THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: WHEREAS$ the City Council of the City of Vernon$ said City being an industrial city and contiguous to Cheli Air Force Base, finds that the industrial development of said base will he heneficial to the residents and tax payers of the southeast area of Los Angeles; and WHEREAS, H. R. 2184 provides for the return of said Air Force Base to the Chanslor- Western Oil and Development Company, an affiliate of the Atchison$ Topeka & Santa Fe Railway Company; and WHEREAS, said companies have established within the City of Vernon industrial developments of the same type projected for said Air Force Base; and WHEREAS, such industrial developments have provided tax basis and employment for numerous residents of this area; NOW, THEREFO.RE$ BE IT RESOLVED: SECTION 1: The City of Vernon hereby goes on record as supporting H. R. 2184 providing for the return of that portion of Cheli Air Force Base declared surplus to the government's needs to Chanslor-Western Oil and Development Company . SECTION 2: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. Mr. KUCHEL. Mr. President, I intro- duce for appropriate reference a bill to authorize the Administrator of General Services to enter into direct negotiation with the Chanslor Western Oil & Devel- opment Co. for the sale at full fair mar- ket value of approximately 50 acres of land located at the Cheli Air Force Sta- tion in Bell, Calif., which has been de- clared surplus to the needs of the Government. Mr. President, the Cheli Air Force De- pot consists of 388 acres which were orig- inally donated to the Government by the predecessor corporation of Chanslor- Western, then known as the Chanslor- Canfield Midway Oil Co., a subsidiary of the Atchison, Topeka & Santa Fe Rail- way Co. This subsidiary has had a splendid record of industrial develop- ment in the Los Angeles area. During the Second World War, when the Gov- ernment was in need of land on which to erect an Air Corps supply depot, the Army Air Corps approached Chanslor- Canfield and, early in 1943, an original parcel of 211 acres was conveyed to the U.S. Government for the consideration of $1. A second parcel of 177 acres of adjacent land was deeded to the Govern- ment on July 10, 1944, in order to meet the urgent need to expand this depot. Again the consideration was $1. At the time of the transfer, Chanslor- Canfield asked the Division Engineer of the War Department who was handling the conveyance for return of the property at the same consideration of $1 when it was no longcr necessary for the needs of the Government. The War Depart- ment informed Chanslor-Canfield that they had no statutory authority by which the Government could relinquish the land acquired by such a donation. Stat- utory authority was also laCking for the disposal of any improvements which the Government might make on the prop- erty. Congress, in passing the Surplus Property Act of 1944, recognized the equity of permitting the donor to reac- quire property when it was no longer needed by the Government. Unfortu- nately, this law expired on December 13, 1949. At that time there were no indi- cations that the Government would de- clare the depot as surplus and unneeded for defense purposes. Se12 ate T'he first indication that such land would be declared surplus came in 1960. Thus, on March 30, 1961, I introduced S. 1497 which would authoriz'C rceonvey- ance to the former owner of that portion of the property which was declared sur- plus to the needs of the United states in accordance \vith existing policy. A hearing was held on this bill by a SpeCial Subcommittee 0f the Senate Committee on Government Operations consisting of Senators MUSKIE and JAVITS. This hear- ing was held on August 22, 1961. At that hearing I presented various resolutions from many groups in the area who agreed with me that, if this land were to become surplus to the needs of the Government, the reconveyance of the land to Chanslor Western Oil & Develop- ment Co. was in the public interest since it would be used as a site for additional industrial development and, thus, pro- vide needed employment opportunities then estimated at between 7,500 and 10,000 new jobs for the residents of Bell and the many surrounding communities. In addition, there would be great added tax benefits to the local taxing districts in whose jurisdictions the property lay as well as to the city of Bell. At that time the Montebello Unified School District sought part--approxi~ mately 78 acres-of this property on which to construct a junior college and had filed an application in accordance with existing procedures with the Gen- eral Services Administration. By reso- lution approved last week by the board of