated Costs, and. Providing for Protests Against the Formation and Extent of Such District, the Inclusion of Lands Tb.erein,or the Acquisition of said Rights, or the Cost thereof, and Against said Annual Charge,. a.nd Fixing the Date for Hearing said Protests, and De- claring the Intention of sa.id Council to.Oroer an Election in Said District", declaring its intention to form a district to be located wholly within the City of Vernon and to b.e known, numbered, and designated as 'City of Vernon Sewer District No. One' 14 15 16 17 18 19 20 21 22 23 24 to be for.medand created under the provisions of an .ct of the Legislature known as 'Municipal Sewer District Act of 1939~,and declaring its intention to,oroerthe constzouction, acquisition, and completion of certain ~provements, all as in said Ordinance of Intention more particularly described, and did declare its intention to assess the cost of said ~provement, and all upkeep, maintenance, and expense thereof, against said proposed district, and against the property loca.ted therein, and did declare its intention to call an election for tne purpose of vottng bonds in the principal sum of Three Hundred and Fifty Thousand Dollars, ($350,000.00) for the purpose all. as more particularly mentioll..ed 25 32 .. .. IIIZ t::J 31 ;::J: e . .. ,; 1 therein; and 2 WHEREAS, said Ordinance of Intention provided that 3 protests and objections by all or any persons interested in the 4 formation of said district, or its extent, or to the proposed 5 improvement, or to the acquisition of said rights proposed to be 6 acquired, or the cost thereof, or to the inclusion of property 7 in said district, or against the annualcbArge or the amount there- 8 of to be paid by said district toward the maintenance and opera- 9 tion of the improvement, and toward the maintenance and operation 10 of the portion of the Los Angeles Sewers to be used for the 11 flowage of sewage of said district, or to anyone or more of said 12 matters, should be filed with the City Clerk of the City of Vernon 13 at or before the hour of 3:00 o'clock P.M., March 8, 1939, and 24 25 WHEREAS, this is the time and place fixed for hearing protests pursuant to Ordinance of Intention No. 524, relating to all matters mentioned in said Ordinance of Intention and to the sewer district therein proposed to be created, NOW, THEREFORE, BE IT RESOLVED, that this Council forthwith hear all protests as provided in said Ordinance of Intention, and. by law, and the Clerk be, and he is hereby, directed to open and read all protests filed with him. FURLONG, City Clerk of' the City of Vernon, 14 do hereby certify that the foregoing Resolution NO, 972, was 15 duly adopted by the City Council of the City of' Vernon, and ap- 16 proved by the Mayor of said City at an adjourned regular meeting 17 thereof' held on the 8th day of March, 1939. ~<-- ~ 18 19 32 ..........'....,. ..',...:...... .. ......- ~ - -" RESOLUTION 9'72 Councilman Peralta No. 972 resolution,/and moved its adoption: "WHEREAS, the Council did on the 14th day of February, 1939 adopt its Ordinance of Intention No. 524, entitled "AN ORDINANCE OF INTENTION OF THE CITY OF VERNON RELATING TO SEWERS, AND TO A CONTRACT RELATING THERETO BETWEEN THE CITIES~OF VERNON AND LOS ANGELES PROVIDING FOR THE ACQUISITION AND CON- STRUCTION OF SEWERS AND THE ACQUISITION OF RIGHTS IN THE OUTFALL SEWERS AND DISPOSAL WORKS OF THE CITY OF LOS ANGELES, FOR THE CREATION OF A DISTRICT TO BE TAXED AND ASSESSFj) TO PAY THE COST THEREOF, AND TO BE TAXED AND ASSESSED TO PAY THE ANNUAL COST OF THE MAINTENANCE AND OPERATION THEREOF, DETERMINING THE ESTIMATED COSTS, AND PROVIDING FOR PROTESTS AGAINST THE FORMATION AND EXTENT OF &JCH DISTRICT, THE INCLUSION OF LANDS THEREIN, OR THE ACQUISITION OF SAID RIGHTS, OR THE COST THEREOF, AND AGAINST SAID ANNUAL CHARGE, AND FIXING THE DATE FOR HEARING SAID PROTESTS, AND DECLARING THE INTENTION OF SAID COUNCIL TO ORDER AN ELECTION IN SAID DISTRICT" declaring its intention to form a district to be located wholly within the City of Vernon and to be known, numbered, and designated as 'City of Vernon Sewer District No. One' to be formed and created under the provisions of an Act of the Legislature known as 'Municipal Sewer District Act of 1939', and declaring its intention to order the construction, acquisition, and completion of certain improvements, all as in said Ordinance of Intention more particularly des- cribed, and did declare its intention to assess the cost of said improvement, and all upkeep, maintenance, and expense thereof, against said proposed district, and against the property located therein, and did declare its intention to call an election for the purpose of voting bonds in the