RESOLUTION NO. 993 A RESOLUTION OF THE CITY OF VERNON, CALIFORNIA, PROVIDING FOR TEE ISSUANCE AND S.Al".B OF BONDS OF CITY OF VERNON SEWm DISTRICT NO. ONE IN TEE SUM OF TEREE HUNDRED AND FIFTY THOUSAND DOLLARS ($350,000.00) FOR THE PURPOSE OF THE CONSTRUCTION AND ACQUISITION OF SEWERS IN SAID DISTRICT AND THE CONSTRUCTION OF OUTLETS FOR SEWERS ALREADY CONSTRUCTED IN SAID DISTRICT, FOR COLLECTING AND DISPOSING OF THE SEWAGE OF SAID DISTRICT, INCLUDING THE ACQUISITION AND CONSTRUCTION OF ALL NECESSARY MACHINERY, APPARATUS AND OTHER PROPERTY TO ENABLE SAID SEWAGE TO BE GATHERED AND COLLECTED, INCLUDING THE ACQUISITION OF RIGHTS IN SEWERS AND OUTFALL SEWERS OF THE CITY OF LOS ANGELES TO ENABLE THE SEWAGE OF SAID DISTRICT TO BE DISPOSED OF BY FLOWING THE SAME THROUGH SAID SEWERS AND OUTFALL SEWERS OF THE CITY OF LOS ANGEI&ES, AND ITS WORKS AND PLANTS, TO AND INTO THE PACIFIC OCEAN, AS PARTICULARLY DESCRIBED IN PROPOSITION NO. 1 OF ORDINANCE NO. 526 OF SAID CITY CALLING A SPECIAL ELEC- TION IN SAID DISTRICT FOR THE PURPOSE OF SUBMITTING TEE QUESTION OF THE ISSUANCE OF SAID BONDS TO THE VOTERS OF SAID DISTRICT; FIXING AND DETERMINING THE MATURITIES OF SAID BONDS AND THE FORM THEREOF; AND PROVIDING FOR THE LEVYING AND COLLECTION OF TAXES FOR THE PAYMENT THEREOF; AND CREATING A FUND TO BE KNOWN AS THE "CITY OF VERIfON SEWER DISTRICT NO. ONE ELECTION 1939 BONDS, INTEREST AND ,SINKING FUND" INTO WHICH SHALL BE PLACED ALL SUCH TAXES AS ARE LEVIED AND COLLECTED EACH YEAR UPON THE TAXABLE PROPERTY IN SUCH DISTRICT LEVIED FOR THE PURPOSE OF MEETING ALL SUMS COMING DUE FOR PRINCIPAL AND INTEREST ON ALL OF SAID BONDS. WHEREAS, the City Council of the City of Vernon, California, did on March 21, 1939 duly and regularly pass and adopt an Ordinance numbered 526 establishing City of Vernon Sewer District No. One in said City, and fixing the boundaries thereof, and calling an election in said district for April 11, 1939, and providing for the submission ataaid election to the qualified voters of said district of the proposition of authorizing the issuance and sale of bonds of said district for the purpose of the construction and ac- quisition of sewers in said district and the construction of outlets for sewers already constructed in said district, for collecting and disposing of the aewage of said district, including the acquisition and construction of all necessary machinery, apparatus and other property to enable said sewage to be gathered and collected, includ- ing the acquisition of rights in sewers and outfall sewers of the e e # City of Los Angeles to enable the sewage of said district to be disposed of by flowing the same through said sewers and outfall sewers of the City of Los Angeles, and its works and plants, to and into the Pacific Ocean, all as more particularly set forth in Ordinance of Intention No. 524 of said City, and in said Ordinance numbered 526 of said City; and WHEREAS, said election was duly and regularly held within the district described in Ordinance of Intention No. 524 and in the Ordinance calling said election numbered 526, and said election was held as provided in said Ordinances, and by law; and WHEREAS, the proposition of incurring the bonded indebtedness hereinbefore mentioned and hereinafter particularly described received thereat more than two-thirds of all of the votes of the qualified voters of said district voting at said elec- tion; and WHEREAS, all and singular of the provisions of the "Municipal Sewer District Act of 1939" of the State of California, - and all Ordinances of the City of Vernon, and all general laws of the State of California relating to the formation of a district under said "Municipal Sewer District Act of 1939" and relating to elec- tions in said City, have been fully complied with so as to authorize the issuance of said bonds; and WHEREAS, the public interest and necessity demand and require that all of said bonds be issued and sold at the earliest practicable date; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Vernon as follows: Section 1: That bonds of said City of Vernon Sewer District No. One, in the principal sum of Three Hundred Fifty Thousand Dollars ($350,000.00), be issued in accordance with the -2- e e provisions of an Act of the Legislature of the state of California, known as "Municipal Sewer District Act of 1939",and in accordance with the laws of the State of California and the Ordinances of the City of Vernon for the purpose of the construction and acqui- sition of sewers in said district and the construction of outlets for sewers already constructed in said district, for collecting and disposing of the sewage of said district, including the acqui- sition and construction of all necessary machinery, apparatus and other property to enable said sewage to be gathered and collected, including the acquisition of rights in sewers and outfall sewers of the City of Los Angeles to enable the sewage of said district to be disposed of by flowing the same through said sewers and out- fall sewers of the City of Los Angeles, and its works