A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON

A. Section 2107 Funds
A master agreement (Section 2107 .fund agree-
ment) providing for the budgeting and for
the expenditure of gas tax allocation for
city streets shall be executed by the city
and by the department for those cities for which expenditure
of money from the State Highway Fund, as provided in Section
194 of the Streets and Highways Code, has been delegated and
which have established a lISpecial Gas Tax Street Improvement
Fund".
5.01

5.02

tions, or special provisions stated in the master agreement
require additional contractual conditions.
The department will initiate and forward
three copies of the master agreement to
the city. The original and second copy
of the agreement shoul~ be executed in
duplicate by the officers authorized to
execute contracts on behalf of the city. A certified copy
of the resolution of the city council approving the agreem€:it,
together with the original and second copy of the agreement
as executed by the city, should be returned to the department.
After the agreement has been signed by the director or his
delegate, a fully executed copy is returned to the city.

5.07
Cities to

After the city has formulated a tentative
program and prior to submitting a formal
project statement to the district, the city
should confer with or submit to the district
engineer the city's tentative program for
review and comment. Such procedure will
facili tate a mutual understanding of the details 'and financing
of the program apd, in many cases, will expedite approval of the
project statement. vlhen considering a budget item for a stream
crossing or grade separation structure, a ,site review should be
made jointly by a representative of the district engineer, of
the Assistant State Highway Englneer for Bridges, and of the city.
Such a review often may result in a more economically designed
structure. When a mutual understanding has been reached regarding
the city's project statement" the cityshal1 prepare the project
statement and ~ubmit the statement to the district engineer.
Project statements should be prepared on a
bas:ts of the entire estimated apportionment
for the year in addition to previous unexpended
and unbudgeted funds. Should a city wish to
propose an improvement requiring an' expenditure in. excess of the
available funds, it should outline the entire project in the
project statement;, and, if stage. or unit construction is contem-
. plated, state the limits and extent qf work to be 'undertakenwith
available funds. .

If a city for any reason is unable to formu-
late a program, then funds will accumulate
to the city's credit in the State Highway
and will be available for expenditure at any time the

Approval o'f budget for expenditure of the
gas tax allocation to cities may be withheld
by the department if adequate provision has
not been made to serve traffic on streets on which any previous
expenditure of such funds has been made. If improvement of a
city street has been started by stage construction, financed
by the gas tax allocation to cities, it is desirable that a
project be included in the budget each year for that street
until the improvement has reached a stage adequate for the.
t;raffic. Approval may also be withheld if in the opinion of
the department the proposed. expenditure or expenditures are
excessive for the work to be done.
5.12
Use of the gas
tax allocation
upon other
highways and
streets.
Section 200 of the Code permits the city to
use the gas tax allocation to cities for the
improvement of any state or county highway
or other major traffic street, including those
outside the limits of such city. Under certain
circumstances a city may expend the gas tax
allocation for improvement of streets connected with school
premises (Section 203 of the Code).
5.13
Supplemental
project
statements.
Since the estimate of. apportionment for a
fiscal year is an estimated figure at the
time the project statement is prepa~ed, and
since the amounts in the project statement
are estimated costs, it naturallyfollows that the actual
cost of the project and the actual revenue derived will differ
from the amount set up in the project statement. The difference
between the estimate of apportionment and the actual appor-
tionment, as well as the difference between estimated project
costs and actual costs is adjustable in a supplemental budget
or in the next annual budget.

vJhen gas t3.X funds are proposed for use in con-.
junction v.ri th other funds which may become
available on a cooperative basis, the project
statement should show the amounts of the coop-
erative funds proposed and the names of the
cooperative funds. These names may include
city funds, flood control district funds, State
Highway Fund, county funds, railroad funds, ,
railroad grade separation allocation, federal-aid secondary appor-
tionment to counties, federal-aid secondary urban extension alloca-
tion, railroad grade crossing protection appropriation, etc.
5.14

