Resolution No. 2127 1 2 RESOLUTION NO. 2127 A l(ESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON 3 TER.MINATING AN AGREEMENT WITH THE COUNTY SANITATION DISTRICT NO. 1 FOR THE CONTROL OF THE COLLECTION AND 4 DISPOSAL OF REFUSE IN THE CITY OF VERNON. 5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES.AS FOLLOWS: 6 7 WHEREAS. under date of April 17. 1956. the City Council of 8 the City of Vernon adopted Resolution No. 1920 authorizing the execution 9 of an agreement with CountySanitation District No.1 far the control of 10 rubbish collection in the City of Vernon; and 11 WHEREAS. the 1957. Amendment to the County Sanitation 12 District Act deprives the Sanitation Districts of power to engage in local 13 collection of rubbish; and 14 WHEREAS7 Counsel for the Sanitation District points out no furt er 15 purpose can he served by said agreement by reason of such amendment7 and 16 that the$a.nitation District will approve immediate termination thereof; 17 NOW,. .THEREFORE. BE IT RESOLVED: 18 That notice of termination of Contract No. SECTION 1: 19 1009,. dated April 17. 1956 between the City of Vernon and County.Sanitation 20 District No. 1 is hereby given. 21 SECTION 2: The City Clerk is hereby instructed to 22 forward a certified copy of this Resolution to the Board of Directors of 23 County Sanitation District No. 1. 24 25 0( 26 z C ... California /~~ Gentlemen: 15, 1958 Reference is made to Contract No. 1009, dated April 17, 1956, between the City of Vernon and County Sani- tation District No. 1 of Los Angeles County. ~his contract was entered into for the purpose of relieving the Sanitation District of concern with effecting any local eollection of refuse and rubbish. However, the 1957 amendment of the County Sanitation District Act deprives the Sanitation Districts of power to engage in local collec- tion. There is thus no further punpose to be served by said agreement~ and we therefore suggest that possibly the City may desire to give notice to the District of termination, effective upon approval of such termination by the Sanitation District. . paragraph 8 of the contract provides that it may be terminated by City upon written notice to District, and that such notice of termination shall not become effective until at leaat two years after delivery of the notice to Diatrict. We are of the opinion that this language does not preclude the District's approving immediate termination should the City desire it. If this suggestion of termination meets with the approval of your honorable body, your favorable consideration will be appreciated. JCG:lf <II , .'
