A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
.A.PPROVING CERT AINPLANS AND DlRECTING THE EXECUTION
OF A CONTRACT BETWEEN THE CITY OF VERNON AND ANTHONY
BROS... .INC.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS I the Fire Department of the City of Vernon is in
need of certain facilities to test fire apparatus; and
WHEREAS, Anthony Bro.. I Inc. are skilled and experienced

WHEREASI on December 91 .1955" Anthony Bros. I Inc. I did
formally bid .on the construction of the necessary reservoir.
NOW. THEREFOREs BE IT RESOLVED:
SECTION 1:
That the plans p:repared by Harold A. Barnett I
Consulting Enginee1", March 19561 being numbered B14-13S4" as: revised
April 2, 1956~.Section A-A are hereby approved.
SECTION 2:
That the plans attached to this Resolution
and marked "Exhibit .A" are hereby made a part of thecontractl excepting
those part.sspecifically excepted on the face of the plans.
SECTION 3:
That the contract between the City of Vernon
and Antho:ny Bros. " Inc.~ consisting ofa letter dated December 91 1955and
a formal contract dated March 151 1956 and Engineers Drawings numbered
BI4-1384"as revised" be and the same is hereby accepted.
SECTION 4:
That the contract price is payable 30 days afte
acceptance af the Reservoir by theCoITsulting Engineer and not in accordance
with Anth.ony Bros. I Inc. 's contract dated March 15" 1956.. and in all cases
where the terms of the contract conflict with the terms of thieReSQlution.,

GENERAL TERMS AND CONDITIONS
I.. Contractor guarantees the work performed by it against defects in material and workmanship for the period of one year from the date
pool is plastered. Contractor shall not be liable on the within warranty for any period beyond that given by the Manufacturer of such items
as electric motors, lights, ladders, filters, heaters, diving boards and similar items furnished on job.
2. If plans and specifications are attached to within agreement they form part oUhis contract. In case of conflict between the provisions
stated in such plans and specifications and the terms of the within contract, the terms of the within contract shall prevail.
3. All requests by Owner.fqr changes, alterations or additions in the work shall be in writing, subject to acceptance by Contractor,at
additional price to be agreed upon in writing and paid in advance. ,
4. Contractor shallfurnishbuildingpermitsOOwners shall. furnish any I)ecessary licenses and zone variances.
5. Owners shallsupervise the locatiol) of buildings or other improvements and there shall be no liability on part of Contractor for incorrect
location thereof, whether on Owner's property or the property of third person.
6. The contract price is based upon the following mutual assumption of facts:
(a) That the site is not fill ground, contains no rock formation or boulders and adequate bearing capacity.
(b) That the site Contains no cesspool, septic tank, gas line, water pipe, drainage pipe, irrigation pipe or underground electrical conduit or
other obstructions not apparent from an inspection of the surface; that no underground or surface water conditions will interfere with the work
or operation of the completed structure or installation.
(cJ That electrical service exists on the premises and the existing lines, switch boxes and transformers ar<3 adequate for the load required
for the electrical installations specified in the contract.
(d) That no blasting or jackhammer work isre.quired.
(e) That there arerea.sonable. means of access for Contractor's equipment.
(f) Upon completion Contractor is notresponsible for floatation of pool due to external water.
7. It isunderstood.and agreed that If any of the foregoing assumptions of fact should prove mistaken, the Contractor may aUts option, dis-
continue performance of the contract or,ifadditional work or materials pre required thereby to complete the contract at Contractor's option,
the same may be performed or installed and shall be added to the contract price at the direct cost thereof, plus twenty-fiveperce.rif thereof,
which Owner agrees to pay.
B. If performance by the COl)tractor is delayed, prevented or frustrated by war, act of the public enemy, the imposition of governmental con-
trois, priorities or limitation orders, storms, rain, earthquake or other forces of nature, malicious mischief, or causes beyond Contractor's control,
the Contractor may, at its option, discontinue further performance or, in the event that Contractor so elects, the time for p<3rformanceshall be
extended by the duration of such cause.
9. If Owner fails to do, within p reasonable time, any .aCt required of .Owner by this agreement, Contractor may, Clt its option, terminl!te this
agreement, discontinu.e performance and demand and be entitled to, payment under paragraph 10.
10. If Contractor, for any of the reasons expressed in the foregoing paragraphs or for any default of the Owner, elects to discontin.ue per-
formance, the Owner shall pay the costs of all labor and material performed and used to such date, plus the cost of all material rendered
unusable, .plus twenty-five percent of the total of such costs including all taxes on labor.

13. Owner agrees, in connection with the specificCltions pertaining to the within swimming pool, that ContractorshClII hClve CI permissive vClri.
Clnce of 3% on all designated surface dimensions, Clnd a 3%, variance on all vertical dimensions, and agrees to hold Contractor harmless unless
such variance: in said- pool specifications are in excess of those set forth herein.
14. Owner agrees that if any damage occurs to the swimming pool after its construction, and which is occasioned by Owner draining said
pool, or which shall be caused by a change in the water-table or ground conditions, or occur after said construction, from natural causes, Con-
tractor shall be held harmless therefrom.
15. Owner agrees that inor any reason whatsoever the City, County, State, or other municipality or Board shall reCluire the installationoh
dry-well or other water waste facilities, either before or afterthe construction of said pool, Owner will hold ContractorhClrmless from cost qr
responsibility therefor, and if Contractor be required actually to install any such dry-well or other water waste facilities, Owner shall be liable
for the cost thereof to Contractor, to be payable on completion of the same.
16. Consent, waiver or compromise by Contrac.tor of or .under anyd the provisions of this contrpct, or as to any breach or default by Owner,
shall not constitute or be .construed as a. waiver of Contractor's right to insist upon strict. interpretation and performance of the.termsand
provisions hereof by Owner ortoexerciseany of the rights specified herein in favor of Contractor, or any lien Or other rights provided by law.
17. Thirty (30) days after filter has been put in operation a Five Dollar ($5.00) minimum charge will be made for all service calls.
18. This contract is printed in triplicate, deviations,.changes or crossing out any printed matter by either party must be done in triplicate. in
the. presence of both parties and initialed by both parties. Anthony Brothers, I nc., is responsible only for the contractual work shown initialed
and approved on all three copies of the triplicate contract form.
19.. If the agreed price includes caissons, this price is based on the soil to be free of boulders or other materialthat may impede the drill-
ing of said caissons. Additional cost will be based .onextra drilling time plus 10%.
