RESOLUTION NO. ~
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AC-
CEPTING A PORTION OF THE EQUIPMENT IN ACCORDANCE WITH SPECIFI-
CATION No. 131, AND Tr~ ORIGINAL BID OF FAIRBANKS-MOREE COMPANY.
TEE CITY COUNCIL OF THE CITY OF VERNON DOES RESOLVE AS FOLLOWS:
TF~T, WFillREAS, the City has heretofore advertised for
bids for the furnishing of two gasoline engine driven high
pressure fire pumps, in accordance with Specifications #131, and
W-BEREAS, the bid of Fairbanks-Morse Company was the
lowest and best bid, and
WHEREAS the City has been unable to accept the bid be-
cause the War Production Board of the United States of America
has not approved the application of the City for a preferred
rating covering all of the equipment, and
WHEREAS the F'airbanks-Morse Company is in a position
to furnish a portion of the equipment set forth in Specificatioh
No. 131 and the bid of the Fairbanks-Morse Company, and
WIillREAS the City Council finds that it is absolutely
imperative that this equipment be purchased owing to the general
emergency now existing in the City of Vernon, and
~nEREAS the City will within a reasonable time accept
the balance of the equipment that the bidder is unable to furnish
at this time owing to the orders and restrictions of the War Pro-
duction Board of the United States:
NOW, TI-IEREFORE, BE IT RESOLVED:
Section 1. That all bids heretofore received by the City
Council of the City of Vernon for the furnishing and delivering
complete two emergency portable gasoline engine driven fire
pumps on skids, in accordance with Specifications No. 131 here-
tofore approved by the City, be rejected, except the bid of the
F'airbanks-Morse Ci:Impany, and the said Faireanks-Morse Company

1 be awarded the contract for the furnishing of said equipment
2 for the price named in their bid.

Section 2. That owing to the emergency now existing
4 and the impossibility of the bidder to furnish all of the
5 equipment set forth in said bid at this time, the City Council
6 of the City of Vernon does hereby resolve to accept a portion
7 of the equipment that can now be secured, as set forth in the
8 letter of the Fairbanks-Morse Company, dated August 31, 1942,
9 for the sum of $8,464.00.

Section 3. The City Council of the City of Vernon will
11 accept the balance of the equipment set forth in said bid of
12 the said Fairbanks-Morse Company if same can be delivered with-
13 in six months from the date hereof.

Section
4. The Said Fairbanks-Morse Company shall

be required to conform in all respects with the Notice Invit-
16
ing Sealed proposals or bids, and Specification No. 131, for
17
the furnishing and delivering of the equipment set forth in
said letter of August 31, 1942, said letter now being on file
in the office of the City Clerk, which is hereby specifically
referred to and made a part of this Resolution.

Section 5. That the City Council of the City of Vernon
finds that it cannot secure other material or equipment that can

be used for the doing of the work required by the City, and that
unless said bid is accepted the city will be irreparably damaged.
Section 6. That an extreme emergency exists at this
time because of the war against the United States by the AXis
powers, and the City of Vernon is a city wherein there are man-
ufactured implements of war and it is absolutely necessary that
this equipment be bought and installed, and the City Council of
the City of Vernon, by a vote of 4/5thfs of its members declare

1 and determine that public interests and necessity demand the
2 immediate expenditure of this money to safe-guard life, health
3 and property.

Section 7. The City Clerk of the City of VeI'mlon is
5 hereby directed to certify to the passage of this Resolution
6 by vote of 4/5thls of its members, and thereupon and thereafter
7 the same shall be in full force and effect.
8 Adopted and approved this 1st day of September, 1942.
