Resolution No. 1474 I RESOLUTION NO. 1474 RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF.VERNON, CALIFOENIA, DETERMINING THAT THE CITY OF VERNON RAISE MONEYS BY THE ISSUANCE OF BONDS OF SAID CITY TO PAY A PART OF THE SUM REQUIRED BY A JUDGMENT AGAINST SAID CITY AND TO PAY FOR THE CITY OF VERNON'S PROPORTIONATE PART OF THE COST OF.THE ACQUISITION, CONSTRUCTION AND COMPLETION OF A CERTAIN MUNICIP AL IMPR OVEMENT, AND MAKING FIND- INGS RELATING THERETO. WHEREAS, the City of Vernon has contracts wi ththe Ci ty of Los .Angeles under and by virtue of which the City of Vernon discharges sewage into certain trunk sewers of the City of Los Angeles and such sewage is disposed of through the Hyperion sewage treatment plant and sewage disposal works (including submarine outfall sewer) now under construction. by' and to be completed by the City of Los Angeles, and by virtue of said contracts the City of Vernon has certain capacity in said sewers, treatment plant and disposal works; and WHEREAS, in an action in the Superior Court of Los Angeles County entitled "The People of the State of California, pla.intiff, v. City of Los Angeles, a municipal corporation, and others," in which the City of Vernon and members of the City Council of the City of Vernon were parties defendant, the Cour.t by its judgment ordered the defendant City of Vernon, within ninety days after the entry of the judgment, unless such City of Vernon adopted some method of disposing of its sewage other than a new treatment plant and disposal works at Hyperten, to complete all arrangemm ts. necessary for the financing of its proportionate share of a new treatment plant and sewagedis- posal works at Hyperion according to the gallonage allotted ,i to sa.id City of Vernon so that said, share will be available as required; and WHEREAS, said judgment has become final and the City of Vernon did not elect to adopt some other method of disposing of its sewage, and the estimated cost of the share to be paid by the City of Vernon is $2iOOO,000.00 and the City of Vernon has paid to the City of Los Angeles $700,000.00 of said estimated cost and, in order to complete the arrange- ments necessary for the financing of its share of the cost of construction of said treatment plant and disposal works, an additional $1,300,000.00 is still to be ra.ised by the City of Vernon, and it is proposed to raise such sum of $1,300,000.00 by issuing bonds of the City of Vernon in the principal sum of $1,300,000.00; NOW, THEREFORE, the City Council of the GIty of Vernon DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That the public interest and necessity demand the acquisitio.n, construction and co.mpletlon of a certain municipal improvement, to. wit: a sewage treatment plant and sewage dispo.sal works (including submarine outfall sewer) at Hyperion, in which, and in the Los Angeles City main trunk sewers leading thereto, the City of Verno.nhas and shall have capacity and a right of use to the extent of sixteen (16) cubic feet per seco.nd (said treatment plant and sewage disposal works are now being constructed by and will be co.mpleted by the City of Los Angeles). That by judgment of the Superior Court of Los Ange.les County, the City o.f Vernon is required to pay its proportionate part of the cost of said treatment plant and sewage dispo.sal wo.rks. 2. " That the est.fmated amount required to be paid .to the City of Los Angeles by the City of Vernon under said judgment, which also is the estimated cost to the City. of Vernon of said improvement and is likewise the estimated cost of the capacity in said improvement allotted to the City of Vernon, is the sum of $2,000,000.00. That $700,000.00 of said sum has heretofore been paid to the City of Los Angeles by the City of Vernon. That the a.mount of the principal of bonds of the City of Vernon to be is... sued to raise the moneys to pay the remaining part of said cost is the sum of $1,300,000.00. Section 2. That said munic ipa.l improvementr.e... quires an expenditure by the City of Vernon greater than the amount allowed for it by the annua.l tax levy. Section 3. That said municipal improvement is neccessary and convenient to carry out the objects, purposes and powers of the City of Vernon. ADOPTED, SIGNED AND APPROVED this 21st day of February, 1950.