It is not necessary that the cooperative funds proposed,
including city funds, be approved or budgeted by the cooperating
agency before submitting the project statement. This procedure
recognizes that the obligations of both the city and the depart-
ment, under the terms of the master agreement, are contingent upon
the allocations of the necessary funds by the cooperating agencies,
including the allocation of State highway funds for the project by
the California Highway Commission.
In the event the cooperative funds are not allocated or budgeted,
a supplemental project statement may be submitted rebudgeting the
State allocated funds.
The above procedure may be particularly helpful to a city
whereby it may submit its project statement proposing use of city
funds and other funds in cooperation with State allocated funds
before city funds ?re budgeted by the city council for the project.
The project statement, Form MC-18, should be
used for submitting to the department the
budget of proposed expenditure of the State
allocated funds. A sample of the form is
included in the Appendix. An outline of the method of preparing
the project statement follows:
5.15
Use of project
statement forms.
First Sheet. The first sheet of the project statement form
contains spaces for tabulating the surmnaryof
funds budgeted for expenditure and the surmnary of the State
allocated funds available. The signature of the authorized
City official is to be made on this sheet.
Second sheet. The second sheet has. spaces for entering the
amount budgeted for maintenance, other, and
remarks.
Third sheet. The third sheet, headed "Proposed Improvement",
contains space for details of the proposed
improvement 1n regard to project description, total estimated
cost, traffic, right of way, construction estimate, geometric
section and structural section.
Fourth sheet. The fourth sheet, headed "Source of Funds",
contains space for tabulating the source of
~nds for right of way and construction. Also to be shown
is the proposed typical section and any additional remarks.

5.16
Specific
maintenanee.
Should a city lIIish the department to perform
a certain item of maintenance work, such as
painting traffi8 stripes or placing bituminous
surface, the cost of such work should be
included on the second sheet of the project statement form as a
separate item from general maintenance. Specific items of mainte-
nance as above mentioned vIill be designated "Specific Maintenanc,elt
to distinguish from general maintenance including all operations
of a maintenance nature.
It is intended ""hat i.:lle form will be prepared
to include on~y those sheets covering the
class of work proposed. If a city proposes
an improvement project only, then the project
statement need only include the first, third and fourth sheets.
When both maintenance and improvement are proposed, all 'relative
sheets should be included within the first and fourth sheets. A
third and fourth sheet. should be included for each separate sec-.
tion or improvement project. All sheets should then be grouped
together and included with the first and second sheets to form a
complete project statement.
5.17
Assembly
of forms.
The project s'ta"t:lI1en-c should be accompanied
by a resolution of the city council, Form
I.JIC -9, adopting the budget for theexpendi-
ture of. funds allocated under Sections 194
and 2107 of the Streets and Highways Code.
In lieu of the procedure utilizing Form MC-9, Form MC-lO
may be used which incorporates approval of the budget of pro-
posed expenditures in accordance with Section 197 of the Streets
and Highways Code. This form contemplates that the project state-
ment has been submitted by the city engineer or other responsible
official prior to formal approval of the budget by the city council.
The project statement, as approved by the department, should be
presented to the council for adoption and'approval using this form.
No expenditures shall be made for the items shown in the approved
budget until the Form MC-IO resolution is adopted by the city.
5.18
Submittal of
project
statements.
Project statements should be prepared by the city in tripli-
cate and signed by the proper city officers; one copy to be
retained by the city and two copies forwarded to the district
engineer. Should the city desire more than one copy of the
project statement for its files, additional copies can be pr~-
pared for that purpose. '
5.19

or the assistant in his office assigned to
the city cooperative work. If incomplete,
incorrect, or not in accordance with legal

Approval of the project statement is in the form of a
budget approval. Such approval by the department will consist

signature of the official approving the budget for the department.
5.20

'FSTER AGREEMENT
. FOR THE B DGETING AND EXPENDITURE
OF FUNDS ALLOCATED ,ROM THE STATE HIGHWAY FUND TO CITIES
This agreement entered into by and between the City of
Y.~ , hereinafter referred to
as the city"and the State Department of Public Works,
Division of Highways, hereinafter referred to as the
department,
WITNESSETH
WHEREAS, Sections 194 and 2107 of the Streets and
Highways Code provide for allocation and expenditure with1n
cities of amounts transferred to the State Highl'fayFund
from the Highway Users Tax Fund; and
WHEREAS, Section 195 of the Streets and Highways Code
provides that at least three-fifths of the money allocated
under the provisions of Section 194 shall be expended for
the oonstruction of streets included in the system of
major city streets within each city, and the balance tor
maintenance; and
WHEREAS, in accordance with the requirements. of Section
196 of. the Streets and. Highways Code, the city has set up by
. ...... ..~ ..
a Speeia1 Gas Tax Street Improvement Fund in which shall, be
deposited all amounts allocated pursuant to Section 194 and
received by the eity; and
NOW, THEREFO~, in consideration of the premises and of
the several promises to be faithfully performed by eaoh as.
hereinafter se.t forth, the city and the department do hereby
mutually agree as follows:

