Resolution No. 2752 CD ~It) 28 z zO II o ..0 II )(>z~Ol ~ 011I0" ~ .. 29 ..o.ZZ"Zir o O:lXco:O ~tie~~~g 30 ;;:1-~~~::i.J ~z>)o:z:ce~ III!:!:~U ~ 31 Uuu 0 i .. ~ · 0 a > g Z ... ::: 32 > 1 RESOLUTION NO. 2752 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANT- ING A ZONING VARIANCE FOR UNIVERSITY REALTY COMPANY. 3 4 5 6 7 S 9 10 11 12 13 14 15 16 17 IS 19 20 21 22 23 24 25 26 27 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: WHEREAS~ an application for a zoning variance was filed with the City Clerk on or about the 8th day of December ~ 1964~ by UNIVERSITY REALTY COMPANY~a Texas corporation~ for a variance under the provisions of Ordinance No. 752 on that certain parcel of land situated in the City of Vernon# and more particularly described as follows~ to wit: Those portions of Lot 5 and Lot 6 of the 500-acre tract of the Los Angeles Fruit Land Association as shown on map thereof record- ed in Book 3~ at pages 156 and 157~ of Miscellaneous Records in the Office of the County Recorder of said Los Angeles County~ more particularly described as follows: Beginning at the Southeasterly corner of that certain property conveyed to the Grabler Manufacturing Company by deed recorded as document No. 941 of May 22" 1952.. in Book 38939~ at page 305~ of Official Records in the Office of the County Recorder of said Los Angeles County~ which Southeasterly corner is a point in the Northerly line of that certain strip of land (now known as 44th Street) 80 feet in width., as con- veyed to the City of Vernon by the deed recorded as document No. 1300 of August 18~ 1949~ in Book 30806.. at page 333.. of said Official Records~ said point lying North 88050' 17" East 621. 24 feet along said Northerly street line and its Westerly prolongation from the Easterly line of Boyle Avenue.. 50 feet in width; thence from said point of beginning along said Northerly street line North 880 50' 17" East 173.47 feet to a line which is parallel with and distant Westerly 347.20 feet at right angles from the Westerly line of that cer- tain property described in the deed to U. S. Growers and Shippers Service.. Inc... recorded as document No. 1118 of May 25.. 1950~ in Book 33224~ at page 350~ of said Official Records; thence along said parallel line North 10 09' 43" West 247.79 feet to a point which lies South 10 09' 43 II East 4.00 feet from the Southerly line of that certain railway right-of-way described as Parcel No. 6 in the Deed to Central Manufacturing District.. Inc. ~ recorded as document No. 2523 of September 23# 1948., in Book 28320.. at page 352., of said Official Records; thence North 8,f) 54' 25" West 37.22 feet to a point in said Southerly right-of-way 1ine~ which point lies South 88055' 22" West 327.19 feet along said Southerly right of way line from a Northwesterly corner of said U. S. Growers and Shippers Service.. WHEREAS~ the application for variance was regularly set for hear ing before the City Council on the 16th day of February~ 1965., at the hour of 1:15 o'clock P.M... in the Council Chambers of the City Hall.. located at 4305 Santa Fe Avenue.. in the City of Vernon.. California; and WHEREAS.. all notices as required under said Ordinance were regularly and duly given of the time and place of said hearing.. and the City Council having heard the matter on the 16th day of February.. 1965~ at the hour of 1:15 o'clock P.M. in the Council Chambers of the City Council~ and all evidence was heard from all persons interested in effecting said variance and also from all persons protesting the same~ and the City Council having heard all the evidence and statements of said persons.. and being fully informed in the premises~ the matter was submitted for decision.. and on February 16~ 1965.. the Council considered the application and made the following. findings and decision: NOW., THEREFORE~ the City Council of the City of Vernon does find as follows: 1. That the property hereinabove referred to and described is 20 suitable for the purpose for which the petitioner requesting such variance 21 intends to use it.. to wit: for the erection of a structure for use as a freezer~ 22 cold storage facility and meat packing facility and to convert the existing 20 23 thousand square foot structure on the entire parcel to cold storage and freezer 24 use. 25 26 27 2. That unnecessary hardship would be put upon petitioner as the owner of said property in the use of said property if his request for a variance was denied. 3. That results inconsistent with the general purpose of Ordinanc No. 752 would result if the request for such variance was denied. 4. That the granting of such variance will not be materially 5 detrimental to the public welfare.. or injurious to the property or improvements 6 in such zone or district in which the property is located. 7 7. The variance covering the property hereinabove described is 8 granted for the erection of a structure for use as a freezer., cold storage 9 facility and meat packing facility and to convert the existing 20 thousand square 10 foot structure on the entire parcel to cold storage and freezer use. subject to 11 the following conditions.. which the City Council deems proper to preserve the 12 public health~ safety~ convenience.. welfare~ and the general intent and purpose 13 of the zoning ordinance~ as amended: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 A. The Grantee of the variance shall comply with all City.. County and State laws applicable to said use now in force or here- after enacted. B. The property shall be sewered and drainage controlled in accordance with the requirements of the Vernon City Council; no condition detrimental to the public health or safety shall result from the use granted under this variance. C. No nuisance shall be permitted on said premises~ or result from the granted use. A copy of this Resolution is to be mailed to the applicant for said variance. The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
