Hammond, as set forth in Resolution No. 1610 of the City of' Vernon; and WHEREAS, Resolution No. 1610 of the City of Vernon withheld $200.00 due said Barber-Bridge Drilling Corp. Ltd. under its contract dated December 19, 1950; and ~iEEREAS, the City Council nO\-1 finds that the payment of ~$200000 so \vithheld should be paid to the Barber-3ridse Dril1in[: Corpo Ltdo Nm.;, 'I'HEREFORE, BE IT RESOLVED: Section 1: That the City Council of the City of Vernon hereby' approves, and directs the payment of ;i~200.00 to Barber- Bridge Drilling Corp. Ltd. beine; the balance due and final payment upon the contract between the City of Vernon and the Barber-Bridge Drilling Corp. Ltd. under the contract hereinabove ref'erred to. Section 2: The City Clerk of the City of Vernon shall certif'y to the passage of this Resolution and thereupon and there- af'ter the same shall be in full force and effect. MOORE, ADMINISTRATIVE AS.ISTANT CITY HALL 4301l SANTA FE AVENUE VERNON 58, CALIFORNIA IN REPLY REFER TO: ENGINEERING DEPARTMENT September 30, 1953 Files: 4-C-8 l-W-34 Honorable City Council City of Vernon Vernon, California Gentlemen: Before final payment by the City of Vernon to Barber Bridge Drilling Corp., Ltd. for the drilling of Water Well No. ll, under Specifications No. 153 and Contract dated December 19, 1950, Roy E. Hammond filed a claim, dated May 19, 1952, with the City for labor, against Barber Bridge Drilling Corp., Ltd. in the sum of $8l.62. In accordance with Resolution No. 1610, the City withheld the sum of $200.00 from said final payment until the alleged claim of Roy E. Hammond was settled. On September 28, 1953, Barber Bridge Drilling Oorp., Ltd. presented the attached photostat of canceled check No. 4381, dated June 10, 1952, in the amount of $95.25 to Roy E. Hammond, as evidence that they have settled said claim. Roy E. Hammond endorsed said check under the notation "Endorsement of this check by payee hereby ac- knowledges payment in f~ll". Other than said cancelled check, Barber Bridge Drilling Corp., Ltd., have been unable to get a claim release from Roy E. Hammond. It is recommended that the matter be referred to the City Attorney for an opinion as to the cancelled check being a release of the claim. If said check is sufficient release, it is further recommended that Barber Bridge Drilling Corp. Ltd. be paid the $200.00 withheld in accordance with Resolution No. 1610.
