Resolution No. 1920 1 2 RESOLUTION NO. 1920 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON 3 AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE COUNTY SANITATION DISTRICT NO.1 FOR THE CONTROL OF THE 4 COLLECTION AND DISPOSAL OF REFUSE IN THE CITY OF YERNON. 5 6 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 7 WHEREASI the County Sanitation District hasl or are about to 8 acquire" facilities for the disposal of rubbish; and 9 WHEREAS~ it is the desire of the City of Vernon to have com- 10 plete control over the rubbish collection in the City of Vernon; and 11 WHEREAS I the County Sanitation District No.1 has submitted 12 an Agreement whereby the City has control over the collection of said 13 rubbishl a copy of which Agreement is attached hereto as Exhibit uA nand 14 incorporated herein; and 15 WHEREASI the City Engineer~ City Health Department and the 16 City Attorney of the City of Vernon have heretofore approved said Agreement; 17 NOW # THEREFORE.. I, and COUNTY SANITATION DISTRICT NO. 1 OF LOS ANGELES COUNTY I a body politic. hereinafter referred to as the "District. 11 WITNESSETH: WHEREAS I District proposes to construct. maintain and operate a refuse collection and disposal system within the District in addition to its sewage collection. treatment and disposal systen'l as authorized by law; and WHEREAS. District desires City to act as its agent in effecting such degree of local collection of refuse and rubbish as desired by City within that portion of the. District located within the incorporated limits of said City; and WHEREAS. City desires to act as agent for District in effecting such degree of local collection of refuse and rubbish as desired by City; NOW . THEREFORE I in consideration of the mutual covenants and conditions contained herein and the advantages to be obtained and derived therefrom by the parties hereto. it is mutually agreed as follows: 1. City hereby agrees to act as agent for District in effecting such degree of local collection of refuse and rubbish as desired by City within the incorporated limits of said City which may be included in Districtts refuse collection and disposal system. 2. District shall pay to City the sum of One Dollar ($1. 00) per yearl commencing with the effective date of this agreement, for such local collections services as are desired and performed by City within its incor- p~rated limits as agent for District" and City agrees that all other costs and expenses incurred by it in effecting said local collection as agent for District shall be borne by City without reimbursement by District. 3. District agrees that City shall be free. at all times to dispose Exhibit "A II -1- 1 2 3 4 5 6 7 8 9 of such refuse and rubbish as collected within the incorporated limits of said City in any manner selected by City; provided. however. that District shall not be liable for any cost of disposal of said refuse and rubbish by said City. 4. District agrees that its transfer and disposal facilities owned and operated b;y it sball at all times be available for use by said City. upon the same terms and conditions and subject to the same regulations .and charges prescribed for other members of the District. 5. City shall comply with .a11 applicable statutes. ordinances 10 and regulations pertaining to refuse collection and disposal whether its 11 activities as agent for District are conducted within or without the incor... 12 porated limits of said City. 13 6. District agrees that City shall be free to effect s.uch local 14 collection of refuse and rubbish as desired by City within the incorporated 15 limits of said City with its own employees. or by contracting with others 16 for said local collection service. or in any other manner which the City 17 deems suitable; provided. however. that in the event City desires to utilize 18 the District's transfer and disposal facilities in disposing of refuse and 19 rubbish collected within said City. it shaU comply with all existing rules 20 and regulationsestabUshed by District relating to the use of the District's 21 transfer and disposal facilities.. and City further agrees to pay to District 22 the service fee or disposal charge prescribed by District for us.e of its 23 transfer and disposal facilities. 24 25 < 26 z a ~~ 27 0: '" II. This agreement shall become effective upon the formation of a refuse collection and disposal system by District pursuant to law. 8. This agreement may be terminated by City upon written notice to District. Said notice of termination must state the date on which termination shall become effective. which date must be not less than two years after delivery of said notice to District. G. California. or to such other address as the District shall hereafter specify in writing to City to which said n.otices should be sent. 11. It is the purpose and intention of this agreement that nothing herein contained shall impair. alter . abridge or modify the City's present or future right to arrange for such local collection of refuse and rubbish as desired by City in any manner which City deems appropriate; that nothing herein contained is intended to require said City to dispose of such refuse and rubbish as collected within said City in any specified manner or at any specified location other than that which City deems suitable and appropriate. (~r:r:. ofrO G}J " Gentlemen: Under date of July 6, 1954 your City Council authorized the City's inclusion in a refq~e collection and disposal system proposed to be formed in Sanitation D~~trict No. 1. It is believed that you had in mind at that time that it was's\1ificiently well understood that the Board of Directors of the District in forming the refuse collection and disposal system would not attempt the collection activity but would leave this to the several District cities and to the County. Two of the larger cities and the County did not at that time consent to inclusion in the refuse collection and disposal system because there was no contractual assurance that the District would not at some time without further consent from the cities and the County assume the collec- tion activity. Therefore, the refuse collection and disposal system forma- tion has been seriously delayed. We now conclude that in order to safeguard against such an eventuality as an attempt by the District to collect as well as dispose of refuse, it is advisable for each of the cities to enter into an agreement with the District in line with the terms embodied in the attached specimen agreement which. as you will note,leaves the collection activity entirely within the purview of city and County, and that the document is so worded that the District will have no control whatsoever over how, or to what extent, the City engages in the activity or through what agency it conducts it. .. .,. . , ,. .. It will merely be assurance to you and to those cities which might assume that the District would event- ually endeavor to interfere with the collection activity. that such a situa- tion cannot develop. Formation of the refuse collection and disposal system is a legal prerequisite to purchase of the Palos Verdes disposal site, there- fore, it is urged that your City Council approve the agreement or an agreement in substantially the same form and containing the same con- ditions and return it to the Joint Administration office at the earliest consistent date. Should you desire a member of our staff to meet with and further explain to the City Council the meaning and intent of the agreement, we will be glad to have a member present at any meeting which you designate.