ARTICLE I. BUDGET PROVISIONS
A budget showing the estimated expenditure of funds, to
be allocated.to the city by the State, shall be submitted
annually by the city for approval by-the department as pro-
vided for under Section 197cif this Code.
A budget approval by the department shall consist of an
acknowledgment of the submittal of a budget by the city, a
statement of the funds available for budgeted expenditures,
a statement of estimated expenditures by projects, and the
signature of the officer approving the budget for the
department.
The amount bUdgeted tor a project may be revised, or
other proj.ects added, by submission by the city of a supple-
mental bUdget for approval by the department.
The annual revenue and the amounts provided for the
projects listed in an approved budget are estimated <aIIlounts.
In the event that'the actual revenue or the actual eostot
the projeots differ from estimated amounts, the approved
budget <may be amended only by a supplemental budget.
When a budget proposes expenditure of other funCis for a
prOject in conjunction with the.expanditure .ofstatealloca.ted
funds, the project statement shall shOW the amounts and names
of .the cooperativetunds including city funds, it any. . It is
agreed that the cooperativeagencies,includ1ng the .city,
need not approve. or budget .such cooperative funds before the
'ci:l;y submits its budget tor approval oithe department.
When a. project, included inabudgetsubmitted by the
city and approved by the department, .is proposed to be jointly
financed with Statealloeated funds, other cooperative funds,
if any, and with an allocation of State highway tundsby the
CalifomiaHighwayCommission, it is agreed that the obligations
o.f both the city and the department under this agreement are
contine;e.nt upon the allocation of the, necessary funds for the
proj ectbY the Callfornla Highway Commisslon ancl upon the
budgeting 'of the necessary cooperative funds. by the c1ty or
by the othercooperat1 ve agencles.,
In the, event the cooperat1ve funds are not allocated or
budgeted" the olty may submit,asupple~ental bUdget to the
department for approval for.rebudget1ng the state allocated
funds.
Upon approval by,the department, the budget as submitted
by the legislative body of the city shall become a part of

this agreement and all work and expenditures of the allo~ated
funds are to be made in accordance with the terms of the
approved budget.s, and of this agreement and any supplements
thereof. .
ARTICLE II. DELEGATION OF EXPENDITURE
The department hereby delegates to the city theexp~nd...

the approved budget,. except for those projects notedin~l1Ch
budget to be. accomplished by the department in behalf otthe
city.
ARTICLE III. MAINTENANCE
Unless otherwise authorized in writing by the depal"tJnent,
all streets will. be maintained by or under the direct supeI"'"

ARTICLE'. IV. RIGHT OF WAY

ARTIOLE V. SURVEYS AND PLANS

the department as noted on the approved budget.

ARTICLE VI. CONSTRUCTION WORK BY CITY
Construction shall be as defined in Section 29 of the
Streets and Highways Code, as modified by Section 195 of
the Code.
The city will construct or cause to be constructed by
others, in accordance with approved plans, specifications
and estimates to be submitted therefor, the improvements
described in the approved budget.
Any significant changes made in the approved plans or
specifications will require department approval, either
prior to making such changes, or at the time the final
report is submitted in those cases where advance approval
cannot be obtained without costly delay to the work, or
where through inadvertence advance approval has not been
obtained. The department's approval, before or after changes
are made, will establish the eligibility of such changes
for financing with allocated funds.
The construction work described in an approved budget
shall be performed by contract unless the performance thereof
by day labor is approved by the department.
The work shal1 be done to the satisfaction of the depart-
ment and is subject at all times to inspection and approval
by the authorized representatives of the department.
ARTICLE VII. CONSTRUCTION WORK BY DEPARTMENT
Construction shall be as defined in Section 29 of the
Streets and Highways Code, as modified by Section 195 of
the Code.
The departmentwill construct or cause to be constructed
the improvements described in an approved budget as work by
department in accordance with approved plans, specifications
and estimates therefor.
Any minor changes in the approved plans and specifications
due to unforeseen contingencies or made desirable by conditions
developing during the progress of the work may be made by the
department.
The work will be performed by contract or by State forces
as may be, in the opinion of the department, for the best
interests of the city and the department.

