12 Second Party a license for the construction, use. and maintenance of a

14 the Yernon Industrial Lead Track No.3 in the vicinity of MilePo.st3. 64...
15 San .Pedro Branch, Verno.n, Ca:I.lfornia.; and
16 WHEREAS, the p.ro.perty o.ver which the license was given

18 No.. 58Z.568 in the Superio.r Court o.f Los Angeles County.. final order of
19 co.ndemnation being dated Septemher ZS, 1953; and
20 WHEREAS.. the license granted in said agreement is no. longer
21 of any value to.. the City o.f Yernon; and
22 WHEREAS, the First Parties under said agreement req'Uest
23 the ex.ecutionof a termination rider for said agreement;

SECTION 1:
That the Mayo.r and the City Clerk of the City
of Verno.n he, and they are hereby authorized anddireeted to execute a
Termination Rider on the part o.f the City of Yernon.. termin;;rting the
said Agree.roem hereinabove referred to. and that the same he forwarded
to the Unio.n Pacific Railroad Companys: together with' a certified copy
of thiS: Resolution.

Gentlemen:
By Resolution No. 1612, adopted and approved August 5,
1952, agreement Vias entered into b~r and between Los Angeles & Salt
Lake Railroad Company and its lessee, Union Pacific ~1.ailroad
Company, first part:,.'", and Ci t.\_ of Vernon, second party, coverinG
the use by CitS' of' Vernon of a private roadway across 11ailroad
Company's right of way on west side of Downey Road, approximately
550 feet south of Vernon Avenue.
In connection vlith widening and hnpl'ovement of Dovmey
Road by Los Angeles County Road Department, the County has acquired
for street purposes the 20 foot strip covered by agreement above
referred to, under Los Angeles County Superior Court Case 582568,
:8'inal Order of Condenma tion ds.ted September 25, 1953.
There is attached hereto letter from Union Pacific
Railroad Company, dated October 22, 1953, together with duplicate
originals, for exec1Jtion, of TeI'mination Eider.
Inasmuch as the agreement for use of the crossing is
no longer effective because the area is a pl).blic street, it is
recommended that the rrermination Rider be executed on the part
of the City of Vernon as requested by the Union Pacific Hailroad

Condemnation dcdH; Septernber 25, 1953, enclose her Bv.lith, for
your handling to execution em behalf of the City of Vernon,
duplicate originals of Terrrdnation Rider, CLD 11017-1, dated
October 15, 1953, terninating agreement A:t1dit A-71408, effective
September 25, 1953, covering above mentioned r()adviay.
Will appreciate your having both counterparts of the
attached docwrrents properly executed by the Mayor of the City
of Vernon, attested by Cit;y Clerk and the City's seal affixed
thereto, returniYlg same to this office as promptly 8S possible
for further handling on behalf' of the Railroads, after which
fully. executed counterpart marked original for "Licensee" will
be returned for your files.
