RESOLUTION NO. 1876
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
3 AMENDING SECTION 5. SUBSECTION (A) OF SALARY RESOLUTION
NO.. 1347 OF THE CITY OF VERNON.

5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLYESAS FOLLOWS:

SECTION 1:
Effective a.s of December 6. 1955.. that
8 portlon of Section 5. Subsection (A) shall be amended to read as followa:
9 HWhere an employee is paid on a monthly. salary baals:,
10 such employee shall be paid the amount produced by multiplying
11 the regular monthly aalary by a fraction having as its denominator
12 the total number of working days in the calendar month (in acco.rdance
13 with the regular wQrk schedule of the employee in question) and as
14 its numerator the total number of.ayaactually worked. tDara
15 actually worked. for the purpose of this: computa.tion ahall include
16 excused and paid absences as: hereafter provided for.. as: well a.s
17 legal holidays. to which the employee is entitled under his: regular
18 working schedule during the pay period in question and so long as he
19 is employed by the City of Vernon. Provided. that. when such
20 employee is hired or w.s employment is: terminated after the beginning
21 or before the end of a salary period. no salary shall be payable on
22 account of any days. preceding such hiring.. or for any days following
23 such termination. H

SECTION 2:
The City Clerk of the City of Yernon.shall
25 certify to the pasaage of this. Resolut1onand thereupon and ,thereafter the,

Re: Resolution 1847 relative to salaries
To the Honorable City Council:
Recent discussions with department heads concerning the language
of subsection (a) of section 5 of the above resolution have
indicated that, as presently written, its language may be
unsatisfactory.
At the present time the subsection in question provides, in ef-
fect, that, where a full-time employee does not work an entire
pay period, his salary is to be computed by multiplying the
regular monthly salary by a fraction "having as its denominator
the total number of days in the calendar month and as its numer-
ator the figure which shall be the result of SUbtracting the
actual working days lost from the total number of days in the
calendar month".
Under' this language it is possible to have a situation arise
in a month having 31 calendar days and 20 working days, for
example, where an employee is terminated after working the
first week (5 working days). Under such circumstances, he
would receive 16/31 of the entire monthly salary, while having
actually worked only 5 days.
It will be possible to clarify this section by providing, in
lieu of the above-quoted language, the following:
"Where an employee is paid on a monthly salary basis,
such employee shall be paid the amount produced by
multiplying the regular monthly salary by a fraction
having as its denominator the total nuaber of working
days in the calendar month (in accordance with the
regular work schedule of the employee in question) and
as its nuaerator the total nuaber of days actually

worked. 'Days actually worked' for the purpose of this
computatioD shall include excused and paid ab.ences as
hereafter provided for, as well as lecal holidays to
which the eaployee is entitled under his regular work-
ing schedule during the pay period in question and so
long as he is eaployed by the City of Vernon.1t

If this aeets with the approval of the Council, the aatter should
be referred to the City Attorney for aaendaent of the resolu~ion.
