A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
ACCEPTING RELEASE OF OPERATING RIGHTS FROM TIlE ATCHISON:I
TOPEKA. AND SANTA FE RAILWAY COMPANY AND THE LOS ANGELES
AND SALT LAKE RAILROAD COMPANY I DATED NOVEMBER 2, 1954.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:

WHEREAS. the City Council of the City of Vernon has hereto-
fore authorized the filing of a stipulation for judgment in the case of the

UNITED STATES OF AMERICA vs. CERTAIN PARCELS OF LAND, etc..

et aI, in the United States District Court, Southern District of California.
Central Division. being numbered therein 1064-HW, Civil. .and said
judgment has been filed and entered; and
WHEREAS, pursuant to said judgment there has been delivered

to the City of Vernon a Release of Operating Rights from the Atchison,
Topeka and Santa Fe Railway Company and the Los: Angeles and Salt Lake

Railroad Company. bearing date of November 2, 1954, releasing to the
City of Vernon any and all rights held by said releasors to construct,

maintain and operate a railroad track or tracks across that parcel of land
described in said release; and
WHEREAS, said release conforms in all respects to the said

stipulation for judgment and the judgment, and it is for the advantage and
best interests of the City of Vernon that said Release of Operating Rights

be accepte.d;

NOWI THEREFORE" BE IT RESOLVED:
SECT ION 1;
The City Council of the City of Vernon

hereby accepts the aforesaid Release of Operating Rights from the
Atchison, Topeka and Santa Fe Railway Company and the Los Angeles
and Salt Lake Railroad Company, bearing date of November 2, 1954,
and directs the recording of said Release in the office of the County
Recorder of Los Angeles County, California.

SECTION 2:
The City Clerk of the City of Vernon shall
2 certify to the pas:sage of this Resolution and thereupon and thereafter
3 the same shall be in full force and effect.

RELEASE OF OPERATING RIGHTS

WHEREAS, THE ATCHISON, TOPEKA AND SANTA FE RAILWAY
CONPANY, hereinafter for convenience called "Santa Fe", and
LOS ANGELES & SALT LAKE RAILROAD COHPANY, hereinafter for con-
venience called "Salt Lake", are the holders jointly of the right
to construct, maintain and operate railroad spur tracks over,
upon and across that portion of Bandini Boulevard, a public s'treet
in the City of Vernon, County of Los Angeles, State of California,
hereinafter more particularly described, by virtue of an easement,
dated May 16, 1925, from Arcadia Bandini Baker Estate Company to
Santa Fe and Salt Lake, recorded in Book 5668 at Page 216, Officia
Records of Los Angeles County, California; and,
WJillREAS, the railroad tracks heretofore located over
and across said parcel have been relocated and by documents
executed concurrently herewith the property upon which such re-
10cated tracks are 10cated is being conveyed to Santa Fe and the
right to construct, maintain and operate such relocated trackage,
in comrnon wi th Santa Fe, is being granted to Salt Lake by Santa Fe:
and,
WHEREAS, in consideration for the conveyapc~ of such
property and rights, Santa Fe and Salt Lake are willing to re-
linquish the rights presently held by them with respect to the
construction, maintenance and operation of tracks in the herein-
after described parcel.
NOW, THEREFORE, Santa Fe and Salt Lake do hereby release
and relinquish unto the City of Vernon, a municip~1 corporation,
any and all rights held by them to construct, maintain and operate
D. railroad track or tracks across that parcol of land described as

No.1 of the Rancho Laguna (so called) within the Rancho
San Antonio, in the County of Los Angoles, State of
California, said Tract being shown on a map known as
Clerk's Filed Hap No. 880, filed as Exhibit "A" in Case
B-25296 of the Superior Court of the State of California,
in and for the County of Los Angeles.
Said parcel of land lios entirely within the railroad
right-of-way described in a dced to The Atchison, Topoka
and Santa Fe Railway Company, in Book 11872 page 249 of
Official Records of said County, and is that portion of
said described right-of-way lying within Parcel 1168 as
described in Caso No. 1061t~H Civil within the following
described boundary lines:
Beginning at the intersection of the Northeast~rly
lino of Bandini Boulevard, 80 feet in width, as described
in a deed to the Ci ty of Vernon, recorded in Book L~762,
pages 71 and 72 of Official Records of said County, with
the Eastorly line of that certain strip of land 80 foot
in width, described in a deed to the Los Angelos Terminal
Railway Company, recorded in Book 702, page 281 of Deeds,
records of said County, said point of beginning being
distant along said Easterly line North 1" 09' 25" West
696.78 feet, more or less, from the most Northerly corner
of Tract No. 5974 as shown on a map recorded in Book 69,
pago 67 of Maps records of said County; thence along tho
said Northeasterly line of Bandini Boulevard South 73" 28'
05" East 161.37 feet to a point on a nontangont curve,
concave to the Northeast, and having a radius of 488.34
feet, a radial line to said point bears 'South 49" 01' 19"
West; thence Southeasterly along said curve 178.05 feet
to the end of curve, a radial lino to said end of curve
boars South 28" 07' 55" West; thence North 76" 03' 21"
West 300.39 feet, more or 10ss, to tho intorsection of tho
Southwesterly line of said Bandini Boulovard with the said
Easterly lino of said 80 feet strip of land deeded to said
Los Angeles Terminal Railway Company; thence along said
Easterly line North 1" 09' 25" West 83.97 feet to the point
of beginning.
Contains 0.03 acre, more or loss.
By the execution of this instrument Santa Fo and Salt
Lake do not grant to the City of Vernon or reloase or relinquish
any titlo hcld by them, or either of them, to the surface or tho
subsurface of tho above described parcol, it baing the intention
of this document to releuse, and only to roloase, tho right to