and plants, to and into the Pacific Ocean; That said bonds shall be 350 in number and shall be numbered from 1 to 350, both inclusive; that said 350 bonds shall be issued in the denomination of One Thousand Dollars each; that the principal and interest of said bonds shall be payable in lawful money of the United States; that said bonds shall be designated "CITY OF VERNON SEWER DISTRICT NO. ONE BONDS, ELECTION 1939"; that said bonds shall be dated June 15, 1939, and bear interest at the rate of not more than six per cent per annum, payable semi-annually on the fifteenth day of December and June of each and every year until said bonds are paid; that the principal and interest thereof shall be payable at the office of the City Treasurer of the City of Vernon, California, and said bonds shall be payable in the following manner, to wit: Bonds Nos. 1 to 12, both inclusive, on June 15, 1940; Bonds Nos. 13 to 24, both inclusive, on June 15, 1941 ; Bonds Nos. 25 to 36, both inclusive, on June 15, 1942; Bonds Nos. 37 to 48, both inclusive, on June 15, 1943; -3- e e Bonds Nos. 49 to 60, both inclusive, on June 15, 1944; Bonds Nos. 61 to 72, both inclusive, on June 15, 1945; Bonds Nos. 73 to 84, both inclusive, on June 15, 1946; Bonds Nos. 85 to 96, both inclusive, on June 15, 1947; Bonds Nos. 97 to 108, both inclusive, on June 15, 1948; Bonds Nos. 109 to 120, both inclusive, on June 15, 1949; Bonds Nos. 121 to 132, both inclusive, on June 15, 1950; Bonds Nos. 133 to 144, both inclusive, on June 15, 1951; Bonds Nos. 145 to 156, both inclusive, on June 15, 1952; Bonds Nos. 157 to 168, both inclusive, on June 15, 1953; Bonds Nos. 169 to 180, both inclusive, on June 15, 1954; Bonds Nos. 181 to 192, both inclusive, on June 15, 1955; Bonds Nos. 193 to 204, both inclusive, on June 15, 1956; Bonds Nos. 205 to 216, both inclusive, on June 15, 1957; Bonds Nos. 217 to 228, both inclusive, on June 15, 1958; Bonds Nos. 229 to 240, both inclusive, on June 15, 1959; Bonds Nos. 241 to 251, both inclusive, on June 15, 1960; Bonds Nos. 252 to 262, both inclusive, on June 15, 1961; Bonds Nos. 263 to 273, both inclusive, on June 15, 1962; Bonds Nos. 274 to 284, both inclusive, on June 15, 1963; Bonds Nos. 285 to 295, both inclusive, on June 15, 1964; Bonds Nos. 296 to 306, both inclusive, on June 15, 1965; Bonds Nos. 307 to 317, both inclusive, on June 15, 1966; Bonds Nos. 318 to 328, both inclusive, on June 15, 1967; Bonds Nos. 329 to 339, both inclusive, on June 15, 1968; Bonds Nos. 340 to 350, both inclusive, on June 15, 1969; , and said bonds shall be substantially in the following form, to wit: "UNITED STATES OF AMERICA STATE OF CALIFORNIA COUNTY OF LOS ANGELES CITY OF VERNON SEWER DISTRICT NO. ONE BONDS, ELECTION 1939 VERNON, CALIFORNIA June 15, 1939. On the fifteenth day of June ...........(year of ma- -4- e e turity) the City of Vernon, California, will pay to the bearer at the office of the City Treasurer of said City of Vernon, in the City of Vernon, state of California, the sum of One Thousand Dollars ($1000.00) with interest thereon at the rate of ........ (.....) per cent per annum, payable semi-annually on the fifteenth day of December and the fifteenth day of June of each year at the office of the City Treasurer of said City, upon the presentation and surrender of the interest coupons hereto attached, from the special fund in said City treasury provided by the levying and collection of taxes upon the taxable property in said district to pay the interest and principal of this bond. This bond is issued in pursuance of the provisions of an act of the Legislature of the State of california, known as "Municipal Sewer District Act of 1939", which became a law February 2, 1939. It is hereby certified that all requirements of the Constitution and laws of the state of California and of all Ordinances of the City of Vernon have been fully complied with by the proper officers in the issuing of this bond; that this issue of bonds has been authorized by the vote of two-thirds (2/3rds) of the duly qualified voters of said district voting on the ques- tion of said issue at an election duly and regularly called and held in said district on April 11, 1939, and that the total amount of this issue is within the limits prescribed by the Constitution and laws of the state of California, including said "Municipal Sewer District Act of 1939"; that before or at the time of incurr- ing the indebtedness evidenced hereby, provision! has been made for the collection of an annual tax upon the property in said district sufficient to pay the interest on such indebtedness as it falls due, and also for the payment of the principal thereof on or before maturity. -5- e e Neither the City nor its officers shall be holden for the payment of the principal or interest of this bond, but the same shall be payable exclusively from taxes levied on the taxable property in said district. IN WITNESS WHEREOF, the City of Vernon has caused this bond to be signed by its Mayor and City Treasurer, and to be countersigned by its City Clerk, and the