COUNTY OF LQS ANGELES" STATE OF CALlFORNlA...ENDORSIN<1THE STATEMENTS OF PRINCIPLES WITH RESPECT TO STAT.E WIJ)E WA~R DEVELOPMENT ADOPTED BY THE FEATHER RIVER PROJECT ASSOCIA- TION AND THE SOUTHERN CALIFORNIA WATER .CooRDINATING COUNCIL.. THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 2 WHEREAS.. .one of the most important problems facing the people of this State today is the devel.opment of the water resourceso~ the $tate to ful- fill the needs of the water deficient areas of the. State while at the same time protecting the water surplus. areas as to. the development of water resources to meet their future needs; and WHEREAS. this problem is state-wide in nature. affecting every per- son in this State and not limited to the development of water under the propose Feather River Project. and should be met and solved in a manner both equitable and beneficial to the people in all parts of.the State; and WHEREAS,. the Feather River Project Association and Southern Cali- fornia Water Coordinating Conference have adopted statements ofPrinciple.s with respect to Stat e.-wide Water Development which embody proposed solutions to this problem which are equitable and feasible and could well serve as a framework upon which to build a program of state-wide water development which will be of benefit to all the people of the State; NOW.., THEREFORE.. BE IT RESOLVED: SECTION 1: That this body hereby endorses the Statementof Principles with respect to State-wide Water Development adopted by the Feather River Project Association and the Southern California Wa.terCo- ordinating Cauncil.and instructs the City Clerk to forward copies hereof to our representatives in the California State Legislature. SECTION 2: . The City Clerk of the CityofYernon shall certify to the pas.sage of this . Resolution and thereupon and thereafter the same shall be in full force and effect. [;;3-, -C~~~o ~ Dear Mayor Furlong: The Committee of Mayors of the Cities of Los Angeles COWlty recently called a joint meeting with the Los Angeles CoWlty Delegation of State Assemblymen and State Senator, Richard Richards in the interest of Wli- fying the thinking and efforts of Southern California Cities with respect to one of the most important problems confronting all of us -- Water. As a result of that meeting. the Committee of Mayors unanimously endorsed the Statements of Principles of the Feather River Project Association and the Southern California Water Coordinating Council with the hope that such action would strengthen the hand of our legislative representatives in Sacramento. Copies of these data are enclosed for your information. The Committee of Mayors also urged that every city in Southern California participate in this coordinated effort. It ~as felt that this could be done with the adoption of the enclosed resolution by your City Council. Thirty-two copies of this resolution should be sent as soon as possible to Sacramento in care of State Assemblyman Carley V. Porter, Head of the Los Angeles County Delegation of State Assemblymen. Assemblyman Porter, upon receipt of the aforesaid copies, ~ill distribute them to ourrepre- sentatives in the State Capitol. Your cooperation will be deeply appreciated as this problem ~arrants the wholehearted support of your city along with the many other cities of Southern California. Adopted by Feather River Project Association Board' of Directors, August 9, 1951, Sa cramento, Calif. .,fi' "" ., ., The following polioies should apply in the authorization and financing of State water projects, including the Feather River Projeot: Authorization: The State should construct proje cts or should provide funds for the construction of projects only as authorized by the State Legislature. Sources of Funds: California as a State should assume the overall responsibility for financing the Feather River Project and other authorized State water projects. In order that there be assurance of adequate financing, in addition to .funds then authorized, general obligation bonds in an amount sufficient to complete the entire project should be authorized as early as possible, even though this might mean that more. bOnds are authorized than are sold because of receipt of .funds from other sources as hereinafter proposed. While the bonds to be issued will be general obligation bonds of the State, they should be supported by contracts of reimbursement to be made with each water or power user agency. i. Bond Issues: Supplementing funds which are available by appropriat:lonby the Legislature or otherwise, sufficient bonds should be voted to complete a specific water project such as the Feather River Project. Bonds authorized for such a project should be used only for purposes defined in such bond authorization and should be kept separate from the Water Projects Construction Revolving Fund. Bond interest and bond redemption payments for the reimbursable costs of such project should be the first demand on revenues of such project after meeting operating and maintenance costs. Fund: There should be a nto this fund the State Legislature may transfer a portion of State receipts from tideland . oil revenues, the "Rai.I'\v' Day Fund, tl and any other mo.nies deemed ap- propriate by the State Legislature. Money should be paid out on re- imbursablefeatures of proje ets from this Fund only under direct ap-. propriation by the Legislature for projects including those too small to warrant a bond issue. All money EtO appropriated from the Water Projects Construc:tion Revolving Fund should be returned to this .fund with interest by those benefiting from such project in accordance with this statement of Financial Policy. 