G I A Resolution of The City Council of the City of Vernon Authorizing The City Treasur- er To Draw Funds to Satisfy Fines Levied Against The City of Vernon and Members of The City Council in Contempt Proceedings Arising Out of the Case Entitled, "The People of the State of California vs. City of Los Angeles, a Municipal Corporation, Et AI. It, No. 489890, in the Superior Court of Los Angeles County. wrffiREAS, the City of Vernon and certain members of the City Council of the City of Vernon have heretofore been served with an order of the Superior Court of the State of California, in and for the County of Los Angeles, dated Decem- ber 5, 1949, entitled, "Order To Show Cause Why Certain Defen- dants Should Not Be Punished For Cohtempttt, together with the "Affidavit of John T. Leggett re Contempt of Certain Defendants in Failing to Obey Judgmentl1; and WHEREAS, said order required that the City of Vernon and members of the City Council thereof appear on the 3rd day of January, 1950, in the aforesaid Superior Court, at the hour of 9:30 A. M., to show cause why they, and each of them, should not be punished for contempt in that the said City and members of the City Council thereof have failed to comply with the terms and provisions of the judgment of the said superior Court in the case entitled, "People of the State of California vs. City of Los Angeles, et a1.", number 489890; and ..-..~ WHEREAS, the City o~ Vernon and the members of the City Council thereo~, appeared by its City Attorney and their Special Counsel, Edward R. Young, in answer to said Order o~ the Court; and WHEREAS, the hearing on said charge o~ contempt was held in Department 20 o~ the Superior Court in the City Hall o~ the City o~ Los Angeles on the 10th, 11th, 12th and 16th days of January, 1950, with the Honorable Joseph T. Vickers presiding; and VlliEREAS, on the said 16th day of January, 1950, the Honorable Joseph T. Vickers, in the contempt proceeding afore- said, pronounced judgment and sentence whereby the City o~ Vernon and each of the members o~ the City Council were adjudg- ed to be in contempt of court for ~ai1ing within ninety (90) days o~ the entry o~ the decree in the case of "The People of the State of California, vs. City of Los Angeles, a municipal corporation, et a1.", numbered 489890, to complete all arrange- ments necessary for the ~inancing of the City of Vernon's proportionate share of the new treatment plant or works at Hy- perion according to the ga110nage allotted to said City of Vernon T1so that said share wi11 be availab1e as required", and sentenced the City of Vernon and each o~ the members of the City Council to pay a fine of Five Hundred Do11ars ($500.00) each, and sentenced each of the members of the City Council to serve a term of five (5) days in the County Jail for con- tempt of court, and further ordered that the members of the City Council be confined in the County Jail of Los Angeles County until the members of said Council shall have complied with the terms of the judgment above mentioned; and WHEREAS, a stay o~ execution of said sentence was grant- ed by the court staying the en~orcement of said sentence to and including January 31, 1950; -2- ... ... j<" NOW, THEREFORE, BE IT RESOLVED: That the Treasurer of the City of Vernon is hereby authorized and instructed~; upon being ad- vised and directed by the City Attorney of the City of Vernon so to do, to wi thdraw from the General Fund of the City of Vernon the sum of' Three Thousand Do11ars ($3,000.00) in cash and to pay the same, or so much thereof' as the City Attorney shall direct, to the Clerk of the Superior Court, or such other authorized person as the City Attorney shall desig- nate, in satisfaction of the said fines levied against the City of Vernon and the members of the City Coun- cil in the contempt proceedings referred to herein.