education of the Montebello Unified School District, this application has been withdrawn effective July 19, 1963. Mr. President, a telegram pertaining to this action of the board is as follows: The following resolution passed by the board of education, MontebelJo Unified School District last night: "Now, therefore, be it "Resolved, That the MontcbelJo Unified School District withdraw its pending appll- cation for a Federal grant of land at the Chell Air Force Station, Bell, Calif., ef- fective date of withdrawal July 19, 1963." Recently the General Services Admin- istration has announced that only ap- proximately 50 acres of the 388 acres will be released for disposal since the GSA has decided to utilize the improved portion of this surplus depot as a re- 'gional supply center for southern Cali- fornia. Thus, the legislation which I have today introduced pertains to the 50 acres which were originally donated by the Santa Fe subsidiary and which lies east of Eastern Avenue in the city of Bell. Kuchel United states Senator Before Special Subcommittee on S. 1497 Of Senate Committee on Government Operations August 22, 1961 Mr. Chairman, Senator Javits, I am grateful for your courtesy in holding a hearing on S. 1497, a bill which I introduced on March 30, 1961, to authorize the reconveyance of certain surplus property at the Cheli Air Force Depot in Bell, California, to the original conveyor. It the Surplus Property Act of 1944 (P.L. 78-457) were stilI law, there would be no need for this hearing. Under that law which expired in 1949, the donors of what was then ageicu1tural property could reacquire their property on the same terms as they conveyed it with the exception of payment for the fair value of the improvements which had been made after their donation of it. However, this law has expired. More basic are the equities of the present case and thus in order to provide for equitable treatment to the donor of the land used for the Cheli Air Force Depot, I have introduced S. 1497. The area we are discussing consists of two parcels totaling approximatelY 388 undeveloped acres which were donated for a total consideration of $2 to the Federal Government during 1943 and 1944 for the use of the Army Air Corps as a supply depot. This land was a portion of a larger tract owned by the Chanslor-Canfield Midway Oil Company, now known as ~he Chanslor- Western Oil and Development Company, a subsidiary of The Atchison~ - 2 ... Topeka and Santa. Fe Railway Company. Mr. Robert D. Lutton, the President of the subsidiary will detail the correspondence relating to the original transaction, the attempt of the company to have a clause inserted to provide for a return of the property once the Government had completed its use of it, the contacts between his company and the Air Force prior to the expiration of the Surplus Property Act of 1944, and the present development plans of his firm in relation to this area. I carefully examined all of these factors before introducing S. 1497, and I am completely satisfied as to the equity of the Chanslor-Western 011 and Development Company's case and the need for a legislative remedy in this matter. Besides the fundamental equities involved, I am anxious to see that all of the property which is not retained for various Federal and other public purposes in accordance with existing law is returned to the tax rolls so that the citizens of Bell, a long- established residential community, may benefit from the industrial expansion which is sure to take place. Cheli property is situated in the heart of the Santa Fe development known as the Central Manu- facturing District Complex. The list of firms which are established there is truly impressive. Planned industrial growth sim11ar to that already in the area will mean increased employment opportunities for the residents of more than a dozen communities in the Southeastern Los Angeles area. It will mean work for those who will operate the plants to be built there. It will mean work for those who haul goods to and from the area by rail and truck. There is widespread community support for this legislation. During the last few months, I have received resolutions supporting - 3 - the return of the Cheli Air Force Depot property to the original conveyors under the principles established in the Surplus Property Act of 1944 from numerous civic, business, labor, and veterans organizations as well as from many city councils. Not only have the city councils of Bell, Downey, Huntington Park, Lynwood, Maywood, Montebello~ Pico Rivera, South Gate, and Vernon endorsed the return of this property to the original donors, but so has the Los Angeles County Division of the League of California Cities in their meeting on June 1, 