3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
AUTHORIZING SPECIAL COUNSEL AND THE CITY ATTORNEY TO
4 APPEAL ANY AND ALL ADVERSE PORTIONS OF JUDGMENT RENDERED
IN CASE OF CITY OF VERNON VS. SOUTHERN CALIFORNIA EDISON
5 COMPANY~ SUPERIOR COURT CASE NO. 697670.

THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
8 WHEREAS, judgment in the case of City of Vernon vs. Southern
9 California Edison Company, Superior Court case No. 697670, was entered
10 on June 8, 1959; and
11 WHEREAS, certain portions of said judgment are adverse to the
12 best interests of the City of Vernon, its taxpayers and its consumerS of
13 electrical energy;
14 NOW~ THEREFORE, BE IT RESOLVED:

S.ECTION 1:
That Special Counsel, Darling, Shattuck &
16 Edmonds, and the City Attorney are hereby authorized to appeal from any
17 and all adverse portionS of said judgment mentioned in the recitals hereof~
18 including the requirement that the City of Vernon, as a condition to re-
19 possession of its electrical generating and distribution system, compensate
20 Southern California Edison Company for the additions and betterments
21 ma.de by Edison during the term of its tenancy~ and to appeal from the
22 inadequate equitable payment in the nature of damages awarded by the Court
23 for the reasonable value of Edison's use and occupancy of the system since
24 December 19, 1957,

SECTION 2:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and thereafter the.
same shall be in full force and effect.
