A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON 1
PETITIONING CONGRESS TO ENACT AT THE 1958 SESSION THE NECESSARf
LEGISLATION AUTHORIZING THE SECRETARY OF COMMERCE TO MORE
EQUITABLY APPORTION FUNDS TO THE SEVERAL STATES FOR CON-
STRUCTION AND COMPLETION OF THE NATIONAL SYSTEM OF INTER-
STATE AND DEFENSE ffiGHWAYS.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEll,EAS, under the provisions of Federal Highway~Act of
1956, theapporti0tlment of funds to the several states to construct the
National System of Interstate and Defense Highways is made as follows:
one-haUin the ratio which the population of each state bears to the total
population of all the states as shown by the latestavallable Federal Census,
provided that no state shall receive less than 3/4 of 1 per centum of the
money so apportioned, and one-half in the manner now provided bylaw for
the apportionment of funds for the .Federal-Aid Primary System which is
based 1/3 on area, 1/3 on population and 1/3 on post road or rural delive;ry
mileage; and
WHEREAS, California's gas tax payments to the Federal Treasu
approximateJO% of the nationts total, but underthe above formula we receive
back only 5. 7%; and
WHEREAS, the Federal Highway Act of 1956 provides that
apportionment of funds to the several states for the fiscal year 196:0 thrQugh
1969 inclusives.hall be in the ratio which the estimated cost of completing the
Interstate -System in each state bears to the sum of estimated cost of com-
pleting the system in all of the states (this formula is referred to as the
llN eeds.F ormulal1J; and

WHEREAS, the act further provides that the-Secretary of Com-
merceshall submit to the Senate and House of Representatives within 10 days
subsequent to January 2, 1958 a detailed estimate of the ~cost of completing
Interstate System ; and
WHEREAS, it is necessary that Congress by concurrent resolu-
tion give approval of such estimate:of costs before theSecreta.ryof Commerce
may make use of the approved needs formula in making apportionment for

1 subsequent years; and
2WHEREASI the acute highway problems in California demand a
3 larger allocation of these Federal funds .so as to allow freeways to be built
4 more quickly to handle the greater traffic loads brought on by Qur tremendous
5 population increases - constant migrations Jrom other states - with attendant
6 increase .in motor vehicles of 348,254 in 1956 over 1955" equal to 29, 000
7 additional cars every month on our highways., and toaUeviate the presently
8 congested freeways and lessen the number of a.ccidents;
9 NOW ~THEREFORE.t BE IT RESOLVED:
SECTION 1:
That the City of Yernon hereby petitions
11 Congress to enact at the 1958 session the necessary concurrent resolution
12 authorizing the Secretary of Commerce to apportion funds among thes.everal
13 states for the construction and completion of the National System of Inter-
14 state and Defense Highways in the raltiowhich the estimated cost of completing
15 the system in each state bears to the sum of the estimated cost of completing
16 the system in all of the states asproyided insubs.ection(d) of Section 108 of
17 the Federal-Aid Higltway Act of 1956;

That copies of this resolution besenf to each
19 Senator and Congressman of Ca1ifornia~

SECTION 3:
The City Clerk of the City ,.of 'Vernon shall
21 certifyto the passage .of this Resolution and thereupon and thereafter the
22 same shall be in fllll force and effect.

Secretary of Commerce to apportion funds among the several states
for the construction and completion of the National System of

cost of completing the system in each state bears to the sum of
the estimated cost of completing the system in all of the states as
provided in subsection (d) of Section 108 of the Federal-Aid High-
waY' Act of 1956.

I am very p1.eased to have received the reso1.t.tion of your City
Counci1. on this subject. I shall be p1.easedif you win lihform your City'
Council that I intend to support the 1.egislation which would change the
apportionment formula for the construction and completion of our new
National. Interstate Highway System as provided in Section 1.08 (d) of the
Federal. Aid Highway Act. As a. matter of fact, I urged from the outset that
this type of apportionment formula be adopted in the Act. In my judg!llent,
the people of the State of California were not getting a fair share of the
revenues to be collected under Tit1.e II of the Federal. Aid Highway Act of
1.956. The Act provided that within 1.0 days subsequent to January 2, 1.958,
the Secretary of Commerce shall. transmit to the Congress his estimates upon
which the new apportionments for fiscal. year 1960 shall be made.
It seems c1.ear that Congress should, without undue de1.ay,
adopt the concurrent reso1.ution urged by your City Council.. I will work
for and support such a concurrent reso1.ution.

Dear Mr. Ziemer:
On November 25, 1957, you sent me a copy of the Resolu-
tion, adopted by the City Council of the City of Vernon, relating
to Federal-aid Highways and Federal-aid Highway legislation. I
received many similar resolutions from various cities through-
out the State of California, and have been in cotIllllUnication with
the Bureau of Public R.oads to gather information covering the
points brought up in these resolutions.
Witb respect to the rlneeds" formula fOr apportionment
of funds for the Interstate System for the fiscal years 1960,
1961 and 1962, the Se~retary of .Commerce has i\lst submitted to
Congress a repj)rt entitled, "A Report of Factors for Use inAp-
portioning .Funds for the National System of Interstate and De-
fense Highways as required by Section 108(d) of the Federal-Aid
Highway Act of 1956 (Public ~aw 627 - 84tb Congress). rl I am
enclOSing a copy of this report for your information.
The data included were prepared by the individual States
and submitted to the Bureau of Public Roads for analysis, evalua-
tion and review in order to assure accuracy and uniformity in the
overall estimates. The Secretary of Commerce bas recommended, in
submitting this report to Congress, and in his recent testimony
before the Subcommittee on Public R.oads of the Senate Committee
on Public Works, tbat the estimate of the cost of completing the
Interstate System contained in the repor.t be approved by Congress
for use as . the basis for apportioning Interstate System funds for
fiscal years 1960, 1961 and 1962.
This report will be considered by the ijouse Public Works
Committee within the next few weeks. The Senate Public Works
Committee has already held several days of hearings, which are

scheduled to be continued early in February .

closely, and will be in touch with you again as the work pro-
gresses.