corporate seal of said city to be hereto affixed, and said City has also caused the coupons hereto attached to be numbered consecutively and signed by the Treasurer of said City of Vernon. " That interest coupons shall be attached to each of said bonds representing each installment of interest to accrue on each bond up to. the maturity date thereof, which interest coupons shall be numbered consecutively and shall be substantially in the follow- ing form, to wit: "NO. (Number of Coupon) On the fifteenth (15th) day of (month of maturity) A.D. (year of maturity) the City of Vernon, California, promises to pay to the bearer at the office of the City Treasurer of the City of Vernon, California, in said City, the sum of ($ ) in lawful money of the United States of America, the semi-annual interest due on City of Vernon Sewer District No. One, Election 1939, -6- e e Bond No. (number of bond to which the coupon is attached). This coupon is payable exclusively from taxes levied upon the taxable property in said district. Treasurer of the City of Vernon, Calif. " Section 2: That the Mayor of the City of Vernon, California, and the Treasurer of said City, are directed to sign all of said bonds, and the City Clerk of said City is hereby authorized and directed to countersign said bonds and to affix the corporate seal of said City thereto, and the Treasurer of said City is hereby authorized and directed to sign the interest coupons of said bonds with his lithographed or engraved signature; that said bonds shall be delivered by said City Clerk to said City Treasurer. Section 3: That for the purpose of securing and pro- viding for the payment of the principal and interest of said bonds, there is hereby created a fund to be known as the "CITY OF VERNON SEWER DISTRICT NO. ONE ELECTION 1939 BONDS, INTEREST AND SINKING FUND"; that all of the money which from time to time shall be placed in said fund shall be, and the same is hereby set apart to be applied exclusively to the purposes and objects of meeting all sums coming due for principal and interest on all of the aforesaid 350 bonds which may be issued under the proceedings hereinabove re- cited; that for the purpose of paying the principal and interest of said bonds, the City Council of said City shall, at the ttme of fixing the general tax levy and in the manner for such general tax levy provided, levy and collect annually each year until such bonds are paid, a tax upon all of the taxable property located within City of Vernon Sewer District No. One, as the same is described in -7- e e Ordinance No. 524 and in Ordinance No. 526 of said City of Vernon sufficient to pay the annual interest on such bonds for that year, and also such part of the principal thereof as shall become due before the t~e for fixing the next general tax levy. Said tax shall be in addition to all other taxes levied upon the taxable property in said district and shall be collected at the same time and in the same manner as other municipal taxes are collected, and forthwith as collected, shall be turned over and paid into said "CITY OF VERNON SEWER DISTRICT NO. ONE ELECTION 1939 BONDS, INTEREST AND SINKING FUND" and shall be used for no other purpose than the payment of said bonds and accruing interest. Section 4. The proceeds derived from the sale of said bonds shall immediately, upon receipt thereof by the Treasurer of said City of Vernon, be placed in the Treasury of said City of Vernon to the credit of a fund which is hereby created, and shall be known as "CITY OF VERNON S~~ DISTRICT NO. ONE CONSTRUCTION FUNP", and shall be applied exclusively to the purposes and objects mentioned in said Ordinance No. 524 and Ordinance numbered 526 of said City, and to the incidental expense in connection therewith, to wit: for the construction and acquisition of sewers in said district, and the construction of outlets for sewers already constructed in said district, for collecting and disposing of the sewage of said district, including the acquisition and construction of all necessary machinery, apparatus and other property to enable said sewage to be gathered and collected, including the acquisition of rights in sewers and outfall sewers of the City of L~ Angeles, to enable the sewage of said district to be disposed of by flowing the same through said sewers and outfall sewers of the City of Los Angeles, and its works and plants, to and into the Pacific Ocean. -8- e e Section 5. The City Clerk shall certify to the passage o~ this resolution by the City Council o~ the City of Vernon, and cause the same to be posted in three (3) public places in the City of Vernon and in City o~ Vernon Sewer District No. One, to wit: at the entrance of the City Hall of the City of vernon, 4305 Santa Fe Avenue; at the Northwest corner of 38th street and Santa Fe Avenue; and at the Northwest corner of 37th street and Santa Fe Avenue, and it shall thereupon take effect. ,Passed and adopted by the City Council of the City of Vernon, California, and approved by the Mayor of said City, this 25th day of JUly, 1939.
