That the property hereinabove referred to and described is 6 suitable for the purpose for which the petitioner requesting such variance 7 intends to use it" to wit: for the manufacture and! or mixing and storage of 8 paints.. varnishes.. lacquers" resins and volatile solvents. 9 2. That unnecessary hardship would be put upon petitioner as the 10 owner of said property in the use of said property if his request for a variance 11 was denied. 12 3. That results inconsistent with the general purpose of Ordinance 13 No. 752 would result if the request for such variance was denied. 14 4. That there are exceptional or extraordinary circumstances or 15 conditions applicable to the property involved~ or to the intended use of the 16 property~ that do not apply generally to the property or class of uses in the 17 same district or zone. 18 5. That such variance is necessary for the preservation and en- 19 joyment of a substantial property right of the petitioner. 20 6. That the granting of such variance will not be materially 21 detrimental to the public welfare~ or injurious to the property or improvements 22 in such zone or district in whi911 the property is located. 23 7. The variance covering the property hereinabove described is 24 granted for the manufacture and! or mixing and storage of paints~ varnishes~ 25 lacquersl resins and volatile solventsl subject to the following conditions~ whb ~ 26 the City Council deems proper to preserve the public health~ safety" conveni- 27 ence.. welfare" and the general intent and purpose of the zoning ordinance.. as amended: A. The Grantee of the variance shall comply with all City" County and State laws applicable to said use now in force or here- after enacted. B. The grounds of this petition, and the facts relied upon by the petitioner in .support of its petition for variance are as follows: 1. Petitioner is the owner of, and has been maintaining a plant and facilities for the manufacture and/or mixing and storage of paints, varnishes, lacquers, resins and volatile solvents and associated products on portions of the parcel heretofore described in the petition. 2. Petitioner, in the manufacture of its products, uses machinery customarily utilized in the trade; i.e., roller mills, ball mills, dispersers, agitators, mixers and canning equipment. 3. Petitioner, in addition to the manufacture of its products, maintains on the properties .heretofore described, warehouse facilities and a retail/ wholesale outlet. - 4. The demand for petitioner's products has been such to cause certain addi- tional manufacturing space to be erected to satisfy such demand so as to compete in this highly competitive field. 5. Petitioner has used portions of the parcels contained in this petition for purposes similar to those outlined in the foregoing since 1935. 6. The area in which the parcel of land particularly described is situated is in the main developed to heavy industrial uses, is adjacent to a major thoroughfare, and is adjacent to streets used for the parking of vehicles of employees of the surrounding industrial establishments.. 7. The requested variance is necessary for the, preservation of a substantial property right of petitioner, in that it is the property owner, bears a substantial volume of taxes thereon, is the employer of 160 persons and urgently requires such suggested use of said property under variance in order to satisfy the demand for its products and to preserve efficiency and economy in the operation of its business. 8. The granting of such variance will not be materially detrimental or indeed detrimental at all to the public welfare or in any way injurious to the property or improvements thereon in the surrounding area.
