therefor ata special bond election held on the 4.thday of November, 1952.;. and

in said bond issue propoaition within the incorporated area. or City without
the permission of City; and
WHEREAS, the bond issue proposition.submitted to and approved of by
the electorate provided that City s amongst other things, would exercise its
powers to require the relocation of utilities to accommodate the c.onstrllct-

Gentlemen:
Herewith are six copies of an Enabling Agreement proposed
between the City of Vernon and Los i~ngeles County Flood Control
District, which provides for furnishing the District with the necessary
City perm5"ts to construct the storm drains within the City of Vernon
provided for in Storm Drain Bond Issue Project No. 1 b:ast Compton
Creek Storm Drain No.1; for the City to cause utilities to revise,
modify, or relocate their facilities, excepting certain facilities
as noted; and for assignment to the District any City ovmed drainage
easements necessary to accon~lish the proposed improvements.
Also enclosed is copy of letter from Flood Control District
dated August 19, 1954, the last two paragraphs of which refer to the
proposed agreement.
It is requested by the Flood Control District that six
copies of this agreement be executed for the City of Vernon and re-
turned to the District for further handling. Three fully executed
copies will be returned to the City after execution for the District
by the Board of Supervisors.
The proposed agreement provides in paragraph 3, paGe 2:
uTo trs'cl1sfer or assign to District on request, and without property
cost, any drainage easements now oWDed by Cityll.
The only such easement involved is one for storm drain in
vacated portion of Alcoa }\.venue, which is covered by a quit-claim
deed subluitted by the District for execution by the City and which
has been referred to the Cit7JT Attorney by the City Council on 1\.ugust/

The storm drain itself is to be ovmed by and to be maintained
at its expense b;r Los Angeles County Plood Control District. The
auxiliary sanitary sewer lines necessitated because of the sto~n drain
and to be constructed by the District are to be ovmed, operated, and
maintained by City of Vernon.
Subject to approval of the City Attorney, it is recol11.mended
that the proposed agreement be executed as requested by Los Angeles
County Flood Control District.

The referenced agreement was entered into on
approximately the date noted above, between your city
and the Los Angeles County Flood Control District,
and relates to accomplishment of the storm drain bond
issue program adopted by the voters of the Los Angeles
County Flood Control District on November 4, 1952
which program included construction of at least a part
of a storm drain within your city.
This agreement has become pertinent in certain
pending litigation between the District and various
public utilities. It is our understanding that your
City Council, or other governing bOdy, passed a reso-
lution authorizing the signing of the above agreement
by the person signing the same on behalf of the city,
or the minutes of some meeting of your governing body
show that such execution was authorized by your'gov-
erning body. To aid us in the noted litigation, we
will appreciate it greatly if you will provide us with
a copy of such resolution or an extract from the offi-
cial minutes.
Your cooperation in this matter will be greatly
appreciated.
