2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
CONCEmmG THE ABANOONMENTOFSEWAGE GAUGING STATIO~S
3 LOCATED IN THE CITY OF LOS ANGELES AT VERNON AVENUE AND
AT 57TH STREET AND IMPOSING CERTAIN CONDITIONS THEREON.

THE CJTY COUNCIL OF THE CITY OF VERNON R.ESOLVES AS FOLLOWS:
WHEREASa on February 25" 1960 the City of Vernon received
a communication from the City Engine.er of the City oJ Los Angeles, dated
the 24 day of February, 1960" requesting that the City Council of the City
of Vernon permit the City of Los Angeles" at Vernon Avenue" to abandon or
remove the sewage gauging station in whole or in part; and
Wl{EREAS" said request was made so that no prejudice to
either City would occur by reason of any settlement of any claimed rights in
the resp,e.ctive sewage system of the other City, and without any prejudice to
system rights of either the City of Los Angeles or the City of Vernon under
that certain action filed in the Superior Court of the State of California, in
and for the County of Los Angeles .entitled City of Los Angeles va. City of
Vernon" being No. 692580 therein; and
WHEl(EAS" the sewagegaugingstationg, which were con-
structed pursuant to the terms of the several contracts between the City
of Los Angeles and the City of Vernon .and the rights and obligations. of the
parties relative to the maintenance and operation of those stations was one
of the s.alvagable elements of the composite contracts between the parties
adjudicated in that certain action for declaratory relief entitled City of
Vernon vs. City of Los Angeles, and being ,No. 558132 in the Superior
Court of the State of California" in and for the County of Los Angeles; and
WHEREAS, by the construction ofa trunk line sewe I' in
Alameda Street southerly fro.m Vernon Avenue by and in connection with the
CountySanitationD:l,strict, the City of Vernon has been .able to divert sewage
originaUng within the City of Vernon and tributary to the Vernon Avenue
sewer .and the 57th Street sewer from the City of Los Angeles sewage system
to the County Sanitation District Number 2 system" all of which makes said
gauging stations obsolete" inoperative and of no use; and

1 WHEREAS, the 5 7th Street sewage gauging station is in the
2 sarnecategory.as that of the gauging station at Vernon Avenue by reason
3 of said diversion of sewage as mentioned herein; and
4 WHEREAS" the City Council of the City of Vernon deterntines
5 it to be. in tb,e b.eat interests of the City of Veroon to agree to the abandonment
6 of said gauging stations praviding certain.limitations are placed thereon;
7 NOW, T$REFORE, BE IT RESOLVED~

.SECTION 1:
That the City of Vernon hereby abandons,
9 rem.i~es." releases and quitclaims to' the City of Los Angeles" all of its
10 right" title and interest" by whatsoever means obtained, in and to the sewage
11 gaugingstatiotlS located in the City of Los Angeles at Vernon Avenue and at
12 57th Street, provided" however" that theabandonment~ remission" releas.e
13 and quit(daim is subJect to' the following provisions:

(a) That said abandonment. remission. releas.e and
15 quitclaim sha.ll be without prejudice to the City of Vernon or to the City of
16 Los Angeles.in subsequent settlements of any claimed rights in the respective
17 sewage systems of the oth.er City" and without prejudice to any rights of
18 either the City of Los Angeles ar the City of Vernon under that certain action
19 filed in the Superior Court af the State of California, in and for the County of
20 Las Angeles entitled City of Los Angeles vs. City of Vernon" .and being>case

(b) That the City of Los Angeles sha.ll pay all costs
23 of whatsoever nature of said abandonment and lor removal.

agree to hold the City of Vernon harmless from any and all liability in
connection with or related to the said abandonment andla.r removal of said
gaugingstatians.
SElCTlON 2.:
That this Resolution be presented to the City
Clerk of the City of Los Angeles with the reques.t that the same be presented
to the City Councilor the City of Los Angeles for approval and that the provi-
sions of this Resolution shall become effective upon receipt by the City of
Vernon of a communication from the City Clerk of the City of Los Angeles

Gentlemen:
By the construotion of a trunkline sewer in
Alameda Street, southerly from Vernon Avenue, your City
was able to divert sewage originating within the City
of Vernon anG. tributary to the Vernon Avenue Sewer,
easterly of Alameda Street from the City of Los 1mgel..
system to County Sanitation Distriot No. 2 system. This
diversion, together with your closing of the conneoting
sewer between the Sanitation Distriot trunkline and the
Los Angeles sewer at Vernon Avenue, eliminated the
necessity of maintaining a gauging station withinthe
City of Los Angeles at Vernon Avenue.
It is requested that the City Council of the
City of Vernon, by resolution, permit Los Angeles to
abandon or remove this gauging station in whole or in
part without preJudiee to either City in subsequent
settlements of any elaimed rights in the respective
sewerage system of the other City, and. without.. preJudiee
to any rights of either Los Angeles or Vernon under that
certain aoticlI'l filed in the Superior CCiHlrt of the State
of California in and. for the County of Los Angeles,
entitled City of Los Angeles v City of Vernon and being
ease No. 692580 therein.
