Resolution No. 2966 ,'- '. "'\I- .... ,.., , . .11 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, DECLARING ITS INTENTION TO VACATE A PORTION OF A STREET LOCATED WITHIN THE CITY OF VERNON. RESOLUTION NO. 2966 3 4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS: 5 WHEREAS, a portion of a public street within the City of 6 Vernon described herein is deemed no longer necessary for present . 7 or prospective purposes, and 8 WHEREAS, the City Council of the City of Vernon desires 9 to vacate the hereinafter described portion of a public street, 10 retaining certain hereinafter described reservations, 11 12 NOW, THEREFORE, BE IT RESOLVED: SECTION 1: That the City Council of the City of Vernon 13 hereby declares its intention to vacate that portion of that certain 14 public street described in Exhibit ttAtt attached hereto and incor- 15 porated by reference for all purposes as if set Iorthin full. 16 SECTION 2: That June 18, 1968, at 2:00 o'clock P.M., in 17 the Council Chamber of the City Council of the City of Vernon, 18 located at 4305 Santa Fe Avenue, in the City of Vernon, California 19 is hereby set as the time and place for public hearing for all 20 persons interested in or objecting to the proposed vacation. 21 SECTION 3: That the City Council of the City of Vernon 22 does hereby elect to proceed with such vacation pursuant to the 23 provisions of part 3 of Division 9 of the Streets and Highways 24 Code.of the State of California. 25 SECTION 4: That the City Clerk of the City of Vernon is 26 ereby directed to post conspicuously along the> line of said 27 ortion of said public street, proposed to be vacated, at least 28 en (10) days before the date set for hearing, notices of street 29 acation, and such notices shall be posted not more than 300 feet 30 part, but at least three shall be posted. Such notices shall state 31 he passage of this resolution of intention, and of the time and 32 lace of the hearing. 1. .. ........ , -. + -.:,..... SECTION 5: That the City Council of the City of Vernon .1 2 determines that the public convenience and necessity require the 3 reservation of a permanent easement and right at any time, or 4 from time to time, to construct, maintain, operate, replace, 5 remove, and renew sanitary sewers and storm drains and appurtenant 6 structures in, upon, over, and across said portion of said public 7 street, and the whole thereof, and further, the public convenience 8 and necessity require the reservation on behalf of the City of 9 Vernon of easements to construct, maintain, operate, replace, 10 remove, renew, rom enlarge lines of pipe, conduits, cables, wires, 11 pOles and other convenient structures, equipment, and fixtures 12 for the operation of gas pipe lines, telegraphic and telephone 13 lines, railroad lines, and for the transportation or distribution 14 of electric energy, petroleum and its products, ammonia, water, 15 and incidental purposes, including the access and the right to 16 keep the property free from inf1amable materials and root growth, 17 and otherwise protect the same from all hazards, in, upon, and 18 over said portion of said street proposed to be vacated. 19 SECTION 6: The proceedings of vacation set forth herein 20 are taken subject to the reservations and exceptions set forth 21 in the preceding section. 22 SECTION 7: There being no newspaper printed, published, 23 and circulated in the City of Vernon, the Cii;y Clerk is hereby 24 directed to certify to the passage of this resolution, and shall 25 post the same, or cause the same to be posted, in three of the 26 most public places in the City of Vernon, to wit: The northwest 27 corner of 38th street and Santa Fe Avenue; the northeast corner 28 of Leonis Boulevard and Pacific Boulevard; and on the bulletin 29 board in the lobby of the City Hall of said City, located at 4305 30 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, 31 California. 32 2. ~ . . ~... ! .1 SECTION 8: That the City Clerk of the City of Vernon 2 shall certify to the passage of this resolution, and thereupon 3 and thereafter the same shall be in full force and effect. 4 ADOPTED and APPROVED this 5th day of June, 1968. 5 6 7 8 9 10 11 12 131 14 15 ~.~ ) ,.", ",.~,.'. pC -~.:.-.:/A /, ~d/<U'2, '/ J o/(e~~n>s C Malt'rg, ~r Pro Tem ATTEST: ~.
