2 A RES.OLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, DECLARING
ITS.I~ION TO VACATE A PORTION OF A STREET LOCATED WITHIN THE
:3 CITY OF VERNON, AND REPEALING RESOLUTION NO. 2966.
4 THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
5 WHEREAS, a portion of a public street within the City
6 of Vernon described herein is deemed no. longer necessary for pre-
7 sent or prospective purposes, and
8 WHEREAS, the City Council of the City of Vernon desires
9 to vacate the hereinafter described portion of a public street,
10 retaining certain hereinafter described reservations, and
IIi WHEREAS, the City Council of the City of Vernon, on
12 June 5, 1968, adopted Resolution 2966, setting the time and place
13 for public hearing for all persons interested in or objecting to
14 the proposed vacation, and
15 WHEREAS, June 18, 1968 was the time set for hearing, and
16 WHEREAS, the time allotted to said public hearing does
17 not meet the statutory requirements, and Resolution 2966 should
18 be repealed,
19 NOW, THEREFORE, BE IT RESOLVED:

SECTION 1: That the City Council of the City of Vernon
21 hereby declares its intention to vacate that portion of that certai
22 public street described in Exhibit "AU attached hereto and in-
23 corporated by reference at this point for all purposes as if set
24 forth in full.

SECTION 2: That July 16, 1968, at 2:00 o'clock P.M., in
26 the Council Chamber of the City Council of the City of Vernon,
27 located at 4305 Santa Fe Avenue, in the City of Vernon, California,
28 is hereby set as the time and place for public hearing for all
29 persons interested in or objecting to the proposed vacation.

SECTION 3: That the City Council of the City of Vernon
31 does hereby elect to proceed with such vacation pursuant to the
32 provisions of part 3 of Division 9 of the Streets and Highways

Code of the state of California.
SECTION 4: That the City Clerk of the City of Vernon is
:3 hereby directed to post conspicuously along the line of sa.id
4 portion of said public street, proposed to be vacated, at least
5 ten (10) days before the date set for hearing, notices of street
6 vacation, and such notices shall be posted not more than 300 feet
7 apart, but at least three shall be posted. Such notices shall
8 state the passage of :this resolution of intention, and of the time
9 and place of the hearing.

SECTION 5: That the City Council of the City of Vernon
III determines that the public convenience .and necessity require the
12 reservation of a permanent easement aalli right at any time or
13 from time to time, to construct, maintain, operate, replace,
14 remove, and renew sanitary sewers and storm drains and appurtenant
15 structures in, upon, over, and across said portion of said public
16 street, and the whole thereof, and further, the public convenience
17 and necessity require the reservation on behalf of the City of
18 Vernon of easements to construct, maintain, operate, replace,
19 remove, renew and enlarge lines of pipe, conduits, cables, wires,
20 pOles and other convenient structures, equipment, and fixtures
211 for the operation of gas pipe lines, telegraphic and telephone
22 lines, railroad lines, and for the transportation or distribution
23 of electric energy, petroleum and its products, ammonia, water,
24 and incidental purposes , including the access and the right to
25 keep the property free from inflamable materials and root growth,
26 and otherwise protect the same from all hazards, in, upon, and
27 over said portion of said street proposed to be vacated.

SECTION 6: The proceedings of vacation set forth herein
29 are taken subject to the reservations and exceptions set forth
30 in the preceding section.

SECTION 7: Resolution No. 2966 previously adopted by the
32 City Council of the City of Vernon is hereby repealed.

SECTION 8: There being no newspaper printed, published,
and circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this resolution, and shall
post the same, or cause the same to be posted, in three of the
most public places in the City of Vernon, to wit: The northwest
corner of 38th Street and Santa Fe Avenue; the northeast corner
of Leonis Boulevard and Pacific Boulevard; and on the bulletin
board in the lobby of the City Hall of said City, located at 4305
Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
California.
SECTION 9: That the City Clerk of the City of Vernon
12 shall certify to the passage of this resolution, and thereupon
13 and thereafter the same shall be in full force and effect.
14 ADOPTED and APPROVED, this 18th day of June, 1968.
