such property is not placed in use within twelve months of receipt~the donee,
wi1:b,in 30 days after the expiration of the twelve-month period# sh~ notify the
Department in writing through th.e appropriate State Agency. Title and right
to the. possession of such property not so placed in use w'ithin the above-
mentioned period shall at the option of the Department revert to the United
States of America, .and upon demand the donee shall release such property to
such person as the Department or its designee shall direct.
(2) There shall ~e a period of restriction which will expire after
sum property has been used for the purpose for which acquired for a period
of four years~ ex.cept that th.e period of restriction on motorvehiclea donated
subsequent to June 3~ 1955" will expire after a period of two years of such use.
(3) During the period .of restriction the donee shall notsell# trade"
le.ase# lend# bail, encumb,er". orotherwlse dispose of sueh property or remove
it for uae outside the State without prior written approval of the Department.
Any sale # trade, lease" loan, bailment, encumbrance or other dispOSal of
property# when such action is authorized by the Department, shall he for the
benefit and aecQunt of the United States of America and the net proceeds
thereof shall he received and held in trust for the United states of America
and shall be paid promptly to the Department" except in those instance.s in
which the Department determines that the Government'sadministr.ative costs
in connection with receipt there.of will exceed su.ch net proceeds.
(4) In the event such property is sold, traded" leased# l.oaned"
bailed, encumbered, or otherwise disposed of during the period ()f restriction
without priorapprov:al# the donee at the option of the Department, shall be
liable to the United States of America for the proceeds of the disposal or for
the fair market value of the property at the time of such disposal as determined
by the Department.
(5) If" during the period of restricti.on" property is no longer
suitable" usable or further needed by the donee f.or the purp.ose for whle.h
acquired" the donee shall promptly notify the Department through the st.ate
Agency" and shall. as directed by the Department or State Agen.cy# either
retransfer the prope My to such department or agency of the United States of
America or such other donee as may he designated" or sell the property at
public sale. Such public sale shall be for the benefit andaccotmt of the Uni.ted
States of America and the net pr()ceeds thereof shall be received and held in
trust for the United States of America# and shall be paid promptly to the
Department" except in tllose instances in which the Department determines
that the Government'sadministrative co.st$ in connection with re.ceipt thereof
will exceed such net proceeds.
(6) At the option of the Department, the donee mayabrogate.the
terms and conditions set forth in Paragraphs II and m by payment .of an

(3) In the event any donated property is used during the period of
restriction for any purpose other than that for wp.ich the property was
acquired, without prior written authorization by theDirector~ Office of Civil
and Defense Mobilization, all right, title and interest in and totl1e prope.rty,
at the option of the Dire.ctor# OfUce of Civil'and Defense Mobilization, shall
revert to the United States. of America.
(4) .[)uring the period of regtrict:ion the donee shall not sell~ trade~
lease, lend~ baU#encumher, or otherwise dispose of such property or
remove it for use out.side the State without prior written approval of the
Director~ Office of Civil. and Defense Mobilization.
(5) If, during the period of restriction~ property is no longersuj,t,..
able~ usable or further needed for the purpoae for whichacquire-d,the donee
shall promptly notify the Director, Office of Civil and Defense Mobilization
throngh the State Agency (California Di.s.aster Office} and shall., .asdirected,
by the Director, Office of Civil and Defense Mobilization or State Agency,
either retransJer the property to such depa.rtment or agency of the United
Sta:tesof America. or such other donee as may be designated, or sell the
property at public sale .
(6) In the-event such property issolo.# traded, leased, loaned#
bailed, encumbered, or otherwise disposed of during the period of restrictiQu
without prior appr()\7a1~ the donee~ at the option of the Director~ Office of
Civil and Defense Mobiliz.ation#shall be liable to the United States of America
for the proceed,a of the disposal Or for the fair market value of the property

(7) Property donated for purposes of civil defense reserve stocks
shall he stored in accordance with criteria made and approved hy t;h.e
Director, OfUce of .Civil and Defense Mobilization and maintained in good
operating eandltion by the donee acquiring title to suCh property.
RESOLVED FURTHER that a certified copy of this resolution be given
to the State of California, State Educational Agency for Surplus. Pro~rty. and
that same shall rema~n in full force and effect until written notice to the
contrary is given said Agency.

Honorable Body:
The State of California, California Disaster
Office, Sacramento, California, in their letter of Novem-
ber 19, 19.58, enclosed three (3) copies of a resolution
covering the donation of surplus Federal property having
an original government acquisition cost of $2500 or more.
The purpose of this resolution is to eliminate the necessity
of having to pass a similar resolution with each acquisition
of property having an original cost of $2500 or more.
We are also advised that those jurisdictions who
have not returned this resolution by January 1, 19.59, will
be ineligible to acquire property in this category.
It is recommended that this resolution be adopted,
and that same be signed by Mr. R. J. Furlong, Mayor-Director.
