Ziemer, City Clerk Director of Finance City Hall 4305 Santa Fe Avenue Vernon, California 90058 Dear Mr. Ziemer: Thank you very much for your recent correspondence relating to A.B. 908 (Bagley) which seeks to impose a 14 percent excise tax on municipally owned (government) utilities. As you are undoubtedly aware, this measure passed the Assembly Com- mittee on Revenue and Taxation and has been sent to the Committee on Ways and Means. As a member of the Committee on Revenue and Taxation, I voted in favor of its passage. As presented in testimony, while the municipal utility tax exempt status helps keep its rates low, these utilities also enjoy other benefits not affected by A.B. 908, which help keep their prices down (to wit) the ability to market tax exempt bonds, the ability to purchase power at wholesale prices from private utilities, exemption from federal income taxes and preferential treatment in the purchase of power from federal power facilities. The basic inequity in the pres- ent system occurs when the customer of the investor-owned utility pays taxes to support state and local government while publicly-owned utility rates do not re- flect state income taxes and local property taxes. Also, according to the analysis of the consultants of the Committee on Revenue and Taxation, the argument regarding the taxing of municipal utilities as "taxing governments" is baseless under the precedent set by the Tennessee Valley Authority and its related local utility corporations. The Tennessee Valley Authority and its major users have paid and will continue to pay, in lieu taxes to local govern- ments, based on a long standing agreement to compensate those governments for the loss of revenue sustained when the Tennessee Valley Authority moved in. There- fore, there is a precedent for the proposal. In addition, all governments including public utilities pay California sales taxes. ~ " f May 15, 1970 Page 2 Further, it has been suggested that a better way to tax municipal utilities would be simply to remove their property tax exemption from the constitution and treat them as any other utility would be treated. Certainly if such a proposal were to pass the Legislature and go on the ballot, the Legislature would be able to repeal A. B. 908 or its law and thus avoid double taxation.
