WHEREAS, the employer-employee relationship of all employees in public service should be covered by a single and uniform body of legisla- tion to assure fair and equitable treatment; and WHEREAS, a question presently exists as to whether firefighters emp1o,yer-emp1oyee relations in cities are governed by Chapter 10, Division 4, Title 1 of the Government Code, or by Chapter 4 of Part 7 of Division 2 of the Labor Code; and WHEREAS, the Legislative Counsel of the State of California has ex- pressed the opinion that the courts might rule the Labor Code sections have precedence over the Government Code provisions; and WHEREAS, Assembly Bill 1356, as introduced by Assemblyman Robert Burke, would clarify the situation and cause firefighters to be covered by the Employer-Employee Relations Act as embodied in Senate Bill 1228; and WHEREAS, this Council believes uniformity of regulation of all employees would be in the best interest of both cities and city employees; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa, that all cities and their representatives in the State Legis- lature are urged to give their support and endorsement to Assembly Bill 1356 in order that uniform regulation of employer-employee relationships may be attained for all public employees.
