CALIFORNIA CONTRACT THIS CONTRACT, made and entered into by and between the CITY OF VERNON. a municipal corporation in the County of Los Angeles. State of California. hereinafter referred to as the ItCity'1 and JAMES M. MONTGOMERY of Pasadena, California, hereinafter referred to as the "Engineerlt. WITNESSETH: T HA T WHEREAS, the City requires and needs the services of an engineer in connection with a competent survey, stu.dy and report complete with maps and estimates for a master plan of development and expansion for the water system of the City of Vernon. and WHEREAS, the Engineer is competent. qualified and desirous of rendering such service to the City. NOW. THEREFORE. THE PARTIES HERETO MUTUALLY AGREE as follows: 1. SERVICES. For the compensation herein stipulated, the Engineer hereby promises, undertakes and agrees to furnish engineer- ing services on a consulting basis in conne'Ction with .a Master Plan for the Development of the Water System of the City of Vernon as follows: \ a. General. A comprehensive study and report which shall provide a master plan of development and expansion for the water system -1- JAMES M. MONTGOMERY' CONSULTING ENGINEER. 15 NORTH OAKLAND AVENUE' PASADENA 1. CALIFORNIA CONTRACT of the City of Vernon shall be furnished. Recommended improvements shall be based on present and future supply, demand, and predicted industrial development of the remaining undeveloped area of the City. The recommended improvements shall be made with due regard to the time that they will be required. b. Supply. An analysis shall be made of the existing ground water supply and the possibility of developing additional supply from this source. The integration of Metropolitan Water District supply into the existing and future water system shall also be studied and preliminary drawings shall be provided showing the proposed connections. c. Additional Water Storage Capacity. The need for additional water storage capacity shall be studied relative to the ground water supply, the contemplated Metropolitan Water District supply. and the relation of additional elevated storage to the required booster pump capacity. Improvements to the existing reservoir at Vernon and Santa Fe Avenues shall also be studied and recommended. d. Distribution System. Studies shall be made of the existing distribution system to determine the present and future adequ.acy of transmission and distribution main capacity. Flow tests shall be made of the major feeder mains in the City to determine flow coefficients for a hydraulic analysis of the distribution system. Recommendations ~2- JAMES M. MONTGOMERY. CONSULTING ENGINEER. 15 NORTH OAKLAND AVENUE' PASADENA I. CALIFORNIA CONTRACT would be made in light of present and future demands on the distribution system. e. Pumping Plant No.1. Studies shall be made of exist- ing booster pumps at Pumping Plant No. I and recommendations shall be made concerning improvements to this plant. f. Financial Analysis. A study of the financial records of the water system shall be made to determine past and present expenditures and revenues. This study shall result in recommendations being made pertaining to a revised water rate schedule including charges for service connections and standby rates. The Engineer shall render such additional information, advice and consultations in connection with said Survey. Study, and Report as may be required by the City. 2. PAYMENT. For the services to be rendered by the Engineer, and for the preparation of said Survey, Study and Report complete with maps and estimates to be included therein, and furnishing twelve (12) copies thereof, and upon acceptance thereof by the City Council of the City of Vernon, the City.agrees to pay to the Engineer his actual pay- roll costs plus a sum equal to said payroll costs. the total sum of which shall not exceed ten thousand dollars ($10,000). -3- JAMES M. CALIFORNIA CONTRACT Payment of the amount due shall be made after claim duly filed therefor in manner as required by law. said claim to be filed by the Engineer with the City after the Engineer has fully kept. fulfilled and performed all of the terms, conditions and provisions of this Agreeme.nt upon the part of the Engineer to be kept. fulfilled and performed, and upon acceptance of said Survey, Study, and Report complete with such maps and estimates by the City Council of the City of Vernon. 3. TITLE. It is expressly agreed and understood, by and between the Parties hereto, that any and all Surveys, Studies, Reports. Maps, Estimates, and other documents as shall be prepared and sub- mitted by the Engineer to the City and each and all of the copies thereof, and all information and everything furnished to the CUyof Vernon by the Engineer under and pursuant to the provisions of this Agreement, shall. upon being furnished to said City, then and there be and become the property of said City. 4. BOQKS OF ACCOUNT. The Engineer agrees to keep proper books of record and account in which complete and correct entries shall be made of payroll costs. Said books shall be subject to reasonable examination by the City. 5. ENFORCEMENT OF CONTRACT. In the event that the Engineer is required to file suit to enforce payments of any of the -4- JAMES M. CALIFORNIA CONTRACT amounts due under this Agreement. the City agrees to pay, in addition to any judgment obtained by the Engineer. a reasonable amount to be determined by the Court for attorney fees and court costS. 6. SUCCESSORS AND ASSIGNS. All the terms, conditions and provisions hereof shall inure to and shall bind the parties hereto, their and each of their respective heirs. executors, administrators, successors and assigns.