principal sum of Three Hundred and Fifty Thousand Dollars ($350,000.00) for the purpose all as more particularly mentioned therein; and offered the following "WHEREAS, said Ordinance of Intention provided that protests and objections by all or any persons interested in the formation of said district, or its extent, or to the proposed improvement, or to the acquisition of said rights proposed to be acquired, or the cost thereof, or to the inclusion of property in said district, or against the annual charge or the amount thereof to be paid by said district toward the maintenance and operation of the improvement, and toward the maintenance and operation of the portion of the Los Angeles Sewers to be used for the flowage of sewage of said district, or to anyone or more of said matters, should be filed with the City Clerk of the City of Vernon at or before the hour of 3:00 o'clock P.M., March 8, 1939, and that said City Council would at said time hear any and all of said protests and objections, and rule thereon, and said 8th day of March, 1939 at the hour of 3:00 o'clock P.M. was therein and thereby fixed as the time for said hearing in the Council Chamber of said City of Vernon; and ~ " ... . . WHEREAS, said Ordinance of Intention has been duly and regularly posted under the direction of the City Clerk in three (3) public places in said City, for the time and in the manner all as provided by said Ordinance of Intention, and by said 'MuniCipal Sewer District Act of 1939'; and WHEREAS, this is the time and place fixed for hearing protests pursuant to Ordinance of Intention No. 524, re- lating to all matters mentioned in said Ordinance of Intention and to the sewer district therein proposed to be created, NOW, THEREFORE, BE IT RESOLVED, that this Council forthwith hear all protests as provided in said Ordinance of Intention, and by law, and the Clerk be and he is hereby directed to open and read all protests filed with him. " Said motion was duly seconded by Councilman Scheider and adopted by the following vote: , Ayes - Messrs. Leonis, Scheider, Peralta, Levy Noes - None The Clerk thereupon reported that no protests had been filed with him. Thereupon, the Mayor asked if any persons were present who desired to be heard upon the matter bef'ore the Council, or who desired to orally protest against, or object to the formation of said district, or to its extent, or to the proposed improvement, or to the acquisition of said rights proposed to be acquired, or to the cost thereof, or to the inclusion of property in said district, or against the annual charge, or the amount thereof to be paid by said district toward the maintenance and operation of the improvement, and toward the maintenance and operation of the portion of the Los Angeles Sewers to be used for the flowage, of sewage of said district, or to anyone or more of said matters, and no person present responded to said invitation. Thereupon, Councilman Peralta. offered the following resolution, and moved its adoption: "WHEREAS, no protests, either orally, or in writing, have been made, or filed, by any persons interested to the formation of the district or to the proposed improve- -2- . . .,-~. ~ .... ... .... . . I!_- ment, or to or against any of the proposals contained in Ordinance of Intention No. 524; and "WHEREAS, the Council has af'forded all persons interested an opportunity to be heard upon the same, and no person has availed himself of that opportunity, "NOW, THEREFORE, BE IT HEREBY RESOLVED, that City Attorney Cassidy, be, and he is hereby authorized and instructed to prepare an ordinance of the City of Vernon, establishing a sewer district in said city and fixing its boundaries, pursuant to the provisions of' the 'Municipal Sewer District Act of 1939' and the provisions of Ordinance of Intention No. 524, of' said City; deter- mining that no protests were filed pursuant to said Ordinance of' Intention and that no persons protested the formation of said district or its extent, or the cost of the proposed improvement, or any other matter specified in said Ordinance of Intention; calling an election in said district and fixing the date for said election and providing for the submission to the qualified voters of said district of the proposition of authorizing the is- suance and sale of' bonds of said district for the purposes set forth in said Ordinance of Intention, and the question of authorizing the imposition of an annual charge upon said district for the maintenance and operation of the improvement described in said Ordinance of Intention." The City Clerk shall certify to the passage of this Resolution, and thereupon and thereafter the .ame shall be in full force and effect.