3. The State should appropria.te from the general fund monies for acquisition of reservoir and dam sites, rights of way, relocation of highways and utilities, and for improvements removed or damaged by construction of the project. 4. Funds properly allocable for the construction of improvements for recreational features .of state-wide interest should be provided from funds available to the State for beaches, parks and recreation. ./ . s. Funds of the State, such as "Rainy Day" fund and sums derived from the State' s tideland oil revenues and investment funds thereof, and 8I'I1 other available funds, may properly be made available by the Legisla- ture as under-writing for the construction of the project. 6. The Federal Government should be requested to supply funds in line with present or future federal policies, including allocations to flood control, fish and wildlife, recreational values of national in- terest and navigation. 1. Where areas express a desire for irrigation funds under recla- mation or other federal law, the Federal Govermnent may be requested to supply funds properly allocable for irrigation in connection with a State project, provided no handicaps are placed on State ownership and operation. 8. Operati~ Fund: An Operating Fund with separate accounts for each project sho d be established. Into such account should be paid all revenues from sale of water and power, all contract payments out of project taxes raised by project beneficiary areas or districts, and all other revenues from each respective project. The first charge on these revenues should be forneC6ssary operation and maintenance of the reim- bursable features of each respective project. The next charge on these revenues should be for bond interest and redemption whenever there are outstanding bonds or other indebtedness for the reimbursable features of such projedi. If loans to the project have been made from the Water Projects Construction Revolving Fund for reimbursable features of such project to Meet such reimbursable costs, payment of interest and return of ca~tal also should bea charge against such revenues. All remain- ing revenues should be used only to meet the requirements of the project from.which such revenues are derived. Allocation of Costs: The State should adopt a policy for determining benefits and costs which, based on reoognized methods, will result in reasonable and fair allocations. Repayment: 1. State 1llOnies for acquisition of reservoir and dam sites, rights of way, relocation of utilities and highways, and for improve- ments removed or damaged by construction of the project should be non- reimbursable. 2. State funds for recreational improveMents of state-wide inter- est should be non~reimbursable. . 3. Federal funds for flood control, fish and wildlife protection, recreational improvements of nationwide interest, navigation and other items in line with established policy should be non-reimbursable. 4. Federal funds for irrigation should-.be reimbursable, in accord- ance witJi federal,pol.icies then prevailing. -2- -, . .. .. 5. All other funds, including those for power and for domestic and industrial and ir rigation water supplY should be reimbursable with interest. 6. The revenues of the project should be pledged to operation, maintenance and the payment of debt service on reimbursable features of projects. 7. The State should enter into contra ets with water distribut- ing agencies before water is delivered. The contracts. should cover repayment of the costs allocated to the particular agencies, includ- ing debt service. The contracts should include a commitment by the &genciesto provide the works required to make their connections to the Feather River Project or other authorized State water projects. Each such agency should provide distribution works for the delivery of water to its own customers. 8. An agency may satisfy its contractual obligation to the State by taxes levied upon the property wi thin the agency, by the application of any revenue of the agency or by any other sources of income available to the agency. . . 9. The State should have the power to enjoin any person from taking water from the Feather River Project, and other authorized State water projects, without first entering into & contract with the State. -3.... , 'A ~ '3~~ R.ESOLUTION NO.