1961. Similar approval has been registered by the Los Angeles County Federation of Labor, AFL-CIO, the Los Angeles Building and Construction Trades Council, the Maywood Lodge No. 979 of the Brotherhood of Locomotive Firemen and Enginemen, Local 243 of the Switchmen's Union of North America, and Chrysler Local 230 of the UAW, AFt-CIO. Besides the Los Angeles Chamber of Commerce, the Greater East Los Angeles Chamber of Commerce, and the Industrial Council of the City of Commerce, the fol10wing Chambers of Commerce have likewise sanctioned this action: Bel1, Downey, Huntington Park, Maywood, Montebello, and Vernon. Civic groups voicing approval include the Bell-Cudahy Democratic Club, the Uptown Huntington Park Democratic Club, East Los Angeles Merchant's Association, Los Angeles County Council of the Veterans of Foreign Wars, John Henry Carroll Post No. 2325 of the VFW, and the Wm. Chas. Orr, Jr. Bell Post 120 of the American Legion. In addition, such great newspapers as the Los Angeles Mirror, on April 12, 1961, and the Los Angeles Herald Express, on June 26, 1961~ editorialized in favor of this reconveyance. - 4 - $eldom in my experience in public office have I found an area so united on the basic purpose of a 1egislative proposal such as this. I have previously noted the favorable support for S. 1497 from the Los Angeles Building and Construction Trades Council. Yesterday, Mr. J. J. Christian, Secretary of that Council, furnished me with a detailed statement as to the reasons his group, which represents thousands of workers throughout Los Angeles County, took the action that they did. Mr. Chairn~n, I would like to have Mr. Christian's statement included as a part of the record of this hearing. Based on his Council1s study of the data avai1able for the comparable properties in the area surrounding the Cheli property, Mr. Christian notes that the Council: ". . . would forecast a probable construction expenditure of $120,000 per acre with approximately one-half or $60,000 per acre representing a construction payroll for our membership. IIAssuming the surplus property available for indus- trial development after Government retentions would be in the neighborhood of 275 acres, this would produce a construction value of $33,000,000 and a construction payroll of approximately $17,500,000 exclusive of streets and utilities. The Los Angeles Building and Construction Trades Council goes on to state their understanding of the equities involved in terms of the original transaction and the actual tonnage carried to and from the Chell Depot. They believe Santa Fe will develop the area in the same ~manner that they have developed the surrounding property "in contrast to a possibly long drawn out or haphazard - 5 - development if the property were acquired by persons whose interest might best be served by holding the property off the market in order to get the best possible price for the property.1I The Council sees economic opportunity in not only building factories but in con- structing the homes that will house the workers who will operate them, Under the bill, not all of the 388 acres will be available for return to the original donors. Much of the land will be with- held for use by the Federal Government. Two local governmental bodies have expressed an interest in attaining a portion of this land for various public purposes. In order to protect them, I originally drafted section 3 of S. 1497 to assure protection for their interests. I am informed that the Administrator of the General Services Administration can make the necessary deterndnations in accordance with existing law and thus I ask that section 3 of S. 1497 be revised as follows: Beginning with line 22, page 3, strike out all to and including line 20, page 4, and insert in lieu thereof the following: Sec. 3. Nctwithstanding the foregoing provisions of this Act, the Administrator may withhold from the land authorized to be conveyed by the first section of this Act an area of land (designated by him) not to exceed 88 acres for disposition pursuant to section 203k(l) of the Federal Property and Administrative Services Act of 1949, as amended (40 U.S.C. 484(k)(I) upon applica- tions made before July 1, 1961. Any portion of the land so withheld. which is not so disposed of under that section within one year after the date of enactment of this Act shall be disposed of in accordance with the provisions of sections 1 and 2 of this Act. ~ , ,t - 6 - Mr. Chairman, this language would protect the interests of the governmental units who have presently applied. It would permit the GSA Administrator to decide on the validity of their applications in accordance with the present criteria established by law and the applicable regulations.
