Resolution No. 1030 e e RESOLUTION NO. 1030 A RESOLUTION OF THE CITY OF VERNON, CALIFORNIA, AMENDING RESOLUTION NO. 993 OF THE CITY OF VERNON ADOPTED ON THE 25th DAY OF JULY, 1939, AS AMENDED BY RESOLUTION 'NO. 1001 ADOPTED AUGUST 17,.1939, RELATING TO THE ISSUANCE OF THREE HUNDRED FIFTY THOUSAND DOLLARS ($350,000) OF BONDS OF CITY OF VERNON SEWER DISTRICT NO. ONE, WHICH BONDS ARE DESIGNATED AS "CITY OF VERNON SEWER DISTRICT NO. ONE BONDS, ELECTION 1939." WHEREAS, the City Council of the City of Vernon, California, did on the 25th day of July, 1939, adopt Resolution No. 993 providing for the issuance of Three Hundred Fifty Thousand Dollars ($350,000.00) of bonds of City of Vernon Sewe:r District No. Q;ne, which bonds are designated as "City of Vernon Sewer District No. One Bonds, Election 1939"; and WHEREAS, the said City Council did thereafter, to wit, on the 17th day of August, 1939 adopt Resolution No. 1001 amend.- ing Section 1 of said Resolution No. 993; and WHEREAS, it is now proposed to eliminate the interest rate for said bonds as fixed by said Resolution No. 993, as amended, to enable the City Council to fix and determine said interest rate for said bonds at a subsequent date when the lowest interest rate obtainable for said bonds shall have been deter- mined: NOW, THEREFORE, the City Council of the City of Vernon do hereby resolve and order as follows: Section 1,: .That Section 1 of said Resolution No. 993 of the,City of Vernon, adopted on the 25th day of July, 19:39, as amended, be and the same is hereby amended to read as follows: "Section 1: That bonds of said City of Vernon Sewer District No.. One, in the principal sum of Three Thousand Dollars ($350,000.00), be issued in accordance with the provisions of an Act of the Legislature of the State of California, known as "Municipal Sewe:r District Act of 1939", -1- - e and in accordance with the laws of the state of California and the Ordinances of the City of Vernon for the purpose of the construction and acquisition of sewers in said district and the construction of outlets for sewers already constructed in said district, for collecting and disposing of the sewage of said district, including the acquisition and construction necessa:ry machinery, apparatus and other property to enable said sewage to be gathered and collected, including the acquisition of.rights in sewers and outfall sewers of the City of Los Angeles to enable the sewage of said district to. be disposed of by flowing the same through outfall sewers.. of the City of Los Angeles, and its works and plants, to and.into the Pacific Ocean; That said bonds shall be 350 in number and shall be numbered from Ito.3501 both inclusive; shall be issued in the denomination of One Thousand each; that the principal and interest of said bonds shall be payable in lawful money of the United states; that said bonds shall be designated ltCrry OF VER11"ON SEvVER DISTRICT NO. ONE BONDS1 ELECTION 1939"; that said bonds shall be dated 1vlarch 1, 1940; and shall bear interest at a rate of not to exceed six per cent (6%) per annum, payable semi-annually on the 1st day of March and September of each and every year until said bonds are paid; that the principal and interest thereof shall be payable at the office of the City Treasurer of the City of Vernonl Califo:rnia, and said bonds shall be payable intl:le following manner, to wit: Bonds Nos. ONE BONDS, ELECTION 1939 VERNON, CALIFORNIA March 1, 1940 It -3- e e On the 1st day of March ..........(year of maturity) the City of Vernonl California 1 will pay to the bearer at the office of the City Treasurer of said City of Vernon, in the City of Vernon, state of California, the sum of One Thousand Dollars (~~lOOO.OO) with interest thereon at the rate of per cent ( %) per annum, pay- able semiannually on the first day of :March and the first day of September of each year at the office of the City Treasure:r of said City, upon the presentation and surrender of the interest coupons hereto attached, from the special fund in said City treasury provided by the levying and collection of taxes .upon the taxable property in said district to pay the interest and principal of this bond. This bond is issued in pursuance of the provisions of an act of the Legislature of the State of California, known "Municipal Sewer District Act of 1939"1 which became a law February 2, 1939. It is hereby certified that all requirements of the Constitution and laws of the state of California and of all Ordinances of the Cit.y of Vernon have been fully complied with by the proper officers in the issuing of this bond; that this. issue of bonds 1:las .been authorized by the vote of two-thirds (2/3rds) of the duly qualified voters of said.district:voting on the question of said issue at an election duly and regula.rly called and held in said district on April 11, 1939, and t1:lat t:be total amount of this issue is within the limits prescribed by the Constitution and laws of the state of California, including said "Municipal Sewer Dist:rict Act of 1939"; that before or. at the time of incurring the indebtedness evidenced herebYI pro- Vision has been made for the collection of an annual tax -4- e -- the property in said district sufficient to pay the intere~t on such indebtedness as it falls due, and also for the pay- ment of the principal thereof on or before ma.turity. Neither the City nor its officers shall be holden for the payment of the principal or interest of this bond, but the same shall be payable exclusively from taxes levied on the taxable property in said district. IN WITNESS WHEREOF, the City of Vernon has caused this bond to be signed by its Mayor and be countersigned by its City Clerk,.and the corporate seal of said city to be hereto affixed, and said City has also caused the coupons hereto attached to be numbered consecutively signed by the Treasurer of said City of Vernon. T:reasurer of the City of Vernon, Calif. ff Section 2: That the City Clerk shall certify to the passage of this resolution by the City Council of the City of Vernon and cause the same to be posted in three public plaQes in the City of Vernon and likewise in City of Vernon Sewer District No. One, to wit: at the entrance of the City IIall of the City of Vernon, 4305 Santa Fe Avenue; at the Northwest corner of 38th street and Santa Fe Avenue; and at the Northwest corner ,of 37th street and Santa Fe Avenue. This resolution shall take effect immediately.
