RESOLUTION NO. 158~
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON AUTHORIZING AND INSTRUCTING
THE CITY TREASURER TO PAY THE SUM OF
$1,225,486.03 TO THE CITY OF LOS ANGELES
FOR THE PURPOSE OF PAYING IN PART THE CITY
OF VERNON'S PROPORTIONATE SHARE OF THE COST
OF THE NEW TREATMENT PLANT AND WORKS AT
HYPERION ACCORDING TO THE LAST KNOWN
ESTII~TE OF COST, AND REMOVING RESTRICTIONS
UPON THE ACCEPTANCE BY LOS ANGELES OF
THE $700,000 AUTHORIZED BY RESOLUTION
NO. 1468 OF THE CITY COUNCIL OF THE
CITY OF VERNON.
WHEREAS, the City of Vernon and certain members
of its City Council have heretofore been held in contempt
of court because of an alleged failure to comply with the
terms and provisions of the judgment of the Superior Court
of the State of California in and for the County of Los
Angeles entitled, "The People of the State of Oalifornia
v. City of Los Angeles, et a1.," number 489890; and
~~~EAS, the Supreme Court of California did,
on the 3rd day of March, 1952 affirm the order and judgment
of contempt of said Superior Court and said decision and
order of the Supreme Court will become final on April 2,
1952; and
WHEREAS, it is the desire of the City of Vernon
and the City Oouncil thereof to attempt to comply with the
terms and provisions of the judgment of said Superior Court
in order to purge themselves of contempt and to show their
good faith; and
WHEREAS, on April 11, 1950 the City of Vernon
voted bonds in the amount of $1,300,000 for the purpose of
applying said amount on Vernon's proportionate share of the

cost of the new treatment plant and works at Hyperion, and
for the purpose of complying with the order of the court
above mentioned, said bonds having been sold, and the money
now being in the possession of the City of Vernon; and
WHEREAS, information has been received from the
City of Los Angeles that the present estimated cost of the
sewage treatment plant and works at Hyperion is $43,820,527.05,
of which Vernon's proportionate share, based upon a percent-
age of 4.22082 of the total capacity, is $1,849,585.57; and
~~REAS, Vernon is informed by the City of Los
Angeles that its proportionate share of the interest upon
bonds issued by Los Angeles for the payment of the cost
of construction is $83,450.21, according to the computations
of Los Angeles; and
~~REAS, by Resolution No. 1468, adopted on the
30th day of January, 1950 the City Council of the City of
Vernon authorized and instructed the City Treasurer of
the City of Vernon to pay to the City of Los Angeles the
sum of $700,000, to be accepted by the City of Los Angeles
on account of the City of Vernon's proportionate share of
the cost of the new treatment plant and works at Hyperion,
and to be accepted without prejudice to any of the rights
which the City of Vernon claims by reason of those certain
contracts heretofore executed between the City of Vernon
and the City of Los Angeles, and without prejudice to the
legal position or rights of the City of Vernon in that
action entitled, "City of Vernon v. City of Los Angeles"
numbered 558132, in the Superior Court of Los Angeles
County, and said money was on the 1st day of February, 1950,
paid to the City of Los Angeles; and

~EEF~AS, by Resolution No. 1472, adopted on the
7th day of February, 1960, the City Council of the City of
Vernon has heretofore assigned to the City of Los Angeles
the sum of $7,549.75 from the funds allocated to the City
of Vernon by the state of California under Chapter 20,
statutes of 1946 (First Extra Session) as amended, to apply
on Vernon's proportionate share of the cost of the sewage
treatment plant and works at Hyperion; and
WHEREAS, the City of Los Angeles has indicated
that it has not accepted the payment of the $700,000 because
said amount was paid conditionally and was not paid without
prejudice to the legal position or rights of the City of
Vernon under the aforementioned contracts with Los Angeles
or under the action entitled, .'City of Vernon v. City of Los
Angeles," No. 558132, nor will it accept the payment of
any money if any such conditions are attached; and
\VHEREAS, the balance of Vernon's proportionate
share of the estimated cost of the new treatment plant
and works at Hyperion, according to the figures furnished
by the City of Los Angeles, amounts to $1,225,486.03,
which includes Vernon's proportionate share of the estimated
cost of construction of the plant and works plus Vernon's
share of the interest paid on bonds issued by Los Angeles
for said construction, less the amount of $707,549.75,
heretofore paid to Los Angeles as above recited,
NOW THEREFORE, BE IT RESOLVED:
That the City Treasurer of the City of
Vernon is hereby authorized and instructed to pay to the
City of Los Angeles the sum of $1,225,486.03, said payment
to be accepted by the City of Los Angeles on account of the
City of Vernon's proportionate share of the cost of the new

treatment plant and works at Hyperion.
BE IT FURTHER RESOLVED that the conditions imposed
upon the City of Los Angeles of the acceptance of the payment
of $700,000 heretofore authorized by Resolution No. 1468,
wherein said payment was to be a.ccepted without prejudice
to the rights of the City of Vernon under those certain
contracts heretofore executed between the Oity of Vernon
and the Oity of Los Angeles, and without prejudice to the
legal position or rights of the City of Vernon in the action
entitled, ttCity of Vernon v. City of Los Angeles," No. 558132,
in the Superior Court of Los Angeles County, are hereby
rescinded, and said payment is considered to have been made
without such conditions attached.
PASSED AND ADOPTED at an adjourned regular meeting
of the City Council of the Oity of Vernon on the 17th day of
March, 1952.

Gentlemen:
This Board filed a report of the City Attorney,
transmitting Check No. 63,887, in the sum of $1,225:.486.03,
dated March 17, 1952, drawn by the City of Vernon on the
Citizens National Trust and Savings Bank of Los Angeles, to
be applied on the City of Vernon's proportionate share of the
cost of constructing the new treatment plant and works at
Hyperion, and a copy of a resolution adopted by the City COuncil
of the said City of Vernon authorizing the said payment and
the rescission of the conditions imposed by the City of Vern~n
on the City of Los Angeles concerning the payment of $700,000.00
heretofore made by the said City of Vernon for the said purpose.
Action was taken by the Board referring the said
check to the Chief Accounting Employee, with instructions to

lished for Cities contributing toward the construction of the
Hyperion Activated Sludge Plant, as directed in the said report