Indirect charges for engineering overhead will be
assessed in accordance with Division of Highways' standard
practices for any work done by State forces.
ARTICLE VIII. VEHICULAR PARKING
It is agreed that in accordance with the provisions
of Section 22502 of the Vehiole Code, the oity, will permit
parallel parking only, within the limits of each of the
construotion projeots described in an approved budget. It
is agreed that the provisions of the Vehicle Code permitting
angle parking by ordinance are not applioable within the
limits of the aforementioned work. It is further agreed
that if a currently effective ordinance permits angle park-
ing within the limits of suoh work, the ordinance shall be
repealed and certified copies of this action shall be
transmitted with the final report.
ARTICLE IX. FUNDS
Funds to defray the cost of the work described in an
approved budget will be paid quarterly as revenues for
expenditure in cities are received in the State Highway Fund.
Payment of these 'funds to the city will be based upon
an approved annual budget. Such payment to the city will
be reduced by any amounts remaining unexpended in the city's
Special Gas Tax Street Improvement Fund attributable to
completed projects covered by these funds, or for work to
be performed by the department, or for contingency projects
as shown on the approved budget.
The construction cost, including construction engineer-
ing, of the traffic signals and safety lighting to be installed
at an intersection ofa major city street with a State highway
will be financed jointly by the city and the department in
the same ratio as the number of intersecting roads under each
jurisdiction bears to the total number of roads entering the
intersection. Unless otherwise agreed to in writing, the
agency designated in the approved budget to prepare the plans,
specifications and estimate will bear the entire cost of such
preparation.
All revenue received from rentals or sales of real
property or equipment purchased with gas tax funds, and all
interest earned from investments of monies in the city'S
Special Gas Tax Street Improvement Fund shall be credited to
the city's Special Gas Tax Street Improvement Fund.

The amount provided for the projects listed in an
approved budget must not be exceeded, and no monies may be
expended by the city from the Special Gas Tax Street
Improvement Fund except for the projects listed in the budget
without submission and, approval of a supplemental budget.
All funds allocated under the provisions of Section
2107 of the Streets and Highways Code in excess of such
funds budgeted for expenditure will accumulate for future
bUdgeting and expenditure.
ARTICLE X. FINAL REPORTS
Within ninety days after expiration of each fiscal .
year, the city shall submit to the department an annual
report of all expenditures from the Special Gas Tax Street
Improvement Fund for maintenance.
Within the time speoified in Section 201 of the Streets
and Highways Code, the city shall submit a final report of
expenditUres made from the Special Gas Tax Street Improvement
Fund for acquisition of rights of way or for construction.
The department shall, within the time specified, submit a
final report to .the city ot expenditures made by the depart-
ment in behalf of the .city.
Annual reports of maintenance expenditures, and final
reports Of expenditures for rights of way and oonstructlon,
shall be made on forms as specified by the department.
ARTICLE XI. SUPPLEMENTS TO AGREEMENT
Supplements to this agreement may be executed to provide
for other matters not covered "herein.
ARTICLE XII. OTHER STATE HIGHWAY FUNDS ALLOCATED TO CITIES
It is agreed that this master agreement covers the budget-
ing and expenditure of other funds for construction that may
be transferred to and allocated from the State Highway Fund to
cities, provided such funds are required by statutes to be
expended in accorc1anoewith the provisions of Sections 194 to
202, inclusive, of the Streets and Highways Code. .

.The procedure for the budgetlng of gas tax funds
is being revised. The yearly agreements are being
replaced with,a master agreement and will be handled
in ,the 'same manner as the master agreement we have
been using/for ~our engineering ,funds.
After 'execution by the governing body of the
city, the enclosed original and two copies marked
"duplicate" are to be returned to this 01'1>ice 1'01'
execution by the Department. The third copy is to be
retained by you1'or your t'iles. A certified copy of
th~ cityls resolution approving this master agreement
is to ,be attached to the original and the two marked
copies of the agreement. It is requested that this
agreement be executed by the city betore March 1, 1961.
Upon execution of this master agreement, project state-
ments play be submitted in the u:sual manner covering the
pr~posed street~rovements and/or maintenance.
All project statements initiated by a city will
be processed under the procedure as described in
Chapter v, "Agreementsand Project Statementstl, re-
vised, 'of the City and Cooperative projects Manual
of'Instructions (copy attached).
On cooperative projects with the Department where
special provisions a.re to be agreed upon between both
parties, it will be necessary to provide a supplemental
agreement. These supplemental agreements will bear
successive S- .'"' , numbers which will state the
special provisions to be agreed upon, including those
special provisions cited in previous executed memorandums
of agreement which are to remain in effect for continuing
projects for which additional funds are bUdgeted. The
supplemental agreements will be initiated by the Department.

Approval of the city's budget by the Department will
be shown on the form titled "Budget Approval Expenditure
of State A1100ated (5/8 cents) Fund"a which will also
bear a statement of funds available.. a tabulation of approved
expenditures by projects, and the schedule of payment of
funds to the city. Expenditures for projects requiring
execution of a supplemental agreement will be approved in
the budget approval, but expenditures for such projects
shall not be made until after execution by the City and
the Department of the supplemental agreement.
Resolutions will be required for each project
statement submitted by the City, either at the time of
submission or after the budget approval has been received.
Also supplemental agreements will require council action.
Under separate cover we are forwarding revised pro-
ject statement forms upon which the city will show their
proposed budget. upon receipt of these forms; please destroy
all forms now on hand as they will be obsolete.
