A RESOLl1fION OF THE CITY COmleIL OF 'fHE CITY OF VERlION DECLARING
ITS IN!EN'fIOB 'f0 GRAlI'f THE GAS FRA.IfCBISE APPLIED FOR BY THE
SOtITHERN CALIFORNIA GAS. COMPAlYmlDER THE FIWiCHISE ACT OF 1937
'fHE CITY COmlCIL OF THE CITY OF VERlIOIf DOES RESOLVE AS FOLLOWS:
THAT.. WHEREAS.. the City Council of the City of Vernon
has received from the Southern California Gas Company, a corpo-
r~tion organized and existing under and by virtue of the laws of
the State of California and engaged as a public utility corpo-
ration in transmitting and distributing gas for all purposes
to consumers in the various municipalities and communities
in the State of California, including the City of Vernon, an
application under and pursuant to the provisions of the Franchise
Act of 1937 for a Franchise, which said application states.. in
compliance with the provisions of Section 2 of said Act, that the
purpose for which the Franchise therein applied for is to lay
and use pipes and appurtenances for the transmitting and dis-
tributing of gas for any and all purposes under.. along.. across
or upon the pu.blic streets, ways, alleys and places as the same
no'W or may hereafter exist 'Within the City of Vernon, and that
the term for which the Franchise herein applied for is indeterm-
inate.. as defined in 5ection 5 of the Franchise Act of 1937; an~
WHEREAS.. said application further states that the
applicaat if granted a franchise as therein applied for, will
pay the City of Vernon during the life of said franchise t'Wo
,
percent (2%) of the gross annual receipts of applicant arising
from the use, operation or possession of said Franchise, PROVIDED..
HOWEVER, that such payment shall in no event be less than one
percent (1%) of the gross aniual receipts of applicant derived
from the sale of gas 'Within the City of Vernon under said Gas
Franchise:

NOW, 'fHE.REFORE, BE I'f RESOLVED:
Section 1.
'fhat the Cit,. Council of the City of
Vernon, under and pursuant to the provisions of the Franchise
Section 2.
That the Grantee of said franchise shall
be required to file a bond running to the City of' Vernon with
at least two good and suff'icient sureties to be approved by
the City Council of the City of' Vernon in the penal S'Um of
One 'fhousand Dollars ($1000.00), or the filing of' a corporate
bond in the sum of' One Thousand Dollars ($1000.00), also to
be approved by the City Council, conditioned that such grantee
shall well and truly observe, fulfill and perform each and
every term and condition of such franchise and that in the
case of any breach of condition of such bond" the whole amount
of the penal sum therein named shall be taken and deemed to be
liquidated damages and shall be recoverable from the principal
and. sureties upon said bond.
Section 3.
There being no newspaper printed, pub-
lished or circulated within the City of' Vernon.. the City Clerk
of' the City of Vernon is hereby directed to post a notice in

2 The northwest corner of 38th street and Santa Fe Avenue, the
:5 northwest corner of 37th Street and Santa Fe Avenue, and
4 the Bulletin Board in the Lobby of the City Hall of the City of
5 Vernon, located at 4305 Santa Fe Avenue, Vernon, California,
6 at least twenty (20) days Qefore the date set for hearing of
7 objections, and in addition thereto, the City Clerk is instructed
8 to publish said notice at least once within fifteen (15) da7s
9 after the passage of this resolution in the Los Angeles Daily
10 Journal, a newspaper printed, published and circulated in the
11 City of LoS Angeles, a City adjacent to the City of Vernon.

Section 4.
The City Clerk shall certify to the
13 passage of this Resolution and thereupon and thereafter the
14 same shall be in full force and effect.
