RESOLUTION NO._2125
.A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON"
CALIFORNIA FINDING AND DETERMINING THE PUBLIC INTEREST
AND NECESSITY FOR" AND AUTHORIZING THE CONDEMNATION OF"
CERTAIN REAL PROPERTY IN THE CITY OF VERNON" CALIFORNIA
IN FEE SIMPLE FOR MUNICIPAL RESERVOIR" WATER SYSTEM
PLANT.. FIRE STATION AND PUBLIC BUILDINGS AND GROUNDS
PURPOSES AND FOR ANY OTHER PUBLIC USE AUTHORIZED BY IJnl.
WHEREAS.. the City of Vernon has heretofore
attempted to negotiate the purchase of the hereinafter
described real property; and..
WHEREAS" the owners of said property have
rejected said negotiations and have failed to offer
said property to the City of Vernon.. a municipal
corporation" for the fair market value thereof; and..
WHEREAS.. efforts by the City of Vernon.. a
municipal corporation.. to purchase said property have
been unsuccessful and a proceeding in eminent domain
will be necessary for the acquisition of said property
by the City of Vernon;
NOW THEREFORE.. the City Council of the City
of Vernon" a municipal corporation" does hereby resolve..
find and determine as follows:
SECTION 1:
That the publiC interest and
necessity require the acquisition" construction and
completion by the City of Vernon of a publiC improvement
for the use of the City of Vernon and the inhabitants

thereof for municipal reservoir for the storage and
distribution of water for domestic$ industrial and
fire protection purposes$ for municipal water system
plant purposes$ for a fire station$ for public
buildings and grounds$ and for any public use
authorized by law.
SECTION 2:
That the public interest and
necessity require the acquisition, for said public
improvement by the City of Vernon$ of a fee simple
estate in and to the hereinafter described real
property; that said fee simple estate in said real
property isnecessar.y for said public improvement; and
that said proposed public improvement is planned and
located in a manner which will be most compatible with
the greatest public good and least private injury.
SECTION 3:
That the City of Vernon is
hereby authorized and empowered to acquire in the name
of the Oity of Vernon$ a municipal corporation, a fee
simple estate in and to the hereinafter described real
property by a proceeding, or proceedings, in eminent
domain in accordance with the provisions of the Code
of Civil Procedure and the Oonstitution of the State of
Oalifornia relating to eminent domain.
SECTION 4:
That Oars on B. HUbbard, Oity
Attorney, and Thomas G. Baggot$ as Special Oounsel, are
hereby authorized to prepare and prosecute in the name
of the Oity of Vernon, a municipal corporation, such
proceeding or proceedings, in the proper court having
jurisdiction thereof, as are necessary for such
acquisition; to make application to said court for an

order f:1x:ing the amount of such secur:ity :in the way of
money depos:its as said court may direct, and for an
order permitting said City to take immediate possession
and use of sa:id real property for reservoir purposes.
That said Carson B. HUbbard, City Attorney, and Thomas
G. Baggot, Special Counsel, and each of them, shall be
re:irnbursed for their expenses and any monies advanced
on behalf of the City of Vernon, and that they, and
each of them.. shall be pa:id for their services the
reasonable value thereof; such charges to be audited
and approved by the City Counc:il.
SECTION 5: That the real property which
the City of Vernon is by th:is resolut:ion author:ized to
acquire for said public purposes is situated in the
City of Vernon, County of Los Angeles.. State of
California, and is bounded and particularly described
as follows:
That portion of the Rancho San Antonio
as per map filed in Book 1 at page 389
of Patents in the office of the Recorder
of Los Angeles County, California
described as follows:
Beginning at an angle point in the center
line of Soto Street, 80 feet wide.. said
point being distant S 10 ,561 20" E, 968.63
feet from the :intersection of said center
line with the center line of 26th Street..
as said streets are shown on Map filed in
the office of the Recorder of said County
in Book 55 at page 44 of Records of SurveYJ

SECTION 6:
This resolution shall take
effeot immediately.
SECTION 1: That the City Clerk shall certify
to the passage and adoption of this resolution; shall
enter( the same in the book of original resolutions of
said Council; shall make a minute order of the passage
and adoption thereof in the reoords of the proceedings

shall turnish certified copies thereot to Thomas G.
