RESOLUTION NO. 2963
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, DECLARING
ITS INTENTION TO VACATE AN ALLEY LOCATED WITHIN THE CITY OF VERNON.

4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
5 WHEREAS, that certain hereinafter described alley
6 located within the City of Vernon is deemed no longer necessary
7 for present or prospective street purposes, and
8 WHEREAS, the City Council of the City of Vernon desires
9 to vacate said alley, retaining certain hereinafter described
10 reservations,
111 NOW, THEREFORE, BE IT RESOLVED:

Section 1: That the City Council of the City of Vernon
13 hereby declares its intention to vacate that portion of that
14 certain alley described in Exhibit "Aft attached hereto and
15 incorporated by reference for all purposes as if set forth in
16 full.
Section 2: That June~, 1968 at 2:00 o'clock P.M., in
17
18 the Council Chambers of the City Council of the City of Vernon,
19 located at 4305 Santa Fe Avenue, in the City of Vernon, California,
20 is hereby set as the time and place for public hearing for all
21 persons interested in or objecting to the proposed vacation.

Section 3. That the City Council of the City of VernOn
23 does hereby elect to proceed with such vacation pursuant to the
24 provisions of part 3 of division 9 of the Streets and Highways
25 Code of the state of California.

Section 4: That the City Clerk of the City of Vernon
27 is hereby directed to post conspicuously along the line of said
28 alley, proposed to be vacated, at least ten (10) days before the
29 date set for hearing, notices of street vacation, and such notices
30 shall be posted not more than 300 feet apart, but at least three
31 shall be posted. Such notices shall state the passage of this
32 resolution of intention, and of the time and place of the hearing.

Section 5: That the City Council of the City of Vernon
2 determines that the public convenience and necessity require the
3 reservation of a permanent easement and right at any time, or
4 from time to time, to construct, maintain, operate, replace,
5 remove, and renew sanitary sewers and storm drains and appurtenant
6 structures in, upon, over, and across said alley, and the whole
7 thereof, and, further, the public convenience andrecessity require
8 the reservation on behalf of the City of Vernon of easements to
9 construct, maintain, operate, replace, remove, renew, and enlarge
10 lines of pipe, conduits, cables, wires, poles and other convenient
11 structures, equipment, and fixtures for the operation of gas pipe
12 lines, telegraphic and telephone lines, railroad lines, a,nd for
13 the transportation or distribution of electric energy, petroleum
14 and its products, ammonia, water, and incidental purposes,
15 including the access and the right to keep the property free from
16 inflama,ble materials and root growth, and otherwise protect the
17 same from all hazards, in, upon, and over the alley proposed to be
18 vacated.

Section 6: The proceedings of vacation set forth
20 herein are taken subject to the reservations and exceptions set
21 forth in the preceding section.

Section 7: There being no newspaper printed, published,
23 and circulated in the City of Vernon, the City Clerk is hereby
24 directed to certify to the passage of this resolution, and shall
25 post the same, or cause the same to be posted, in three of the
26 most public places in the City of Vernon, to wit: The northwest
27 corner of 38th Street and Santa Fe Avenue; the northeast corner
28 of Leonis Boulevard and Pacific Boulevard, and on the bulletin
29 board in the lobby of the City Hall of said City, located at 4305
30 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
31 California.
