RESOLUTION No. 1620
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZ-
3 ING THE SETTLEMENT OF A CLAIM FOR DAMAGES TO TRAFFIC SIGNAL
ON THE EAST SIDE OF SANTA FE AVENUE AT 25th STREET.

5 THE CITY COUNCIL OF THE CITY OF VERNON DOES RESOLVE AS FOLLOWS:
6 WHEREAS, on or about the 14th day of January, 1952,
7 James M. Jacobus acting in the capacity of an agent and employee
8 of Pacific Freight Lines ran a truck owned and operated by the
9 Pacific Freight Lines in the City of Vernon into a traffic signal
10 located on the East Side of Santa Fe Avenue at 25th Street; and
11 WHEREAS, the City Engineer of the City of Vernon has
12 determined that the cost of repairing said traffic signal is the
13 sum of $246.86; and
14 WHEREAS, the Pacific Freight Line tenders the sum of
15 $246.86 as settlement in full of all damages resulting from the
16 destruction of said traffic signal;
17 NOW, THEREFORE, BE IT RESOLVED:

Section 1:
That the Mayor and the City Clerk are
19 hereby authorized to execute a release of all claims upon pay-
20 ment to the City of Vernon of the sum of $246.86 by the Pacific
21 Freight Lines.

Section 2: The City Clerk of the City of Vernon is
hereby directed to certify to the passage of this Resolution and
thereupon and thereafter the same shall be in full force and

effect.
Adopted and Approved this 20th day of August, 1952.

(This paragraph applies to accidents in California) The California Civil Code, Section 1542, provides as follows: "Cer-
tain claims not affected by General Release--A general release does not extend to claims which the creditor does not know
or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his
settlement with the debtor." I UNDERSTAND AND AGREE THAT ALL RIGHTS UNDER THIS SECTION OF THE
CIVIL CODE OF CALIFORNIA ARE EXPRESSLY WAIVED BY ME.
I understand that the iniuries are or may be permanent; that the injuries are or may be progressive and become more
serious and that the length of disability and recovery is uncertain. I nevertheless consider. that the money now being paid
me is fair and equitable under all circumstances. I accept it as a full and final settlement of all claims, rights and dam-
ages which Inow have or may have against the parties being released, their agents or representatives.
In making this agreement I have not relied on statements nor representations regarding my rights, claims for damages,
facts of accident and nature and extent of my iniuries by the parties being released, their agents and representatives. On
the contrary, I have consiciered all these matters myself and have relied entirely on my own judgment.
I understand that the amount of this settlement is a compromise settlement of a doubtful and disputed claim or rights
for all damages arising out of the accident referred to above. It is further agreed that this settlement is not to be considered
as an admission of any responsibility whatsoever, in whole or in part, for the accident by the parties released, their agents
or representatives.
This release contains the entireagreement between me and the parties released and their agents and representatives
and it is agreed thaUhe terms of this release are contractual and not a mere recital.
I UNDERSTAND THAT THIS IS ALL THE MONEY I WILL RECEIVE AS A RESULT OF THIS ACCIDENT.
I HAVE READ THIS RELEASE, UNDERSTAND IT AND AM SIGNING IT VOLUNTARILY.

The following is a report of the lnvestigl3.tion made by the Vernon Police
Department on dall'l..a.ged Illraff'ic signal on Santa. Fe Ave., at 25th street.
Log entry 4:45 P.M.,l-14-52, Lantry phones and states that the traffic
signals at 26th and Santa Fe are not working.
4:46 P.M.,Phoned Edison Company and told them of traffic signals out of
order at 26th Street and Santa Fe Ave.,per above log entry.
6:14 P.M.,Lantry in on desk and reports, while patroling Santa Fe Ave.,
observed traffic control signal on east side of S~~ta Fe, governing east bound
and northbound traffic, knocked down, met J'ar:1es Melvin Jacobus. 431 south Hope
street,L.A.,Ohau.ffeurs license #B-202863, who stated he was emplo;red by
'aci~ic Freight Lines, 2501 South Alameda, Ad-6l81, and was backing 1941
Chevrolet 21t ton stake truck~. # 1590, license BIB X88288, in to loading dOCk.
of Variety Associates, 252C5 8m. ta Fe AV. ,and accidently lmocked do,vn signal,
Met. Mahan, City signal repair man, who stated he would remove signal off of
sidewalk but would be unable to replace it until tomorrow morning, There are
no signals working at this intersection as the si2',nal h'11ocked dorm, controlled
all signals.
