2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON URGING
THE STATE LEGISLATURE TO ADOPT LEGISLATION AUTHORIZING LOCAL
3 CONTROL OF GAMBLING.
4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
5 WHEREAS~ present State Laws are inadequate to controll or inade-
6 quate or so vague as to render control of gambling not within power of local
7 jurisdiction; and"
8 WHEREAS~ gambling in Los Angeles County has become a major
9 police problem; and~
10 WHEREAS~ due to the uncertainty of State Law~ local Police
11 Departments are powerless to curb gambling.
12 NOW~ THEREFOREI BE IT RESOLVED:

SECTION 1:
That the City Council of the City of Vernon does
14 hereby urge the immediate passage of legislation clearly impowering local
15 jurisdiction to control or prohibit gambling.

SECTION 2:
The City Clerk of the City of Vernon shall certify
17 to the passage of this Resolution~ and thereupon and thereafter the same shall
18 be in full force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA URGING THE STATE LEGISLATURE TO
ADOPT LEGISLATION CLEARLY AUTHORIZING LOCAL
CONTROL OF GAMBLING.
WHEREAS, by judicial determination it appears that in
adopting Penal Code Section 330 that the State has preempted the
field in regard to the regulation of certain card gambling games,
thus vitiating local legislation in the field, and
WHEREAS, State legislation is inadequate to control
gambling in areas of large concentrations of population, and
WHEREAS, the State Legislature has heretofore recognized
this inadequacy by virtue of Penal Code Section 337s(e} insofar as
State legislation applies to draw poker, including low-ball poker,
which subsection is quoted in part as follows:
II (e) The Legislature finds that in counties with
a large, concentrated population, problems incident
to the playing of draw poker are, in part, qualita-
tively, as well as quantitatively, different from
the problems in smaller counties."

WHEREAS, there has been a sudden influx in Los Angeles
County of card gambling games not mentioned by Penal Code Section
330, and particularly the game of panguingui, and
WHEREAS, said card gambling games not proscribed by
Penal Code Section 330, and particularly the game of panguingui,
have caused a substantial police problem in several cities in Los
Angeles County, and particularly Long Beach, Culver City, and
Santa Monica

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the State Legislature be and it is hereby
urged to pass, as soon as practicable, and early in the 1965 ses-
sion of the legislature, legislation specifically authorizing local
ordinances to control card gambling games and that the Legislature
clearly indicate that by the adoption of Penal Code Section 330 it
did not intend to preempt the field.
SECTION 2. The City Clerk is directed to send a certified
copy of this resolution to each member of the legislature, to the
Governor, and to the Attorney General of the State of California.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter the same shall be
in full force and effect.

ests seeking,to open card rooms for the purpose of playing the card game of

WHEREAS, said gambling interests have based their right to operate
panguingui card games on the theory that 'Section 330 of the Penal Code of the
State of California, which prohibits the playing of certain specified garnesof
chance, does not specifically prohibit the game of panguinguf, and they further
t:laim that since the State law preempts the field .of legislation on this su~ject,

4th resolution of the Vernon City Council pertaining to State
gambling laws.
I have assigned an investigation of the adequacy of our
State statutes and a study of Penal Code Section 330 to the
Assembly Committee on Governmental Efficiency. Assemblyman
Lester A. McMillan, Committee Chairman, has assured me that
thorough hearings will be conducted. Hearings are set to open at
10:00 A. M. August 21st in Room 5, Board of Education Building,
1723 Fourth Street, Santa Monica.
I am sending you copies of the news release announcing
the investigation. I have asked Assemblyman McMillan to advise
you of the time and place of future hearings.
I am pleased that the Vernon City Council concurs in
recognizing the need for an investigation of our gambling laws.

Assembly Speaker Jesse M. Unruh today authorized a
legislative investigation of the adequacy of State statutes governing gambling
and games of chance.
Assemblymen Lester A. McMillan and Robert S. Stevens of
Los Angeles ancllaw enforcen'i.ent officials of Long Beach, Santa Monica. and
Culver City requested the investigation which Unruh has assigned to McMillan's
Assembly Committee on Governmental Efficiency and Economy.

The Supreme Court was petitioned for a writ of habeas corpus
following arrests made in the City of Long Beach for violation of the local
gambling ordinance. According to Long Beach Prosecutor James T. Starr,

the field of gambling to the exclusion of local governing bodies. I!
Santa Monica and Culver City also have reported law enforcement
difficulties involving the playing of pangUi~ithin their city limits. Thirty-

NOTICE OF HEARING
Assemblyman Lester A. McMillan, Chairman of the Assembly
Interim Committee on Governmental Efficiency and Economy, today
announced the Subcommittee on Gambling and Games of Chance
will hold a hearing starting at 10 a.m. on Friday, August 21, 1964,
in Room 5 of the Board of Education Building at 1723 Fourth Street
in the City of Santa Monica.
This subcommittee has recently been organized for the
purpose of inquiring into the operations of so-cal1ed Panguingue
Parlors in California. Legislation will be considered in regard
to this problem.
Members of the subcommittee are Assemblyman McMillan,
Chairman, of Culver C;lty and Los Angeleo, and Assemblyman Joseph
Kennick of Long Beach, Assemblyman John Knox of Richmond,
Assemblyman Robert Stevens of Santa Monica, and Assemblyman
James Whetmore of Garden Grove.

Vernon concerning local control of gambling.
I agree with you that local communities should be able to
adopt ordinances controlling gambling within their jurisdic-
tion. I will support legislation which will allow this.
You might be interested in knowing that the Senate Fact
Finding Committee on Local Government will be holding
hearings in Los Angeles on the subject of state pre-emption
of local functions. I hope that these meetings will lead
to clarifying legislation in the area of pre-emption.
