RESOLUTION BO. 1291
A RESOLUTION OF THE CITY COUNC:IT, OF THE CITY OF VERNON APPROV-
ING AN AGREEMENT BETWEEB THE CITY OF VERNON, CALIFORNIA, AND
MECHANICAL FOUNDRIES CO. A CALIFORNIA CORPORATION
THE CITY COUNCIL OF THE CITY OF VERNOB DOES RESOLVE AS FOLLOWS:
THAT, WHEREAS, Mechanical Foundries Co. a California
corporation is conducting its foundry business now in a zone
other than the zone' established for this purpose; and
WHEREAS, said Mechanical Foundries Co. is desirous
of replacing one cupola for another cupola of like dlmensions;
and
WHEREAS, if s~me is permitted the said Mechanical
Foundries will not enlarge said non-conforming use; and
WHEREAS, the City of Vernon is desirous of allowing ,
a change of cupolas so as not to expand the use of the cupolas
now operated by the said Mechanical Foundries Co., and
WHEREAS, the said Mechanical Foundries Co. has sub-
m.itted a contract wherein they have agreed to remove the non-
existing cupola upon the completion of the new cupola to be
built and as evidence of good faith and as a guarantee to re-
move the present cupola which the new one replaces, will not
expand its non-conform.ing use in the zone in which it is now
situated, and as a guarantee for the removal of said cupola,
said Mechanical ~oundries Co., in additiOn to its contract, has
filed a certified check in the sum of $5000.00 with the City
Clerk, payable to the City of Vernon:
NOW, THEREFORE, BE IT RESOLVED:
Section 1.
That the City Clerk of the City of Verncm.
be, and he is hereby authorized and instructed to accept the
said certifieA check in the sum of $5000.00 and to deposit s~e
in the Trustee Account of the City.
Section 2. The City Clerk is hereby authorized and

1 INSTRUCTED to sign a contract with Mechanical Foundries Co.,
2 heretofore submitted by them, wherein the City agrees to re-
3 turn said $5000.00 upon removal of said old cupola therein
4 described.

Section 3. The City Clerk is hereby directed to
6 certify to the passage of this Resolution and thereupon and
7 thereafter the same shall be in full force and effect.

THIS AGREEMENT is entered into this 5th day of
Mareh , 1946. by and between the OI'fY OJ! VERNON,
California, hereinafter called the Oity, and MEOHANIOAL
FOUNDRIES, 00., a California Oorporation, hereinafter called
the Oompany.
REOITALS
Wft~~~~, the Oompany and its predecessor companies
have since 1928 been operating an iron foundry with two
c~polas, one larger than the other, at 4545 Pacific Bo~le-
vard, Vernon, California, ..tala.Zone No.., 6 tor Metal
Foundries as described in Section 3.6 of Ordinanoe No. 541,
dated July 1, 1941, and the Oompany desires to replace the
existing large c~pola with another cupola with the same size
steel shell and has tiled an application with the Oity for a
permit allowing s~eh installation; ani.'
WHEREAS, the city desires ass~rance that d~ring the
construction and installation of the s~bst1tute cupola and
the dismantling and removal ot the existing large cupola, the
Company will not expand its non-conform.ing use by the operation
of more than two cupolas or of cupolas of a larger size than
the two present ones:
AGREEMEN'i'
NOW, THEREFORE, in consideration ot the granting ot
the aforesaid permit, the Oompany agrees:
(l) That it .will not under such permit install a
cupola with a steel shell any larger than the larger of the
two existing cupolas.
(2) That it will dismantle and permanently remove
the larger of the two" existing cupolas as soon as the sub-
stitute cupola has been. installed under said permit and. is
in operation.
