RESOLUTION NO. 2848
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A
ZONING VARIANCE FOR THOMAS A. YBARRA.

4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:

WHEREAS, an application for a zoning variance was filed
6 with the City Clerk on or about June 23, 1966 by Thomas A. Ybarra
'1 for a variance under the provisions of Ordinance No. 752 on that
8 certain parcel of land situated in the City of Vernon, and more
9 particula,ly described as follows, to wit:
10 Lot 4, Block 12 of New Vernon, as recorded in Book 21,
11 Pages 25-26 of Miscellaneous Records in the office of the
12 C9unty Recorder, Los Angeles County, California;
13 WHEREAS, the application for variance was regularly set
14 for hearing before the City Council on the 16th day of August, 1966,
15 at 1:00 o'clock P.K., in the Council Chambers of the City Hall,
16 located at 4305 Santa Fe Avenue, in the City of Vernon, California;

WHEREAS, all notices as required under said Ordinance were
19 regularly and. duly given of the time and place of said hearing, and
20 the City Council having heard the matter on the 16th day of August,
21 1966, at the hour of 1:00 o'clock P.M., in the Council Chambers of
22 the City Council, and all evidence was heard from all persons
23 interested in effecting said variance, and also from all persons
24 protesting the same, and the City Council having heard all the
25 evidence and statements of said persons, and being fully informed
26 in the premises, the matter was submitted for decision, and on
27 August 16, 1966, the Council considered the application and made the
28 following findings and decision:

NOW, THEREFORE, the City Council of the City of Vernon
30 does find as follows:

1. That the property hereinabove referred to and des-
32 cribed is suitable for the purposes for which the petitioner

1 requesting such variance intends to use it, to wit: For the
2 erection, use, and maintenance of a two (2) family residence.
~ 2. That unnecessary hardship would be put upon petitioner
4 as the owner of said property in the use of said property if his
5 request for a variance was denied.
6 3. That results inconsistent with the general purpose of
'1 Ordinance No. 752 would result if the request for such variance was
8 denied.
9 4. That there are exceptional or extraordinary circum-
10 stances or conditions applicable to the property involved, or to
11 the intended use of the property, that do not apply generally to
12 the property or class of uses in the same district or zone.
13 5. That such variance is necessary for the preservation
14 and enjoyment of a substantial property right of the petitioner.
15 6. That the granting of such variance will not be
16 materially detrimental to the public welfare, or injurious to the
17 property or improvements in such zone or district in which the
18 property is located.
19 7. The variance covering the property hereinabove
20 described is granted for the erection, use, and maintenance o.f a
21 two (2) family residence, subject to the following conditions,
22 which the City Council deems proper to preserve the public health,
23 safety, convenience, welfare, and general intent and purpose of the
24 zoning ordinance, as amended:
25 A. The Grantee of the variance shall comply with all
26 City, County, and state laws applicable to said use now in
27 force or hereafter enacted.
28 B. No nuisance shall be permitted on said premises, or
29 result from the granted use.
30 A copy of this Resolution is to be mailed to the applicant
31 for said variance.
32 The City Clerk of the City of Vernon shall certify to the

1 passage of this Resolution and thereupon and thereafter the same
2 shall be in full force and effect.
