RESOLUTION NO. 3031
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, ACCEPTING
THE BID OF E. D. JOHNSON & COMPANY FOR TRAFFIC SIGNAL MAINTENANCE,
1969 TO 1974, IN ACCORDANCE WITH CONTRACT NO. 341.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, Contract No. 341 was approved by the City Council
of the City of Vernon by Resolution No. 3021, and pursuant thereto
sealed bids were opened .on July 15, 1969, and
WHEREAS, said bids were referred to Arthur E. Nelson, Jr.,
City Engineer and Interim Traffic Engineer, who has reported to
the City Council under date of July 22, 1969, recommending that
the contract be awarded to E. D. Johnson & Company, their bid being
the lowest bid meeting the contract requirements, and
WHEREAS, Arthur E. Nelson, Jr., City Engineer and Interim
Traffic Engineer, has further recommended that the bid bond in the
amount of ten (10%) per cent of the amount bid, not meeting the
requirements of the notice inviting bids be considered an informali~
ty, and the failure to comply be waived,
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: That the .City Council of the City of Vernon
20 does hereby award the contract in accordance with the recommenda-
21 tions of Arthur E. Nelson, Jr., City Engineer and Interim Traffic
22 Engineer, and authorizes the execution of a contract with E. D.
23 Johnson & Company for traffic signal maintenance, 1969 to 1974,
24 according to contract No. 341 heretofore approved by the City
25 Council of the City of Vernon.

SECTION 2: That all other bids are rejected and the City
27 Clerk is hereby instructed to return all checks or drafts to
29
28 unsuccessful bidders.
SECTION 3: That the City Council of the City of Vernon
30 does hereby determine that the bid bond supplied by the successful
31 bidder, E. D. Johnson & Company, is not sufficient but that the
32 same is a mere informality, and said informality is hereby waived

1 by the City Council of the City of Vernon upon condition that
2 prior to the execution of said contract a $5,000.00 bond, approved
;3 by the City Attorney of the City of Vernon, be deposited with the
4 City Clerk of the City of Vernon, in accordance with Contract No.
5 341.

SECTION 4: That the City Clerk of the City of Vernon shall
7 certify to the passage of this resolution and thereupon and there-
8 after the same shall be in full force and effect.
9 ADOPTED and APPROVED this 5th day of August, 1969.
