RESOLUTION NO. 1963
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
GRANTING A ZONING VARIANCE TO FOOD MACHINERY AND CHEMICAL
CORPORATION.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
THAT WHEREAS.. an application for a zoning variance was filed
with the City Clerk of the City of Vernon on the 2nd day of July.. 1956~ by
the Food Machinery and Chemical Corporation for a variance under the
provisions of Section 6.1 of Ordinance No. 541 of the City of Vernon.. and
all amendments thereto.. on that certain parcel of land situated in the City
of Vernon and more particularly described as follows.. to wit:
Those portions of Lots 4. 5s 6.. 7s 8.; 9~ 10.. 11s 12..
19 and 20 in Block 45 of Huntington Park Extension No. 2s
in the City of Vernon~ County of Los Angeles~ State of
California.. as per map recorded in Book 11. Page 6 of Mapss
in the office of the county recorder of said county~ and a
portion of Rancho San Antonio in said city. described as
follows:
Beginning at the southeast corner of the parcel of land
conveyed to Mechanical Pattern Workss by deed recorded
in Book 2737.. page 143~ Official Records; thence along the
south line of land so conveyeds South 890 31 t 3011 West 421. 91
feet to a point distant easterly 85 feet~ measured at right
angles. from the east line of a 60 foot right of way conveyed
to California Central Railway Company~ by deed recorded in
book 557 page 82 of Deeds; thence l?arallel with the east line
of said right of way South 00 08' 30 I West.. 200.01 feet;
thence North 890 31 t 30 II East 556.86 feet to a point in the
northeasterly line of said Block 45.; said northeasterly line
being a curve concave to the southwest having a radius of
894.25 feet; a radial line from said point bearing South 630
39' 1811 West; thence northwesterly along said northeasterly
line of Block 45.. 240.80 feet to the point of beginning,
and
WHEREAS.. the application for variance was regularly set for
hearing before the City.col.{nc11 on the 27th day of July.. 1956.; at the hour
of to 01 clock a. m. in the Council Chambers at the City HaUs located at
4305 Santa Fe Avenue.. in the City of Vernons California; and
WHEREAS.. all notices as required under said Ordinance were
regularly and duly given of the time and place of said hearings and the City
Council having heard the matter on the 27th day of July.. 1956.. at the hour

of 10 o'clock a. m. in the Council Chambers of the City Council~ and all
evidence was heard from all persons interested in said variance. and no
person protesting the same.. and the City Council having heard all the
evidence and statements of said persons and being fully informed in the
premises the matter was submitted for decision.. and on the 7th day of
August. 1956. the Council considered the application and made the following
findings and decisions:
NOW.. THEREFORE1 THE CITY COUNCIL OF THE CITY OF
VERNON FINDS AS FOLLOWS:
1. That the property hereinabove referred to and described is
suitable for the purpose for which the petitioner requesting said variance
intends to use it. to wit: for a foundry.. in addition to such other uses as
are lawful in the zone in which the property is located. subject to certain
restrictions.
2. That unnecessary hardship would be put upon petitioner and
the owner of said property in the use of said property if its request for a
variance w as denied.
3. That results inconsistent with the general purposes of
Ordinance No. 541.. and all amendments thereto.. would result if the request
for such variance was denied.
4. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved~ or to the intended use of the
property.. that do not apply generally to the property or class of uses in the
same district or zone.
5. That such variance is necessary for the preservation and
enjoyment of a substantial property right of the petitioner.
6. That the granting of such variance will not be materially
detrimental to the public welfare.. or injurious to the property or improve-
ments in such zone or district in which the property is located.
NOW.. THEREFORE.. the variance covering the property herein-
above described is granted for the use of a foundry~ in addition to such
other uses as are lawful in the zone in which the property is located.. subject

1 I to the following terms and cenditions which the City Council deems proper
2 to preserve the public health.. safety.. convenience.. welfare and the general
3 intent and purposes of the zoning ordinance.. as amended:

1. That no cupolas be installed on the subject property~ and that
5 no additional cupolas be installed on the property now owned . andop.eratedby
6 Food Machinery and Chemical Corporation at 4545 Pacific Boulevard..
7 Vernon, California.

2. That all regulations of the City of Vernon Building Depart-
9 ment and Fire Department be complied with in connection with construction
10 of buildings and installations of equipment on said property.

3. That aU regulations of the Los Angeles County Air Pollution
12 Control District be complied with in connection with installation of equip-
13 ment on said parcel.

4. That petitioner acquire title to the property des.cribed in the
15 petition within a period of ninety (90) days from the date of the granting of
16 the conditional variance.

5. That the property be used for and in the manner set forth in
18 Paragraph 7 of the petition for variance filed in said matter.

6. That the conditional variance hereby allowed is conditioned
on the privileges granted herein being ut ilized within ninety (90) days from
and after the effective date hereof.. and should the privileges authorized
hereby fail to be exercised or utilized, or" where some form of construction
work is involved" such construction or some unit thereof has not actually
commenced within such ninety (90) days after said effective date.. this
resolution shall be void and any privilege or variance granted hereby shall
lapse.. unless such time has been extended by resolution of the City Council.
7. That in the event the privileges granted herein s.hallnot
have been exercised within such ninety (90) days by reason of the delay in
the approva.l of plans by any officer or depart.ment of the City of Vernon
having jurisdiction thereof, the City Council may by resolution grant an
extension of the time .so specified in the preceding paragraph when such
extension shall have been recommended by the officer or department of the

1 City of Ve.rnon having jurisdiction to grant approval of such plans.
2 A copy of this Resolution is to be filed in the records of the
3 proceedings on the pe.tition for variances and a copy mailed to the Applicant.
4 The City Clerk of the City of Vernon shall certify to the passage
5 of this Resolution and thereupon and thereafter the same shall be in full
6 force and effect.
7 ADOPTED and APPROVED this 7th day of August.. 1956.
