2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING
CONTRACT NO. 321 FOR HEATER REMIXING AND ASPHALT RESURFACING OF
',3 CERTAIN STREETS AND DIRECTING THE GIVING OF NOTICE INVITING
SEALED PROPOSALS OR BIDS IN ACCORDANCE WITH CONTRACT NO. 321 OF
4 THE CITY. OF VERNON.
5 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
6 WHEREAS, there has been presented to the City Council of
7 the City of Vernon Contract No. 321, providing for heater remixing
8 and asphalt resurfacing of certain streets in the City of Vernon,
9 and
10 WHEREAS, the City Council of the City of Vernon has deter-
11 mined that it is in the best interests of the City that said
12 contract be awarded in accordance with the applicable State laws,
13 NOW, THEREFORE, BE IT RESOLVED:

SECTIONl: That Contract No. 321, having been prepared
15 in accordance with Plan No. P-1780, is hereby approved by the City
16 Council of the City of Vernon.

SECTION 2: That the City Clerk of the City of Vernon is
18 hereby directed to file in his office in the City Hall of the City
19 of Vernon a copy of Contract No. 321.
SECTION 3: That the City Clerk of the City of Vernon is
20
21 hereby directed to give notice in writing inviting sealed pro-
22 posals or bids for heater remixing and asphalt resurfacing of
23 certain streets in accordance with Contract No. 321, and in
24 ac~rdance with this resolution.
SECTION 4: There being no newspaper of general circula-
25
26 tion printed, publiShed, or circulated in the City of Vernon, the
27 City Clerk is hereby directed to post said notice or cause the
28 same to be posted in three (3) of the most public places in said
29 City, to wit: The northwest corner of 38th Street and Santa F.
30 Avenue; the northeast corner of Leonis Boulevard and Pacific
31 Boulevard; and on the bulletin board in the lobby of the City Hall
32 of the City of Vernon, located at 4305 Santa Fe Avenue, in said

SECTION 5: That the City Council of the City of Vernon

~ has ascertained the general prevailing rate of per diem wages in
4 the locality in which the work described in Contract No. 321 is to
5 be performed, for each craft, classification, or type of workman
6 needed to execute said Contract, and that the general prevailing
7 rate of per diem wages and the general prevailing rate for holiday
8 and overtime work in the locality of the execution of said Contract
9 No. 321 for each craft, classification, or type of workman needed
10 is set forth in said Contract and incorporated by reference at this
11 point for all purposes as if set forth in full and hereby approved
12 by the City Council of the City of Vernon.
SECTION 6: That the City Clerk of the City of Vernon is
13
14 directed to post said notice forthwith, and that the first posting
15 of said notice shall not be less than ten (10) days before the
16 date of opening bids for the proposed work. That said notice shall
17 provide that sealed proposals or bids will be received by the City
18 of Vernon, California, at the office of the City Clerk of said
19 City, at the City Hall, 4305 Santa Fe Avenue, until the hour of
20 two (2) o'clock P.M., on the 16th day of August, 1966, in accord-
21 ance with Contract No. 321 approved by said City.

SECTION 7: The City Clerk of the City of Vernon shall
23
certify to the passage of this Resolution, and thereupon and
thereafter the same shall be in full force and effect.

2 NOTICE INVITING SEALED PROPOSALS OR BIDS FOR HEATER REMIXING AND
ASPHALT RESURFACING OF CERTAIN STREETS, IN ACCORDANCE WITH
'.3 CONTRACT NO. 321 OF THE CITY OF VERNON.
4 Pursuant to Resolution No. 2844 of the City of Vernon,
5 adopted on the 2nd day of August, 1966, directing same, notice is
6 hereby given that sealed proposals or bids will be received by the
7 City of Vernon, California, at the office of the City Clerk of said
8 City, at the City Hall, 4305 Santa Fe Avenue, until the hour of
9 two (2) o'clock P.M., on the 16th day of August, 1966, for heater
10 remixing and asphalt resurfacing of certain streets, in accordance
11 with Contract No. 321 approved by said City. The proposals will
12 be publicly opened and read in the Council Chambers of the City
13 Hall located at 4305 Santa Fe Avenue, Vernon, California, on the
14 date and at the time above mentioned. Specifications and contract
15 documents may be obtained at the above-mentioned office of the
16 City Clerk upon payment of a deposit of ten dollars ($10.00) for
17 each specification.
18 The construction to be done and materials to be furnished
19 under said Contract No. 321 are approximately as follows:

26 The construction shall be in accordance with Plan No.
27 P 1780 and Contract No. 321 heretofore approved by the City Council
28 of said City, and now on file in the office of the City Clerk of
29 said City, a copy of which may be secured from the City Engineer
30 of said City.
31 Bidders are hereby notified that, pursuant to the pro-
32 visions of Sections 1770-1781, inclusive, of the Labor Code of the

1 state of California, the City Council of the City of Vernon has
2 ascertained the general prevailing rate of per diem wages and
~ rates for legal holidays and for overtime work in the locality in
4 which this work is to be performed, for each craft or type of
5 workman or mechanic needed to execute the contract which will be
6 awarded to the successful bidder, and that Resolution No. 2844 of
7 the City of Vernon establishes said rates, and is on file with the
8 City Clerk of the City of Vernon.
9 Notice is further hereby given that all bidders may submit
10 with their bids a sworn statement of their financial responsibility,
11 technical ability and experience. Such sworn statement may be
12 required before award is made to any particular bidder.
13 To be entitled to consideration, each bid submitted pur-
14 suant to this notice shall be made out on a form to be obtained
15 at the Office of the City Engineer; shall be accompanied by a
16 certified check, draft or bid bond, payable at a bank authorized
17 to do business in the State of California, made payable at sight
18 to the City Clerk of the City of Vernon, in an amount equal to
19 ten per cent (10%) of the bid submitted, shall be delivered to the
20 City Clerk of the City of Vernon in a sealed envelope at, or
21 before, the time stated herein, and must be plainly marked
22 ttProposal for Contract No. 321't.
23 The above-mentioned check or bond shall be given as a
24 guarantee that the bidder will enter into a contract if awarded to
25 him and will be declared forfeited if the successful bidder refuses
26 or neglects to enter into a contract of the required form after
27 being requested to do so by the City Clerk of the City 'of Vernon,
28 California. The successful bidder will be required to furnish a
29 labor and material bond in an amount equal to fifty per cent (50%)
30 of the Contract price, and a faithful performance bond in an
31 amount equal to one hundred per cent (100%) of the Contract price.
32 Unless otherwise required by law, no bidder may withdraw

1 his bid for a period of thirty (30) days after the date set for
2 the opening thereof.
~ A deposit of ten dollars ($10.00) will be required to
4 secure the Plans and Specifications, as a guarantee that the Plans
5 and Specifications will be returned, which deposit will be re-
6 funded in case same are returned to the City in good condition not
'1 later than forty-eight (48) hours after the bids on the work will
8 have been opened.
9 The City of Vernon reserves the right to reject any and a1
10 bids or waive any informality in the bid.
